AN ORDINANCE AMENDING ORDINANCE NO. 280 OF THE CITY OF HUNTINGTON BEACH, ENTITLED "AN ORDINANCE PROVIDING CERTAIN FIRE PRE- VENTION MEASURES IN THE OIL FIELDS; REGU- LATING THE USE OF CERTAIN STREETS AND HIGH- WAYS WITHIN THE CITY; REPEALING ALL ORDI- NANCES AND PARTS. OF ORDINANCESIN CONFLICT WITH THIS ORDINANCE AND PROVIDING PENALTIES FOR THE VIOLATION HEREOF. " The City Council of the City of Huntington Beach do ordain as follows: SECTION 1. That a new section be and the same is hereby added to Ordinance No. 280 entitled "An Ordinance providing certain fire pre- vention measures , in the oil fields; regulating the use of certain streets and highways within the city; repealing all ordinances and parts of ord- inances in conflict with this ordinance and providing penalties for the violation hereof,tt 'which said new section shall be known as Section 42 and shall read as follows: i ttSECTTON 41. It is hereby declared to be a nuisance and un- lawful for any person, firm, association, corporation, trust or syndicate in charge or control of or having any interest in or owning either in whole or in part any der- rick,' on any premises in said City, whether as principal, agent, servant, employee, or otherwise, to cause,, allow or i permit said derrick to be constructed, erected or main- tained or to remain upon said premises unless the said derrick is at all times securely guyed. Said derrick \, shall be securely guyed within the meaning of this section, only if and when the sameshall have securely attached to each corner at least (two guy wires or cables)at least one- quarter inch in diameter, one of which shall be attached to each of said corners of said derrick not more than - 1 - i i I I twenty feet from the top of said derrick and the other not less than sixty nor more than seventy feet from the base thereof, and all of said guy wires or cables shall be drawn tight with equal tension and they shall each be fastened securely to an anchor or dead-man of sufficient size and strength to equal the strength of said guy wires or cables, and no guy wires or cables from -any corner of said derrick shall be fastened to, any anchor or dead-man to which there is fastened any guy wire or cable from any � other corner of said derrick, and no two of said anchors or dead-men shall be within one hundred fifteen feet of each other, and they shall be at least sixty-five feet from the base of the derrick, and so located that a straight line drawn between any two adjacent dead-men or anchors will not come within forty-five feet of said derrick. It is provided, however, that if any such derrick is constructed entirely of steel and is set upon four portland cement concrete foundation blocks of not less than twenty- seven cubic feet content each, and each block has embedded securely therein at time of making, one three-fourths inch bolt, to a depth of at least eighteen inches, to which said derrick is securely bolted, and the City Engineer has issued a certificate that such derrick -is so constructed an(�main- tained and need not be guyed to make the same safe, then said derrick need not be guyed. . Said certificate, declaring that there is 'no necessity for guying'' may be revoked at any time by such City Engineer. " SECTION 2. The City Clerk shall certify to the passage of this ordi-, nance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper printed, published and circulat- ed in said City of Huntington Beach. An emergency has arisen which 2 - 'Y endangers the peace, health and safety of citizens of the City of Hunting- ton Beach, and the fact constituting such emergency are as follows : That labor upon oil wells and derricks in certain localities of said City is ceasing, and such. oil d,erricks, ,•equipment and rigging stand and r;ema.in idle- without. watchmen or. supervision, and the same become and area menace to the public peace, health and safety; and the'•adoption .of 'this ordinance is necessary for the protection of said public 'peace, health and safety. Therefore, this, .,,.-ordinance shall take effect from and • after its passage. AA Passed and adopted this day , 1929.
