OF SAID CITY ENTITLED "AN ORDINANCE OF THE CITY OF HUNTI,'GTON BEACH
PROVIDING FOR THE APPOINTMENT OF AN EXAMINER OF' RECHANICAL ENGINEERS

The Board of Trustees of the City of Huntington Beach do ordain !as follows ; _
Section 1. That Ordinance No. 287 of the City of Huntington Beach
entitled 11An ordinance of the City of Huntington Beach providing for the
appointment of an examiner of mechanical engineers, prescribing his
duties and regulating the operation of steam boilers ." be and it is here-
by repealed.
Section 2. The City Clerk shall certify to the passage of this
Ordinance by the Board of Trustees of the City of Huntington

ly newspaper published, printed and circulated in the City of Huntington

AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH, ORANGE COUNTY , STATE OF
CALIFORNIA, FOR PUBLIC INTEREST 'AND NECESSITY, ORDERING A SPECIAL
ELECTION TO BE HELD IN SAID CITY FOR THE PURPOSE OF SUBMITTING TO THE -
j QUALIFIED VOTERS OF SAID CITY THE PORPOSITIOU OF SELLING A PUBLIC _
UTILITY 071MED BY SAID CITY OF HUNTINGTON BEACH, TO- WIT: : THE .GAS DIS—
TRIBUTING SYSTEM, WORKS, EQUIPMENT AND APPURTENANCES, AND DESIGNATING
THE PURPOSE FOR WHICH THE PROCEEDS OF SALE ARE PROPOSED TO BE EXPENDED,
THE TIME AND MANNER OF HOLDING SAID ELECTION AND THE MANNER OF VOTING
FOR OR AGAINST SAID SALE.
The,'.-Board of Trustees of the City of Huntington Beach do ordain
as follows :
e s Section 1. That public interest and necessity demands that a
public utility, to=grit : the Gas Distributing System, works, equipment
and appurtenances owned by said City of Huntington Beach should be sold, -
and that pursuant to and in accordance with the laves of the State of
California, and particularly an' act of the Legislature of the -State of
California, entitled An act authorizing cities, tov+rns and municipal
corporations to sell an,"a dispose of public utilities', providing for
calling of special elections to vote upon the auestion authorizing
such sale, and regulating the manner in which the proceeds of such
sale shall be applied." Approved May 31st, 1921, and an act of the
Legislature of the State of California, entitled "An act to provide
for and regulate municipal elections- in cities of the fifth and sixth
class. " approved May 27th, 1919, and. all acts amendatory to said
acts a special municipal election shall be held in the City of Hunt—

U` ington Beach,'i Orange County, State of California, on Tuesday
February 8th _ 1927, for the purpose of submitting Yto the
qualified voters of said Cit-y the -proposition of selling such said
C public utility, the said Gas Distributing System, works, equipment
and appurtenances.

Section 2. that the purpose for which the proceeds of the sale
of said public utility .is proposed to be expended, is as follows : -
the sum of _. 7500."00 to pay and. retire the bonds and bonded in-
debtedness of the said City of Huntington Beach, created and existing
for the acouisition and construction of said public. utility remaining.
unpaid and unretired, and the accrued and accruing interest thereon,
the payment of iihich is not otherwise provided for;- and-.,the remainder
of the said proceeds of sale to be expended, for the following purposes :

The sum of . 5000.00 for payment and retirement of Fire Apparatus Bonds
of -the City of Huntington Beach. 118,750.00 fox the payment and re-
t irement of Public Hall Bonds of the Caty of Hu nton B�a.ch and-the

sum of 9375Q.00 for the repair and maintenance of the present \
Municipal .2ier in the City of I untington Beach.
Section 3. - The said proposition for the sale of said public c '
utility owned by the City of Huntington Beach, to-wit : the Gas Dis-
tributing System, works, equipment 'and appurtenances shall be placed
on the voting ballot in the following words and. figures : "Shall a
public utility owned by the City of Huntington Beach, to-i-it : the Gas
Distributing System, works, equipment and appurtenances, located in the
said City of Huntington Beach, County of Orange, State of California,
be sold, and the Board of Trustees be authorized to sell the same, as
provided by law. "
Opposite such proposition to be voted upon, and to the right there- -
of the words "YES" and "NO" shall be printed on -separate lines with
voting slquares. If an elector shall stamp a cross (X) in the voting
square after the printed word "YES" his vote shall be counted in favor
of the proposition to sell s�,,id public utility; and if he shall stamp a
cross (X) in -the voting square after the word 'INTO" his vote shall be
counted against the pro positi.o.n_ to sell said public utility.

