AN ORDINANCE OF THE CITY OF RUNTINGTON BEACH REGULATING SLAUGHTER HOUSES,
THE. SLAUGHTERING OF ANIiMS FOR FOOD , AND THE SALE OF IIEAT, FISH, GIAIIE

The Board of Trustees of the City of Huntington Beach do of°dain

as follows: Official Establishment supervised by Inspector:
Section 1. It shall be unlawful for any person, firm or corporation
to sell, have , keep or expose for stale for human consumption or to 'have
in his possession within the City of Huntington Beach, the flesh of any �
cattle, calves, swine or goats, unless the same shall have been slaughter-
in an official establishment under the supervision of a United States

Government Inspector. in accordance with the regulations relating, to the
inspection of meat, as prescribed by the Department of Agriculture of the

United States, or under inspection recognized and accepted by the said
Department of Agriculture of the. United States, or unless the same shall
have been slaughtered in an official establishment -under the supervision
of the State Veterinarian of the State of California, in accordance with

the laws of the State of California, regulating the inspection of animals
p slaughtered for human consumption or under the supervision of the Health
Commissioner, or a meat inspector of the City of Los A ,eles ,or under the
supervision of the 1.1eat Inspector or Assistant of the., County of Orange ,
or the 1"lleat Inspector of the City of Huntington Beach in accordance with
the provisions of this Ordinance.

Section 2. It shall be unlawful for any person, firm or corporation

to sell, have, keep or expose for sale, or have in his Possession within
the City of Huntington Beach, the flesh of any cattle ; cglve`s, sheep,
swine or goats unless there has been placed on each primal part thereof,
\ by and under the personal supervision of an Inspector of the United States ,
or of the State of California, or of the City of Los Angeles, or of the
County of Orange , or of the Gity of Huntington Beach, a mark, stamp. ,or
brand, showing that the same has been inspected and passed for food `pur- Ji
poses by the City of Los Angeles, or a mark, stamp,. or brand showing the17

meat has been inspected and passed for food purposes by the County of ,
Orange, or a mark, stamp or brand showing that the meat has been inspected
and passed for food purposes by the City of Huntington Beach," an(J2 having the
words: "Orange County Inspected and Passed" together with the number of.
slaughter house, as hereinafter provided, in which the same has been in-
spected.
Section 3. It shall be unlawful for any person, firm or corporation,
except the Meat Inspector or Assistant , provided for, to have in possession,
keep or use any mark, stamp or brand provided or used for• marking, stamping
or branding any articles herein required to be marked, stamped or branded:
It shall be unlawful for any person, firm or corporation to have in posses-
sion, keep , make or use any mark, stamp or brand having thereon a device
or words similar in.-character or import to the masks, stamps or brands I
provided or used for marking, stamping or branding such articles. '
TAKING OF SAMPLES:
Section 4. Any person, firm or corporation selling or exposing, of
.fering or keeping for sAle within the City of Huntington Beach, any meat,
fish, game or poultry or any product, compound or mixture thereof, or fur-
nishing or supplying any meat, fish, game, poultry or any product, com-
pound or mixture thereof, to be used for human. food; shall-,
p:ermit samples
thereof to be taken by the Meat Inspector of by any assistant meat inspec-
tor appointed by him; and it shall be unlawful for any such person, firm
!' or corporation to prevent, resist or oppose, or to attempt to prevent,
resist or oppose the taking of samples as aforesaid by the IEeat Inspector
or his assistant.
DISEASED AM IMUTURE ANIMALS:
Section 5. It shall be unlawful for any person, firm or corporation
within the City of Huntington Beach, to hold, offer, keep or, expose for.
sale, or to cause or permit to. be held, offered, kept or exposed for sale , . !
any meat, game, fish, poultry or, any, article of food manufactured: there-
from that is immature, unnutritious, emaciated, tainted, decaying, decayed,

putrid, unwholesome or infected with any disease, or corrupted from any
cause whatsoever; or any meat from any cow, hog, sheep, calf, goat or
fowl that was unsound, sick, diseased, immature or not in good condition,
at the , time the same was slaughtered.
IDIIATURE VEAL:
Section 6. ` It shall be unlawful for any person, firm or corporation
to sell,' hold,'Ikeep, offer or expose for sale, or to bause or permit to
be sold, held, kept, offered or exposed for sale , the meat or flesh of-
any calf that is less than four weeks old at the time of slaughters or that
weights less than sixty-five pounds after the removal of the viscera, feet
and head,

Section 7. It shall be unlawful for any person, firm or corporation

keeping or having in possession any corral, slaughter house or stock yard,
or other place where cattle, hogs, sheep, goats or poultry are kept or
maintained, or any room, house, building, place or -premises where meat,
fish, game, poultry or any product thereof, is kept, stored, maintained., ' *
exposed or offered for sale , or where meat, fish, game or poultry is pre
served, cured, canned, or otherwise prepared for food, to prevent , resist
or oppose, or to attempt to prevent., resist or oppose the entrance of any
police officer or Meat Inspector, or other person working under the direc- ' �
tion of the Meat Inspector into, or the inspection of any such officer
of any such corral,- slaughter house, stock yard, room, housd, building,
place or premises, or the inspection by any such officer of any animal,
meat; fish, game, poultry or any product therein contained.

