An Ordinance of the City of Huntington Beach, a Muni-
cipal corporation of the Sixth Glass, incorporated under the
�. Laws of the State of California, ordering the sub41ission to the .
qualified voters of said city, the proposition of incurring* a
bonded debt of said City for the purpose of -the acquisition,
construction and completion by and in said C itSt of municipal,
improvements, providing for the issuing of bonds therefor, the
rate of interest thereon and the levy of a tax for the payment
of said bonds and the inte rest the re on; .f ixing the date on which
such election is to be held, the manner of holding such elec-
t ion, the polling place of such election and the officers the;re -
of, and providing that in all particulars not recited in this
Ordinance ., such election shall be held as provided by law f or
holding municipal elections in the City of Huntington Beach,
California,

BE IT RESOLVED by the Board of Trustees of the City
of Hun•tingtonBeacll,California, as follows:
Section 1. That it is hereby determined by the
Board of Trustees of the said City of Huntington Beach,
California, that the public interest and necessity demands the
acquisition, construction and completion in the City of Hunting-
ton Beach,California, of the following municipal improvements
and each of them, to wit:
(a) The acquisition, construction and completion
of a Municipal Wharf together with such equipment and appurte -
nances as may be necessary or convenient to the use thereof; j
said Wharf to extend into the Pacific Ocean from the outer end
of the Municipal Wharf now extending into the Pacific Ocean from
the termination of main Street in the City of Huntington Beach
_ at the Coast line of said Ocean, -

(b) The acquisition,. construction and completion
of sewe r disposal plant consisting of an incinerator,
and such equipment and appurtenances as may
be necessary or convenient to the use thereof
( c) Street work,- consisting of the acquisition of
equipment for doing street �,liork * including street cleaning equip-
ment in the City of Huntington Beach;
(d) The acquisition of property for a public park .
along the Coast Line of the Pac ific Ocean within the City
of Huntington Be ac h.
(e ) The construction and completion by improving
and equipping, of parks and play grounds s:,rithin the City of
Huntington Be ac h.
(f) The acquisition, construction and completion
of a sewer system for the carrying and disposal of storm sur-
face iNrate rs within the City of Huntington Be ac h.
Section 2. That it is hereby determined that the
said Municipal Improvements are , and-each of them is necessary
and convenient to carry out the objects,purposes and powers
of said City of Huntington Beach.
Section 3. That it is hereby determined that the
cost of said municipal improvements described as the acquisi-
tion, construction and completion of municipal Wharf,to-
gether with equipment and appurtenances as may be necessary
or convenient to the use thereof; said Wharf to extend into
the Pacific Ocean from the outer end of the I+municipal Wharf
now extending into the Pacific Ocean from the termination of
Main Street in the City of Huntington Beach at the Coast line
of said Ocean, is and will be too great to be paid out of the
Ordinary annual inc ome and, re venue of said C ity of Hunt ington
Beach, and that the estimated cost of said improvement is one
hundred thousand ($100, 000. 00) dollars and that it is and will
?e necessary for .the City of Huntington Beach to incur a bonded
debt in the amount. of one hundred thousand ( 100, 000. 00) dollars
for the purpose of the acquisition, construction and completion
of said improvement.
Section 4. That it is hereby determined that the
cost of said-municipal improvement described as the acquisition,
construction and completion of sewer disposal plant consisting
of an -incinerator, and such equipment and appurtenancep as may
be necessary or convenient to the use thereof; is and will be