y Section 4e There shall be four (4) voting precins.ts for the pur-
pose of holding said election consistingeof a consolidation of the regu-
lar. election precincts established for holding State and County elec-
tions,as follows:
Consolidated voting precinct "A" comprising State and County
precincts numbers one, two and three, and the polling place thereof
shall be at the Municipal Auditorium, near the I#est,erly' corner of the
I intersection of IVIain Street and Fifth Street -in said City; Consoli-
dated voting precinct "B" comprising State and County election pre-
cincts numbers four, five and six, and the polling place thereof -
shall be at the Methodist Church Bungalow Sunday School room on the
Northerly corner of the intersection of Eleventh Street and Orange
Avenue in said City; Consolidated voting precinct " C" comprising
State and County Election precincts numbers semen and eight and the
polling place shall be therefor at the Grammar Sohtnol building located
near the intersection of Fifteenth Street and Palm Avenue, on the
Northeasterly side of Palm Avenue in said. City; Consolidated voting
precinct 11I3" comprising State and County precincts numbers nine and
ten, and the polling place therefor shall be at M. M. Hallicy's store,
located on the Southeasterly corner of Frankfort Street and Alabama
Avenue in said City.
The polls shall be open between the hours of 7:00 o "clock A.M.
and 6 :00 o1clock P.M.
That the Board of Trustees shall appoint an Election Board for
each consolidated precinct, to be composed of one Inspector, one Judge

and three clerks for each consolidated precinct, each of whoi .shall

be a qualified: elector and resident of consolidated precinct in which

that the City Clerk shall procure the necessary
{ voting booths and `ese that their are properly erected, and shall have all

the necessary ballots p rinted : according to the requirements of law
and. secure the necessary ballot=boxes, stamps, voting lists, ink-pads, -�
roster, instruction cards, affidavits of registration and index there-
to, tally lists, returns, envelopes, and all other necessary supplies, --
,i and. see that they are properly distributed to each voting booth prior
., to the opening of the polls on the day of election, The City Clerk
shall also give notice of said election, as required_ by law, and shall
cause notice thereof to 'be published in Huntington Beach News, a week-
ly newspaper printed, published and circulated in said City, by tWacrl
() . insertions thereof, and shall cause the said. proposition to be
printed and a copy thereof enclosed in an envelope with a-s ni—ple ballot--------�J
i and mail the same to each voter not later than ten days (10) prior to \
the election.
Section 5. It shall require the votes of two-thirds (2/3) of al
i the qualified voters voting at such election to authorize the sale of

the public utility described in this ordinance.
Section 6, The City Clerk of the City of Huntington Beach shall _
certify
to the passage of this ordinance, and shall cause this ordinance
. t
to be published at least once a week for two weeks in Huntington Beach
News, a weekly newspaper printed, published, and circulated in the said
City of Huntington Beach, the first publication thereof to be 'made .at
i
least two weeks prior to the date mentioned in said ordinance for .h-olding
the special Municipal Election in this ordinance provided for.

Section 7. If the vote cast at the election provided for in this {
ordinance be in favor of the sale of the public utility mentioned in the
ordinance calling for the election, the Board of Trustees of the City
of Huntington Beach shall immediately proceed to sell such public utility,
and shall fix a date on which bids for the sale of ,such public utility
will be received- and the manner of filing such bids, and shall cause notice
of such sale to be published for at least two weeks ne xt before the day
fixed. for receiving bids, which notice shall be published in the manner {

jI provided by law for the publication of the ordinance calling for and
giving notice of such election. At the date fixed for receiving bids

l the Board of Trustees shall open and. examine all bids received, and
Ih may sell such public utility to the highest and best bidder therefor;
PROVIDED, that if the bids received in the opinion of the Board of
Trustees are inadequate and disproportionate to the value of such said
1 public utility, the Board of Trustees shall have the right to refuse
all bids and may proceed to give new notice of sale of said public
utility as provided by law.
Section 8. If any bids. submitted pursuant to law and this ordi-
nance is accepted by the Board of Trustees of the .City of Huntington
I Beach, said Board. of Trustees shall by resolution :authorizeA�he Presi- \
dent of said. Board and the City Clerk to execute and acknowledge and
deliver for and on behalf of the City of Huntington Beach, and in% its
name and under its co prorate seal a good and sufficient deed conveying

j said public utility to the successful bidder upon receipt from said bid-
der, in cash, the full gamount of bid, and the p;rp► se of such bidder to
continue to operate such public utility, and such deed of conveyance _
shall operate to convey to said successful bidder all of the right,
title and interest and estate of the said City of Huntington Beach in
and to said public utility.
Section 9. The proceeds of the sale of said ,,public utility shall
be placed in the Municipal Treasury and shall be applied exclusively for
the purposes and objects mentioned in this ordinance.
Passed and adopted by the Board of Trustees of the City of Hunting-
