AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING ORDINANCE NO. 150, ENTITLED "AN ORDINANCE OF THE CITY OF HUNTINGTON -/ BEACH PROVIDING FOR THE ASSESSMENT AND COLLECTION OF TAXES. " The City Council of the City of Huntington Beach .do 6 ordain as follows: Section 1. That Section 54 of Ordinance No. 150, entitled "An Ordinance of the City of Huntington Beach Providing for the Assessment and Collection of Taxes" be and the same is hereby amended so as to read as follows: "Section 54: The Assessor shall be governed as to the amount of taxes to be collected upon property, which taxes are not in his opinion a lien upon real property under Sections 52 and 53 of this Ordinance by the City rate for the previous year; provided that the first collection of such taxes under this Section shall be based upon the City tax .rate for the fiscal . I year 1931-32. "When taxes are so collected upon' assessments of the 'possession of, claim to, or right to the possession of land' then, when the rate is fixed for the year in which such collection is made, if a sum in excess of the rate so fixed has been collected, such excess shall not be apportioned to the City but shall remain in the City Treasury and must be paid by the Treasurer to the .person from whom the collection was made, his heirs, executors or assigns on demand therefor, and if a sum u less than the rate fixed has been collected the deficiency must be collected by the tax collector as other taxes on property are collected. The Assessor on the first Monday in each month must pay into the City Treasury all moneys collected by. him during the preceding month. "The Clerk must as soon as the Assessment book for the year comes into his hands, note opposite the name of each person from whom taxes have been collected in the amount thereof; and as soon as 'the rate of taxation for the year is fixed the Clerk must note, in connection with said entry the amount of the excess or deficiency. " Section 2. The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be printed and published -by one insertion in the Huntington Beach News, a weekly newspaper printed, published and circulated in the City of . -Huntington Beach, Orange County, California, and thirty days thereafter it shall take effect and be in force.