too 'great to be ;paid out of the ordinary, annual income' and
revenue of said City of Huntington Beach, and that the e s-
timated cost of said improvement is twenty-five thousand
($25, 000. 00) dollars 'and that it' is and will -be ne ce ssary _f or.
the C ity of Hunt ington Be ach t o incur- a bonded debt in the
amount of twenty-five thousand ($25, 000. 00) dollars for the
purpose of the acquisition, construction and completion of
said municipal improvement.
Section 5. That it is hereby determined that the
cost of said municipal improvement described as street work
consisting of the acquisition of equipment for doing street
work including street cleaning a quipme nt in the City of
Huntington Beach, is and will be too great to be paid out of
the ordinary annual income and revenue of said City of
Huntington Beach, and that the estimated cost of said im-
provement is twelve thousand ($12,000. 00) dollars and that
it is and will be necessary for the City of-Huntington Beach
'to incur a bonded debt in the amount of twelve thousand
($12, 000. 00) dollars for the purpose of the acquisition, of
said municipal improvement&
Section 6. That it is hereby determined that the
cost of said municipal improvement described as the acquisi-
tion of property along the coast line of the Pacific Ocean
within the City of Huntington Beach for a public nark is and
will be too great to be paid out of the ordinary annual in-
come and revenue of said City of Huntington Beach,and that
the estimated cost of said improvement is seventy-five thous-
and (0?5, 000. 00) dollars and that it is and will be necessary
.for the City of Huntington Beach to incur a .bonded debt in the
amount of seventy-fife t494band ($75, 000. 00) dollars for the
purpose of the acquisition of said municipal improvement.
Section 7. ' That it is hereby determined that the
cost of said municipal improvement described as the c onst ruc-
t ion and completion by improving and equipping of parks and
play grounds wit�iin the City 'of Huntington Beach is and will
be too great to be. paid out of the ordinary annual income and
revenue of said City of Huntington Beach, and that the estimated
cost of. said improvement is twenty thousand ($20, 000. 00) dollars
and that it is and will be necessary for the City of Huntington
Beach -to incur a bonded debt in the amount of twenty thousand
($20, 000. 00) dollars for the purpose of the construction and
completion of said improvement.
Section 8. That it is hereby determined that the
cost of said municipal improvement described as the acquisi-
tion, construction and completion of a sewer system for the
carrying and disposal of storm surface waters within the City
of Huntington Beach, is and will .be too great to be paid out
of the ordinary annual income and revenue of said City of .
Huntington Beach., and that the estimated cost of said improve -
ment is twenty thousand ($20, 000. 00) dollars and that it is
and will be necessary for the City of Huntington Beach to in-
cur a bonded debt in the amount of ten thousand (4�10, 000. 00)
dollars for 'the purpose of the acquisition, construction and
completion of said municipal improvement.
Section 9. That the City Clerk shall attest this
Resolution and shall certify to the passage and adoption there -
of and the vote tre re on; and shall c au se the same ,t o-ge the r
with his certifiedte to be entered in the Book of Resolutions
of said City, and shall make a minute of the passage and adopt-
ion thereof in the minutes of. the meeting at which the same is
passed and adopted.

AND WHEREAS, it was de to rmine d by said Board of
Trustees by a vote of more , than two-thirds (2/3) of all its
members that the cost of said municipal improvement and each
of them is and will be too great to be paid out of the ordinary
annual income and revenue of said City of Huntington Beach and
that the estimated cost of said improvement described as "The
acquisition, construction and completion of a municipal wharf
together with such equipment and appurte-nance s as may be ne c-
essary or convenient to the use there of; said Wharf to .extend

NOVI THERXFORE, at this, a subsequent meting of the said
Board of Trustees of said City, to the meeting at which said Re -
solut ion No. 453 of said Board of Trustees was passed and adopted,

The Board- of Trustees of the City of Huntington Beach
do ordain as follows;

SECTION 1. That a special election be held in .the
City of Huntington Beach,California for the object and purpose
of subz,iitting to the qualified voters and electors of said City
of Huntington Beach the proposition of incurring a bonded debt
of said C ity f or the objects and purpose s set f orth in said
Resolution No. 453 of' the Board, of Trustees of said City and
he re inaf to r set forth.
SECTION 2. That the objects and purposes for which
it is proposed to incurt said bonded debts and each of. them and
the amounts the re of are as follows; 4A) a bonded debt in the j
sum of one hundred thousand ($100, 000. 00) dollars for the ac-
quisition, construction and completion of a municipal wharf toge -

(2) A bonded debt in the sum of twenty-five thousand
dollars ($25, 000. 00)- for the acquisition, construction and com-
pletion of sewer disposal plant consisting of an Incinerator,

City of Huntington Beach;
(p) A bonded debt in the sum of twenty thousand

indebtedness to be incurred by said City for the acquisition,

section 6. That the maximum rate of inte re st t o be
paid on such indebtedness is six per cent ( 6 00 per annum, and j
said interest shall be paid semi-annually.
Section 7. That the indebtedness which it is pro4
Posed to incur for said improvements and all of them,together
with all existing indebtedness of said City, does not exceed
i fifteen per cent (15%) of the assessed value of all the real
and personal property of said City of Huntington Beach.
Section 8. That the cost of the acquisition, con-
struction and completion by the said City of Huntington Beach
of said municipal improvements and each of them is and will be
too great to be paid out of the ordinary annual income and re -
venue of said City; that such cost, in addition to, other ex-
penditures of said City will exceed the income and revenue pro-
vided for in any one year; .that the acquisition, construction
and completion by said City of Huntington Beach of said munici-
pal improvements and. each of them is necessary and convenient
to carry out the object and purposes of the municipality of the
City of Huntington Be ac h, and that the cost of the acquisition,
j construction and completion of said municipal improvements and
each of them requires an expenditure greater than the amount
allowed for such improvements by the annual tax levy.
Section g. That an election is hereby called and
ordered to be held at and within the City 'of Huntington Beach,

voters of the said City of Huntington Beach by printed ballot and

Election Precincts, which said Precinctis shall be known as
Huntington Beach Consolidated Voting Precinct No. "A", Hun-
tington Beach Consolidated Voting Precinct "B". Said Hunting-
ton Beach Consolidated Voting Precinct No. "A" shall embrace
the same territories as and have the same exterior boundaries
as, and shall include all territory within Huntington Beach
Genewal Election Precincts No. 1, No 2, No 39 No 9 and No.10.

