AN ORDINANCE OF THE CITY OF HUNTI14GTON BEACH
g AIVIENDING 011INANCE 110. 226 OF SAID CITY.'
8 The Board of Trustees of the City of Huntington Beach do
4 ordain as follows:
5 Section 1. That a new section be added to Ordinance No. 226
6 of said City, entitled, "An Ordinance of the City of Huntington
. 7 Beach to be known as the Building Ordinance , regulating the
8 construction, alteration, repair and demolition of buildings .
9 and structures and parts thereof and providing for fire protect-
10 ion; regulating area ways and materials and machinery and use of
11 streets in conne,etion with building or wrecking operations pro-
12 viding for permits for same , and. repealing all ordinances in con-
t
13 flict therewith, which said new section Shall be numbered-
14 Sectiod 37 , and shall be in words and figures as follows , to-wit:
15 c( Section 37- , It shall be unlawful for any person, firm or
16 corporation to erect, construct or build or ca,�se to be erected ,
17 constructed or built , within the residential district as described
18 in Ordinance No. 209 of said City, entitled "An Ordinance of the
19 City of Huntington Beach, California, establishing a business
20 and residence district in said City and prohibiting the
21 establishment or maintenance of certain businesses and industries

22 in said district" as amended by Ordinance No. . 211 of said City)
23 4ny building, house, dwelling or structure to be used for human
24 habitat"on or for sleeping, living or for eating purposes,
25 unless .such building, house, dwelling or structure is of stud
26 and post and girder construction upon concrete or brick foundation
27 and the floor of such building is at least eighteen (18) inches
28 above the surface of the ground and has adequate ventilation
29 under said floor and said house , building, or structure contains
30 not less than four hundred (400) square feet of superficial floor ,
31 area in each part of portion of said house, dwelling, or structure
32 which shall be designed,.;' to be or shall be used as dwelling o
1 or sleeping or living quarters or for . human habitation by separate
2 family of one or more persons, and shall be lathed and plastered
3 throughout on 4JVmt6Wpide , except for window and door trim, or
4 covered on wi` k ide;throughout with some preparation or substance
5 which shall be equally fire resistive or retardant: No California
6 construction so called, shal be used. In every- ease where two
7 or more houses, dwellings or structures intended for human
8 habitation, or houses, dwellings or structures intended for habi-
9 tation by two or more families of one or more persons are erected
10 upon the same lot or pair of lots or upon any portion of the same
11 lot or pair of lots , so that one of said buildings or portion of
12 said building intended for separate occupation is behind another
13 building, or portion of building intended for separate occupation,_
or portion of building intended for separate occupation
14 the rear building shall have direct access to the street by means
15 of a pas.sage way not less than ten (10) feet in width and the
16 width of s .id passage way shall be increased two (2) feet for each
17 house or portion of said building intended for separate occupation
18 in excess of two, placed upon said lot or pair of lots. ° No part
19 I10 f any jhouse , dwelling or structure used for human habitation shall
20be nearer to any other .house , dwelling or structure

22 The word "lot", as used in this section shall be construed to
23 'mean any subdivided portion of any block as shown on a map of said
4 24 'property as recorded in the office of the County Recorder of the
25 County of Orange or any portion of said lot belonging to any person
26 ;separate from the balance of said lot. The words "pair of lots"

Is used herein shall be construed to mean,any two lots lying
28 adjacent to each other and belonging to the same person upon which
29 any improvement is to be erected,. .
30 Section 11. The City Clerk shall certify to the passage of
31 this Ordinance and shall cause the same to be published by one
32 insertion in the Huntington Beach News. `Phis Ordinance is necessary

1 for the immediate preservation of the public peace , health and
8 safety and the facts constituting such urgency are as follows:
3 ' zany small buildings lacking sanitary requirements and constituting
4 fire menace are now being erected in this city and there:: is danger
5 of more buildings of similar character being erected herein which
6 said buildings are a'dangar to the public health and ..to the public

safety, therefore this Ordinance shall take effect from and. after
8 its passage.
9 Passed and adopted this 16th day of April, 1923:
