HomeMy WebLinkAboutOrdinance #287 ORDINANCE NO. 287 I AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH PROVIDING FOR THE APPOINTMENT OF AN 'EXAMINER OF MECHANICAL ENGINEERS" , PRESCRIBING HIS DUTIES_AND POWERS AND REGULATING THE OPER- ATION OF STEAM BOILERS . The Board of Trustees of the City of Huntington Beach do ordain as follows: Section 1. That an office to be designated as EXAMINER OF MECHANICAL ENGINEERS is hereby created to consist of one person who shall be appointed by the Board of Trustees. The person so appointed shall be of good moral character and habits and shall have had at least ten years actual axperience in the operation of steam boilers and engines. The term of office of said EXAMINER OF MECHANICAL ENGINEERS shall be at the pleasure of the Board of Trustees. It shall be the duty of the EXAMINER OF MECHANICAL ENGIN_ EERS to examine all persons desiring to apply for license to operate steam boilers for power purposes and to issue to such person so ex- amined a certificate of qualification in each case where the appli- cant for examination shall have produced evidence satisfactory to the Examiner that such person is qualified in point of learning, experi- ence and ability to properly and safely operate steam ,power boilers and engines such as are ordinarily and customarily used in the oil fields for the operation of oil wells and works. Every person desiring to apply for a license to operate steam boilers--for the generation of steam for power purposes shall, before applying for a license therefor, first apply to the EXAMINER OF MECHANICAL ENGINEERS for examination as to his qualifications to operate the same. Each such application for examination shall be ac- companied by a fee of fifty cents, and suc_.h references as the appli- cant may desire to present to the EXAMINER OF MECHANICAL ENGINEERS as to the good moral character and experience and ability of the i . person so applying for examination. The madhamit EXAMINER OF MECHANICAL ENGINEERS shall, at the time of receiving any such application, fix- - ,. a time, place and date for said examination, which shall be not more than five days after the day on which the application is received by him, and shall examine the applicant at said time and place; PaQVIDED, that the time for such examination may be extended from time�Rt Rg request of applicant. All applications for license to operate any such steam boiler or boilers, shall apply to the City Engineer for such license. Every application to the City Engineer hereunder shall be accompan- ied by a Certificate of Qualification issued by the EXAMINER OF MECHANICAL ENGINEERS, bearing the name of the applicant, and signed by the EXAMINER OF MECHANICAL ENGINEERS. The applicant for license shall pay to the City Engineer at the time of annlyiZg for license the sum of One ($1.00) Dollar, which shall be t'1he license fee, and for all services of the City Engineer in examininr_s the Certificate of Qualification, recording the license, and issuing the license. SECTION 2. No person, firm, or corporation shall operate or cause or permit to be operated any steam boiler mmmengtm for the genera- ' tion of steam for power purposes unless such boilers are operated by and under the constant charge and control of an engineer duly licensed in accordance with the provisions of this ordinance. No such engin- eer shall be permitted by any such person, fiem or corporation to leave such boiler or boilers while in operation unless relieved by another licensed engineer as contemplated by this ordinance. SECTION . The EXAMINER OF MECHANICAL ENGINEERS shall receive as and j for his full compensation for all services performed by him and for t1B Performance of all of the duties of his office, the sum of fifty cents - I �I - '6 to for each and every examination made by him in accordance with the zhammm provisions of this Ordinance, which sum he shall collect from each applicant for examination. SECTION 4. Every person applying to the EXAMINER of Mechanical Engineers for examination, and who has actually been examined under the provisions of this ordinance as to his qualifications to operate such boiler or boilers, who feels aggrieved at the decision of the said Examiner of Mechanical Engineers, shall have his right to appeal to the Board of Trustees of the City of Huntington Beach from such decision, and the decision of the said Board of Trustees shall be final. SECTION 5. Any person, firm, or corporation violating any of the pro- visions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not to exceed Three Hundred ($300.00) Dollars, or by imprisonment in the city or county, jail for a period of not to exceed ninety days, or by both such fine and imprisonment. SECTION 6. A condition has arisen and exists which endangers the public peace, health, safety and comfort, and public and private pro- perty and the Board of Trustees declare this an emergency-measure for j the imiaediate preservation of public peace, health and safety and that unless regulated and controlled immediately by appropriate ordinance the operation of steam boilers for power purposes will constitute a menace to the public. = The CityClerk shall certify to the passage of this Ordin- ance Y P g ance and shall cause the same to be published once in Huntington Beach Nevis, a newspaper published and circulated weekly in the City of Huntington Beach, California, and this Ordinance shall be in force and effect immediately upon the publication thereof.