shall embrace the same territories as and have the same ex-
terior boundaries as, and shall include all territory within

the precincts last established and designated by the Board
of Supervisors of the County of Ora_nge ,State of Cal ifornia,for

SECTION 13. _In all particulars not recited in this
Ordinance , said Special Election shall be held and conducted
as provided by Law for holding Municipal Elections in the City
of .Hunt ingt on Be ac h.
SECTION 14, Any qualified voter may at said special
election, vote in favor of the propos it ionz submitte d, by
stamping a cross (X) on his or her aallot in the voting square
at the right of the word "YES" following the proposition voted
upon and an qualified voter m vote a inst the propositions

"submitted by stamping a cross (X) on his or her ballot in the
voting square at the right of the. word "NO" following the pro-
Gposition voted upon.
SECTION 15. If any voter at said special election
shall have stamped a cross (X) on his or her ballot in the
- voting square at the right of the word "YES" follmning the pro-
position voted upon, his or her ballot shall be counted in
favor of incurring the bonded debt mentioned in said pro-
position.; and,- if arty voter at said special election, shall
have stamp6d a cross (X) on his or her ballot in the voting
square at the right of the word "NO" following the proposi-
tion voted upon, his or her ballot shall be counted against
incurring the bonded debt mentioned in said proposition.
SECTION 16. The City Clerk is hereby directed to
i procure all supplies that may be necessary to properly and
lawfully conduct said special election.
That when the polls are closed, the return of `said
election shall forthwith be made to the Board of Trustees
of said City and signed by the officers of election ands shall
be by them deposited with the City Clerk, together with the
abllots cast at said election and the Board of Trustees of
said City shall meet and canvass said returns in the council
chamber at the City Hall of said City, being the ngular
meeting .place of said Board of Trustees on the QM day of
1 : .,1924, at the hour of ! 30 o'clock P.T .
oi` said`Vday, and if upon such canvass, it' shall be found that
at least Vwo-thirds of the qualified voters of the said City
of Huntington Beach, voting at said special election,voted in
r favor of said proposition then bonds of the City of Huntington
Beach,Cali fornia, shall be issued by said City ih the amount
mentioned in the proposition for which at least two-thirds of
the .qualified/,voters of said City of Huntington Beach voting
at said Special Election voted favorably, which said bonds
shall be issued for the purpose of the acquisition, construc- i
tion and completion of the municipal improvement favorably
voted upon; said fonds shall not be sold for less than the
par value and the proceeds from the sale of such bonds shall
be placed in the treasury ofthe-C ity of Huntington Beach to
the credit of Special Funds and shall be applied exclusively
to the purposes and objects mentioned in this Ordinance and
for which the same was favorably voted.
SECTION 17. That for the purpose of, paying the prin-
cipal and interest of- said bonds, the Board of Trustees of

of said City shall, at the time of f ixing the 'general tax
levy, and in the manner for such general tax levy provided,
levy, and collect annually each year until such bonds are
paid, or unt it the re' be a sum in the treasury of said C ity
Pet apart for that purpose to meet all sums coming due for.

the princ ipa� thereof as shall become due before the .time.
for fixing the next general tax levy; provided however,that
i if the maturity of,- tine indebtedbe ss created by the issuance
of said bonds be made 'to begin more than one year after the
date. of the issuance of saia bnnds9 such tax shall be - levied
and collected at the time and in vim manner of ore said,an-
nually each year, sufficient to pay the interest on such in-
debtedness as it falls due and also to constitute a sinking
fund for the payment of the principal the re of on or before
maturity. That such taxes shall be in addition to all other
taxes 'levied for municipal purposes and shall be collected
at the time and in the same manner as other mun is ipal t axe s
are collected and shall be used for no other purpose than
the payment of said bonds and accruing interest.
SECTION 18. . The City C le rk shall certify to the
passage and adoption of this Ordinance by more than twe-
thirds vote of all the members of the Board of Trustees of
said City of. Huntington Beach.
/ SECTION 19. There being newspaper g n opublished 'in
said City of Huntington Beach, at least six days a week,the re=
fore, this .Ordinance shall be published once a week for
weeks by one insertion eack-week for successive weeks

SECTION 20. No other notice of said election than
the publication ordered in Section 19 of this Ordinance shall
be deemed necessary and said publication of this Ordinance