Section 8. It shall be unlawful for any person, firm or corporation
to establish, maintain or conduct any meat market or meat shop or other
place where meat, fish, game , poultry® or any product thereof is stored,
held, kept , exposed or offered for sale, for human food, or manufactured

into articles of/food., or preserved, cured, canned or otherwise prepared-
for human food, unless the same is constM.d.ted, maintained and conducted
in the manner required by this Ordinance.

CONSTRUCTION OF MEAT MARKET:
Section 9. Every such meat market or meat shop, and every room,
building or place in vrlhich meat, fish, game , poultry or any product there-
of is stored, kept, held, exposed- or offered for sale for human food, or
} : _..:.: .;.. `.•: :- ?manufactured into artd¢1es of human food, or preserved, canned,
cured or otherwise prepared for human food shall be so constructed and. •main
tained as to prevent any flies or other insects or any vermin or roclents
from entering therein. No live poultry, or pigeons shall be kept within
the room in which meat, fish, game or any product thereof, or any dressed
. .poultry is stored, held, kept or exposed or offered fare sale for human
food. Every such meat •market, meat shop, room or place shall be kept at
all times clean and in a sanitary condition. And in order to, fac ill-Ad.t.6o
this, hot and cold. water shall be installed in such meat shops. The ice
box or cooling room wherein meat, fish•, game, poultry or any product there
of, is stored, held, kept, exposed, offered or prepared for sale for human
food, shall be kept clean, and no decomposed or decaying matter shall be.
allowed. to remain therein All hooks, receptacles, containers and im-
plements used for holding or preparing meat, fish, game, poultry or any.
product thereof, for human food, shall be kept clean and in a sanitary con-
dition . Every place wherein meat, fish, game , poultry or any product there-
of, is stored, held, kept, exposed or offered for sale for human food shall
.be provided with counters and tables, the top of which shall be .of such
material and shall be so constructed as to render the same non-
absorbent.
Every block or table upon which meat, fish, game , poultry or any prod-uat
thereof is placed for cutting or preparing for human food, shall be kept
clean and smooth, and shall contain no crack or crevices.
The toilet shall be separate and apart from any room wherein food
products are sold or prepared and shall be so constructed or located as .
not to allow a direct- passage of air between the name and any* such meat
market; meat shop, room or place. No water closet or urinal shall be `
ventilated through any such meat market, meat shop; room or place. Every
such meat market, meat shopi, room or place shall have a lavatory which

shall be provided with soap , towel, hot and cold water.,
LAVATORY:
Section 10. It shall be unlawful for--any person, . f.irm:_or corporation
to wash or cause to be washed, any meat, fish, game; poultry or any pro-
duet thereof, in any sink, washstand or basin that is used for general
lavatory purposes.
TRUCKS NOT PROPERLY COVERL+D:
Section 11. It shall be unlawful for any person, firm or corporation
to have, carry, transport, convey, or to cause or permit to be carried,
transported or conveyed, any meat , fish, game , poultry or any product
thereof intended for human food , in, upon or along any street; alley;
thoroughfare or open space, unless the same is at all times covered and
protected from dust, dirt, flies and other insects.
FISH AND MEAT TRUCKS:
Section 12.. It shall be unlawful for any person, firm or corpora
tion to peddle any fresh fish intended for hum:az food unless. same is
thoroughly enclosed, covered and protected from dust, dirt, flies and .
other insects, aud. unless a sufficient quantity of ice is provided to
` preserve such food in a wholesome condition.
DOGS:
II Section 13. It shall be unlawful for any person, firm or corpora-
tion to permit any dog to remain in any room, in which meat; fish, game, a
poultry, or any product thereof, is stored, held, kept , exposed or of-
fered for sale for hum.an, food, or to permit any dog to ride upon any
wagon or vehicle in iah ch any such article is being transported.

Section 14. It shall be unlawful for any person, firm or corpora
\ tion to keep or. to cause or permit to be kept, or to permit to remain,
any meat, fish, game or poultry not -intended for human consumption, or
any hide, skin or pelt of any animal. after the same has been removed
' from the carcass thereof, within any ice-box or cooling room in which
meat, fish, game , poultry or .any product thereof intended for human
consumption is kept or stored.

