I AN ORDINANCE AMENDING SECTION 10 OF ORDINANCE NO. 280 ENTITLED "AN ORDINANCE PROVIDING CERTAIN FIRE .PREVENTION MEASURES IN THE OIL FIELDS; REGULATING THE USE OF CERTAIN STREETS AND HIGH WAYS WITHIN THE CITY; REPEALING. ALL ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT WITH THIS ORDINANCE AND PROVIDING PENALTIES FOR- THE VIOLATION HEREOF" , The City Council of the City of Huntington Beach do ordain as follows: Section 1® That Section 10 of Ordinance No. 280 i' entitled "An Ordinance providing certain fire prevention measures in the oil fields; regulating the use of certain streets and highways within the City; repealing all ordinances and parts of ordinances in conflict with this ordinance and I providing penalties for the violation hereof" , be and the same IIis hereby amended so as- to read as follows: �i "Section 10. It shall be unlawful for any peson, firm or corporation, either as principal, agent, servant; employee or otherwise to cause or permit crude, distillee or refined oil or petroleum, or waste water, or mud to become deposited upon or to flow upon, into or across any sidewalk, curb or street, or into. any drainage system, sewer or gutter; provided however, that it shall be lawful for the Superintendent i of Streets of the City of Huntington Beach to cause and permit water which contains not more thanl0.O parts of oil per million to be deposited in or permitted to flow into storm drainage- systems under such terms, conditions and restrictions .as may ` be adopted by him; provided however, that said City. i � ' Superintendent of Streets shall require all such water to be i carried in pipe lines to the gutter of paved streets, or in the event there are no paved streets adjacent to said property then the same must be carried in pipe lines to a manhole of said storm drainage system. �1.. I - r ' , S Any person, firm or corporation desiring to have the Street Superintendent of the City of Huntington Beach dispose of or permit any water to flow into such storm water drainage , system shall file an application requesting such City ,Street Superintendent to dispose of said water in said draina.ge. system and shall provide at his or its own cost and expense the necessary settling, separating and cleaning apparatus to clarify, settle and clean said water and shall provide the necessary pipe and conduit to conduct said water to the gutter of a paved street or a manhole in said storm water drainage system. In the event such apparatus and equipment is provided then it shall be lawful for the Street Superintendent to cause any water accumulated upon private property to be deposited or caused to flow into said storm water disposal system. Nothing herein contained shall be construed- to permit. any person other than the Street Superintehdent 'to allow or permit any water to be deposited or flow into said storm water drainage system and the Street Superintendent or one of his employees or deputies shall be present at all times. Any person,firm or corporation filing an application to have water accumulating upon his or its property disposed of by the Superintendent of Streets, shall at the time of making said application, deposit with the Superintendent of Streets a fee of Two Dollars ($2.00) and shall thereafter pay to. the Superintendent of Streets of the City of Huntington Beach the sum of $2.00 per month for each oil well, rig or \ derrick from which water may be produced during such time as - said person, firm or corporation may desire to have the Superintendent of Streets dispose of the water accumulating upon his or its property. The Superintendent of Streets shall not dispose of any water accumulating upon private property -2- i C unless and until the fees herein provided have .been paid. All pipe lines and conduits constructed for the purpose of (, I emptying water into the storm water drainage system shall be equipped with valves which shall be capable of being closed and sealed by the Superintendent of Streets and it shall be a violation of this Ordinance for any person, firm - or corporation to cause or permit any .seal placed upon said valves to be broken or removed or unlocked by any person other than the Superintendent of Streets, his agent or employee." Section 2. The City Clerk shall- certify to the passage of this Ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper of general circulation printed, published and circulated in said City of Huntington Beach. An emergency has arisen which endangers the peace, health, and safety of citizens of the City of Huntington Beach, e and the facts constituting such emergency are as follows: Large quantities of water are being accumulated upon private property in the City of Huntington Beach, both from rainfall and from production of water from oil wells located in said City, and there is no convenient or appropriate method of disposing of said water except through the storm water drainage system in the City of Huntington Beach, and it has become known that certain operators of oil wells in said City have Beenlcausing and permitting said water -to be emptied into lahax (IM toil wells where the same percolates through the water strata from which the City of Huntington Beach obtains �I its domestic water) causing infiltration of salt water in said domestic supply, and a speedy remedy of the situation is necessary in order to prevent further damage to said water supply and to prevent said water so accumulated from causing damage to public streets and to public health. Therefore, this ordinance shall take effect and be in force from and -3- after its adoption. PASSED AND ADOPTED THIS e� day of r 1932. Mayor of the f---H-untn�t Beach.
