ORDINANCE NO. 367
AN ORDINANCE AMENDING ORDINANCE 226 OF THE CITY
OF HUNTINGTON BEACH, ENTITLED "AN ORDINANCE OF
THE CITY OF HUNTINGTON BEACH TO BE KNOWN AS THE
BUILDING ORDINANCE, REGULATING. THE CONSTRUCTION,
ALTERATION, REPAIR AND DEMOLITION OF BUILDINGS
AND STRUCTURES AMID PARTS THEREOF AND PROVIDING
FOR FIRE PROTECTIOhi; REGULATING AREA WAYS AND
MATERIALS AND MACHINERY, AND USE OF STREETS IN
CONNECTION WITH BUILDING OR WRECKING OPERATIONS,
PROVIDING FOR PERMITS FOR SAME, AND REPEALING
ALL ORDINANCES IN' CONFLICT THERE'Ni ITH" , AS Ate- �

The City Council of the City of Huntington Beach do
ordain as follows:
Section 1. That Section 292 of Ordinance No. 226
of the City of Huntington Beach, entitled "An Ordinance of
the City of Huntington Beach to be known as the, Building
Ordinance, regulating the construction, alteration, repair
and demolition of buildings and structures and parts thereof
and providing for fire protection; regulating area ways and
materials and machinery, and use of streets in connection
with buildings or wrecking operations, providing for permits
for same and repealing all ordinances in conflict therewith" ,
as amended, be and the same is hereby amended so as to read
as follows:
"Section 292. AUTOMOBILE FILLING STATIONS AND GARAGES.
It shall be unlawful for any ,person, firm or cor-
poration to build, construct, or cause to be built or construct-
ed within the City of Huntington Beach any automobile filling
station except of one or more of the following fireproof materi-
als, to-wit: Brick, stone,, hollow tile, concrete (plain or re-
inforced) or flat sheet steel (not less than 22 gauge for roof

and •16 gauge on side walls) on structural steel frame securely
bolted or -riveted together.
All outer doors and casings shall be covered with sheet metal
on all exposed surface of not less than 28 gauge.

For the purpose of this ordinance an automobile filling a�
station shall be defined as a detached structure at least thirty
(30) feet from any other building or structure, having not over
Eight Hundred (800) square feet roof area, and not more than
one story, or Fifteen (15) Feet in height at highest point of.
roof; devoted to the retail sale of fuel, oils and accessories
for motor vehicles.
STORAGE TANKS
All motor vehicle fuel storage tanks shall be installed
under ground. It shall be unlawful for any person, firm or
corporation to install any underground storage tanks not having
riveted or welded seams, or of a lighter material than. 12 gauge.
Such tanks must carry the stamp of approval of the Underwriters'
Laboratories. Such tanks shall be placed four feet (40 ) inside
of property lines and shall be inspected by Fire Chief and,
when installation is satisfactory to him, shall be covered by
four. (4) feet of earth and kept so covered. Minimum distance

between tanks shall be one (1) foot. No single tanks shall be
of greater capacity than one thousand (1000) gallons, U. S.
Measure. No greater number than four (4) such tanks will be
allowed for storage purposes without special permission from
the City Council. All pumps shall be of type approved by Fire
Chief.
It shall be unlawful for any person, firm or corporation
to commence to use any building, structure, barn or shed as an
automobile filling station, or for the retail sale of fuel =anal
accessories for motor vehicles unless the same complies with the

regulations of this section, and is not more than one story or

Section 2. The City Clerk shall certify to the passage
of this Ordinance and shall cause the same to be published by
one insertion in the Huntington Beach News, a newspaper printed,
published and circulated in said City of Huntington Beach, and
thirty (30) days thereafter it shall take effect and be in
full forces
Passed and adopted by the City Council of the City .of
