AN ORDINANCE PROVIDING CERTAIN FIRE- PREVENTION MEASURES IN
THE OIL FIELDS; REGULATING THE USE -OF CERTAIN STREETS AND
1 HIGHWAYS WITHIN THE CITY; REPEALING ALL ORDINANCES AND PARTS
OF ORDINANCES IN CONFLICT WITH THIS _ORDINANCE AND PROVIDING
2 PENALTIES FOR. THE VIOLATION HEREOF,
3 Tha Board of Trustees of the City of Huntington Beach do ordain
4 as follows;
5 Section 1® It is hereby declared to be unlawful for any person to
-
6 smoke or throw, place or deposit any lighted or smouldering cigar, cig.
7 arette, ash, match or other exposed smouldering or burling' substance
g within twenty-five (25) feet of any oil well, derrick., oil refinery,
9 gasoline absorption plant, gas compression plant, oil pumping plant or
10 storage plant or storage tank or oil sump containing petroleum or any
11 of its inflamable or fluid by.-products.;
12 Section 2, It shall be unlawful for any person, firm or corporation,

W > ®. 14 or permit any oil, waste oil, oil refuse or oil waste matter to remain

a < z 15 on the surface of the ground around or near any derrick, in any derrick
= 16 cellar, around or near any oil storage or bleeder tank, around or near
! 17 any oil pump or around or near any combustible structure, except within

is an oil sump or oil tank, and all such persons, firms or corporations
19 shall - v such oil, waste oil, oil refuse or oil waste

20 matter, within forty,.-eight (4-9) hours after the spill or deposit oc.:.

i 22 Section 30 It shall be unlawful for any person, firm or corporation,
23 whether as principal, agent,, servant, employee, or otherwise, to permit
. 24 any open flame of,any kind within twenty-five (25) feet of any oil well
25 while it is actually producing, or within twenty-five feet of any stor..
26 age tank or sump containing petroleum or any of its inflamable by..
27 products.
29 Section 4. It shall be unlawful for any person, firm, or corpora-
29 tion, whether as principal, agent, servant, employee, or otherwise,

4 , . without equipping the same with a water sprinkler
5 system, as hereinafter described, which shall be so installed and main.=
6 tained as to beoapable ,of effectively covering the entire derrick with
7 water at all times.
8 Such water sprinkling system shall be provided with a remote con,
9 trol on the premises at least thirty-five (35) feet from the, base of
10 the derrick and at a point in such premises nearest the most accessible
11 standard fire department connection for a two and one-half (2�) inch
a 12 hose coupling. A sign locating this connection and bearing the follow..

W W14 "Sprinkler" , shall be posted at each such fire department connection.

a < ? 15 Such Sprinkler system shall be of a manually controlled type and shall b
16 tested upon the completion of the installation thereof, and every thirty
17 (30) days thereafter., If any defects are apparent when the test is made
18 they shall be immediately corrected so as to make the entire system
19 effective,
20 Section 5, ' It shall be unlawful for any person, firm; or corpora-
21 tion, whether .as principal, agent, servant, employee, or otherwise, to

22 maintain any oil derrick or rig unless such derrick ,or rig, during all
23 of the time of' its erection, construction and maintenance, be equipped
24 with at least two two and one-half (22) gallon "foam!° type extinguishers
25 located on the outside of such derrick or rig, and hung in a convenient
26 and easily accessible plaoe. None of such extinguishers shall be re..
27 moved from such derrick or rig except for use or recharging.
28 Section 6. It shall be unlawful for any

1 treats gib, oil, or its by.-products unless such plant be equipped with
2 at least two two and one-half (21) gallon "foam". type ,extinguishers
3 where the floor area is.five hundred (500) square feet or less, and one
4 additional extinguisher for each1fifteen hundred (1500) square feet or
5 fraction .thereof of additional floor area. Each such "foam" type ex...
6 tinguishers shall be approved by the Underwriters Laboratories, Inc. and
7 shall be recharged at least once a year or oftener, if necessary, and
8 must be tagged to show the date when last recharged. Each such exting=.
9 uisher shall be hung in a convenient and easily accessible place except
10 when removed for use or recharging,
11 Section 7. It shall be unlawful for any person, .firm, .or corpora..
12 tion, whether as principal, agent, servant, employee, or otherwise, to

is Section -It is hereby declared to be unlawful for any person,
17 firm, or corporation, whether as principal, agent, servant, employee,
18 or otherwise, to allow or permit any derrick to remain upon any premiss.
1.9 es, upon which drilling operations have been conducted, for a longer
20 period than sixty (60) days after the oil or gas well for which such
21 derrick was used has been abandoned.' For the purpose of this ordinance,
22 the filing of a notice of abandonment with the State Bureau of Mines
23 shall be deemed evidence of an abandonment. Provided, however, that

24 nothing herein contained shall psamU the storage of_:-oil drilling equip—'
25 ment or supplies on such premises.
26 Section 9. It shall .be unlawful for .any person, firm, or corpora.:
27 tion, whether as principal, agent, servant, employee, or otherwise, to
28 operate any gas or steam engine, without having thereto attached and
29 matntained during all of the time said gad or steam engine- is in opera..
30 tion, a muffler to lessen the noise of the exhaust.
31 Section 10, It shall be unlawful for any person, firm, or corpor

1 tion, whether as principal., agent, servant, employee, or otherwise, to '
2 cause or permit crude, distilled or refined oil or petroleum, or waste
3 water, or mud, to become deposited upon, or flow upon, into gr across
4 any sidewalk, curb or street, or into any drainage system or gutters*
5 Section 11m. It shall be unlawful for any person, firm, or corpor..
6 anon, whether as principal, agent., .servant, employee, or otherwise,
7 to fire, operate, use, or maintain any power boiler for the generation
8 of steam power, without equipping the smoke=stack with a screen or other
9 adequate device to prevent . the escape from said smoke.-stack of sparks
10 or ignited carbon or soot;-
11 Section 12. All Ordinances and parts of Ordinances in conflict i
12 with this ordinance are hereby repealed.

m g E 13 Section 13. Every person, firm, or corporation, whether as prin-
W ' m 14 cipal, agent, servant, employee, .or otherwise, violating or failing,

a < ? 15 neglecting or refusing to comply with any of the provisions of this

16 Ordinance shall be deemed guilty of a misdemeanor and, upon conviction
17 thereof., shall be punished by a fine not exceeding Five Hundred Dollars
18 ($500000) , or by imprisonment for not more than six (6) months, or by

19 both such fine and imprisonment; and each such person, firm, or corpor-.
20 ation shall be deemed guilty' of a seperate offense for each day during
21 any portion .of which the violation of or failure, neglect or refusal
22 to comply with any of the provisions of this Ordinance is committed,
23 continued or permitted-,
24 Section 14. The City Clerk shall certify to the passage of- this
25 Ordinance by the Board of Trustees of the City of .Huntington 15each and
26 cause the same to be published once in Huntington Beach News, .An emer-
27 gency has arisen which endangers the peace,' .health, safety and property
28
of citizens of Huntington Beach, as follows; Certain territory within
29 the limits of the Municipality of the City of Huntington Beach is about
30 to be drilled and explored for oil, gas, and other hydrocarbon substanc-
31 es and unless- regulated and controlled b
� y appropriate Ordinance the ,

1 operations are likely to constitute a fire menace, and unless conducted
2 in an orderly and cleanly manner will constitute a menace to health and
3 safety, and cause the destruction of the . improvements upon and-along
4 streets and highways. Therefore, this Ordinance shall. take effect from
5 and after its passage,