Section 15. Every person, engaged in handling meat, fish, game ,
poultry, or any product thereof, intended for human consumption„shall
at all times keep his hands and clothes clean and in a sanitary con-
ditions
It shall be unlawful for any person, after having handled any hide ,
skin or pelt, of any nonedible part of any animal, to handle any meat,
fish, game , poultry, or any product thereof , intended for human food,
without first cleansing his hands.
CUSTOMERS NOT AILO`-ED TO HUZLE LSAT:
Section 16. It shall be -unlawful for any person, ether than the
Meat Inspector of the City of Huntington Beach; -or any person regularly
employed for such purpose, to handle, fumble, or touch any meat, fish_,
game , poultry, or any product thereof, ' that is stored. held; kept or
offered or exposed :ior sale for human food.
OYSTERS AND FISH:
Section 17. It shall be unlawful for any person, firm or corpora-
tion to keep, expose or offer for sale , or to sell any fish or oysters, , .
unless the same are kept in clean containers and thoruughly enclosed, iced,
covered and protected from dirt,. dust, flies and other insects;or to use
any ladle, dipper; or measure for handling oysters unless the same is kept
clean and is used for no other purpose.
PURE WATER
Section 18. It shall be unlawful for any person, firm or corpora-
tion to use or to cause or permit to be used any impure or unclean
dater for washing, mixing or preparing meat, fish, game, poultry, or

any product thereof, for human food.

TUBERCULOSIS-Butcher:
Section 19. It shall' be unlawful for any person engaged in handling
meat, fish, game, poultry, or any product thereof', intended for human food
to enter the room of any person who. is Affected with pulmonary tuberculosis,
or other communicable , contageous, or infectious disease. j

It shall be unlawful for any person affected with pulmonary tuber-
culosis, venereal disease or other communicable , . contagious or infectious
disease; to work or be employed in handling or preparing meat, fish, game ,
poultry, or any product thereof, for human consumption; and it shall be
unlawful for any person, firm or corporation to employ or permit to be em-
ployed any such person.
DUTY JAM POVFER OF IMAT INSPECTOR.-
Section 20. It shall be the duty of the heat Inspector, and he is
hereby empowered, to enter any place where fish, game , poultry, meat or
flesh of any animal, mentioned in this, Ordinance., or the product thereof,
is stored, held., kept, exposed or offered for sale for human consumption
and every establishment where meat is manufactured into articles of food, or
preserved, cured-, canned or otherwise prepared for human consumption. He
is also empowered to enter all slaughter houses, packing houses; corrals, or
yards , and shall inspect the name and the stock therein contained, whenever;
upon inspection and examination, such meat or the products thereof shall be
found not: to be marked, stamped or branded, showing. that it has been passed
for food p=poses as provided in this Ordinance, or if game, fish, poultry,
meat or the products thereof are found to be tainted, unwholesome , corrupted
from any cause, or infected. with any form of desease , the said M at Inspector
shall condemn the .same as unfit for human consumption and shall mark or
mutilate the s;.ame , or make the fact of such condemnation and unfitness ap=
parent, and shall immediately order the same to be removed.
The said Meat Inspector shall also inspect all cattle, sheep, hogs,
and other livestock and all poultry; held, offered or kept , or exposed for
sale ; or intended to be held, offered, kept or exposed for sale , or held-
or kept* for slaughter or for food or intended to be held or kept for
\ slaughter or for food; and whenever the same shall be found to be maimed;

emaciated, illnourished or infected with any disease, or to be younger than

permitted by. this Ordinance, the said Meat Inspector shall condemn the same
as unfit for, human consumpti=4 and it shall be unlawful for any person,
i firm or corporation, to hold, offer, or expose for sale or to cause or permit
to be held, offered or exposed for sale, -any such 0.ondemned animal or poultry.

The T?Teat Inspectors shall be graduate veterinarians from accred-
ited. Veterinary Colleges or Universities, which are recognized by .the
California State Board of Veterinary Examiners. :
Section 21. There is hereby created the office of Inspector of the
City of Huntington Beach, ; such officer shall be appointed by and serve 'at
the w1112. of the Board of Trustees of staid City. Said Inspector shall,
appoint assistant , or assistants, from time to time who are hereby
granted the same powers and authorities as said Meat Inspector in the
carrying out of the provisions of this Ordinance.
PENALTY:
Section 22. Every person, firm or corporation, violating any pro-
vision of this Ordinance shall be deemed guilty of misdemeanor, and ;
upon conviction thereof, shall be punishable by a fine of not more
than Three Hundred Dollars ($300.00) , or by imprisonment in the City

Jail of the City of Huntington Beach; for a period of not more than
ninety (90) days , or by both such fine and imprisonment.
Each such person, firm or corporation shall be deemed guilty of
a separate offense for every day during any portion of which any vio=
lation of any provision of this Ordinance is committed, continued or-
permitted by such person, firm or corporation and shall be punishable
therefor as provided by this Ordinance.
Section.23. the foregoing Ordinance shall be published once in
Huntington Beach News, and thirty (30) days from date of its publiea-
tion, shall be in full force and effect.
Section 24. If any section, clause or .phrase of this Ordinance is
declared or held unconstitutional or invalid, it shall not effect the
remaining portions or parts of said Ordinance. The Board of Trustees

of the City of Huntington Beach does hereby declare that it would have

adopted. said Ordinance and any parts thereof despite the invalidity ol� ,, ,
unconstitutionality of any of the remaining or other parts thereof'. !

The foregoing Ordinance was introduced at a regular meeting of the
Board of Trustees of the City of Huntington Beach, held on the
day of &C7 1927 , and was finally passed at a
reel meeting thereof on the �.4- 4 1927, by the follow-
ing vote:
