1 ORDINANCE NO.
2 AN ORDINANCE OF THE CITY OF HUNTINGTON
BEACH REGULATING THE USE OF THE PUBLIC ,
3 BEACH OF THE PACIFIC OCEAN IN SAID CITY
4 - - - - - - - 1
5 The City Council of the City of Huntington Beach do ordain
6 as follows;

7 Section 1. The Nord "camp" as hereinafter used in this or-
8 dinance is intended to mean, does mean, and shall at all times
9 be held and construed to mean, any temporary shelter to be
10 occupied by human beings for a limited period and not as a per-
11 manent place of abode , that is constructed of cloth or paper,
12 treated or untreated, or branches or boughs of trees , or partly
13 constructed thereof, or by the use of paper and/or cloth and/or
14 boughs or branches of trees , in connection with an automobile ,
15 automobile truck or other vehicle , for the purpose of temporary
16 shelter. The word ",occupied" as hereinabove used is intended
17 to mean and does mean and shall at all times be held. and con-

18 strued to mean, used for the purpose of protecting human beings
19 from wind, sun, rain or public view.
20 Section 2. It shall be unlawful for any person, firm or '

21 corporation, either as employer or employee , or for himself , to
22 maintain any camp or occupy the same at any place within the City
23, of Huntington Beach upon the shore or beach of the. P acific Ocean
24� within said City.
25 The words "shore" or "beach" , and each .of them, as used .

26 within this ordinam e , are intended to mean, and do mean, and
27 shall be construed to mean, that certain strip of land lying
28
. between Ocean Avenue in said City and the line of ordinary tide I
I
29 of the Pacific Ocean, excepting such portion thereof as may be
I I
30 included within the operating eight of way of the Pacific Electric!
31 Railroad at said point.

1 Section 3. It is provided, however , that it shall not be a
2 violation of this Ordinance , nor shall it be construed to be a i
3 camp for any person to erect within the above described portion
4 of the City of Huntington Beach a sun shade or parasol, or other
5 protection fzom the sun or wind, provided the same is immediately
6 taken down and removed when the person erecting the same leaves
7 the beach or shore , and provided further that said sun shade or
8 parasol shall be wholly open to an unobstructed view of the
9 interior thereof by any and all persons then and there being, for
10 at least fifty per cent of the perimeter of said sunshade or
11 parasol , and that the side walls thereof do not extend over more
12 than fifty.-peg cent of the perimeter of said sunshade or parasol.
13 ;Section 4. Any person violating any of the provisions of
14 this ordnance shall be guilty of a misdemeanor, and upon con-
15 viction thereof shall be punished by a fine not exceeding
16 Three Hundred Dollars ( 300. 00) , or by imprisonment in the County
17 Jail not exceeding thirty (30) days , or by both such fine and
18 imprisonment.
19 Section 5. The City Clerk shall certify to the passage of
20 this Ordinance and shall cause :the same to be published by one
21 insertion in the Huntington Beach News , a newspaper printed,
22 published and circulated in said City of Huntington Beach, Cali-
231, fornia. An emergency has arisen wherein it is necessary for the
24 immediate adoption of this Ordinance for the preservation of the
25 public peace , health and safety , which said emergency is as follows:,

26 Many people are now camping on the public beach at Huntington
27 I
Beach and are erecting closed shelters and camps thereon; that there! ,
28 ' s no toilet facilities provided along said beach and the occupants
/� 29 f said camps and said shelters a,re committing nuisances upon said

30 each , which renders the beach polluted and unfit for use by other
31 persons corning thereto and said condition has increased to 'such an
I 32
extent that immediate action is necessary for the preservation of

1 the health and sanitation of the same to protect the public.
2 Therefore , this Ordinance shall take effect from and after its

introduced and read at a regular meeting of the City
Council held on the 2nd day of September,1930, and
was again read to said City Council on the 8th day
of September 1930, at a regular adjourned meeting
of the said Council, and that said Ordinance was passed
and adopted by the following vote;
