HomeMy WebLinkAboutOrdinance #368 ORDINANCE NO. o50 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AME11DING ORDINANCE N0. 19 OF SAID CITY, ENTITLED: "AN ORDINANCE PROHIBITING THE OBSTRUCTION OF STREETS, ALLEYS, SIDEWALKS AND PUBLIC PLACES WITH- IN THE, CITY OF HUNTINGTON%BEPACH FOR ANY PURPOSE WITHOUT A PERMIT; ALSO REQUIRING THE, LIGHTING OF SAID OBSTRUCTIONS BY MIGHT; AND REGULATING THE CUTTING, EXCAVATING ITI;, UPON AND ALONG IMPROVED STREETS IN SAID CITY, " AS A211ENDED. The City Council of the City of Huntington Beach do ordain as follows: Section 1. That Section 3 of said Ordinance No. 19 of the City of Huntington Beach entitled: "An ordinance prohibit- ing the obstruction of streets, alleys, sidewalks and public places within the City o_f Huntington Beach for any purpose without a permit; also requiring the lighting of said obstruc- tions by night; and regulating the cutting, excavating in, upon and along improved streets in said city, " as amended, be and the same is hereby amended so as to read as follows: "Section 3. Any person, firm or corporation desiring to engage in any trade or business or to move or construct a building, make repairs, or to perform any other work by which it may become necessary to place any such building, stand, counter, lunch wagon, wagon stand, band stand, structure, building mater- ial, gravel, dirt, excavation or other obstruction upon or in the streets, alleys, sidewalks or' public places within the said City, must first obtain a permit from the Superintendent of Streets �^ of said City to place any obstruc-t,io as hereinabove mentioned i/ _. . upon Orkin said streets, alleys, sidewalks or public places, and the said Superintendent of Streets of said City may issue -such i I Y n a• i permit upon the payment of the sum of Five ($5000) Dollars to the City of Huntington Beach therefor; provided, however, that in the event the person, firm or corporation making such applica- tion is the owner or holder of a franchise or reservation of in- terest in said street, alley, sidewalk or public place to keep or maintain any pipe line, telephone line or pole system in or upon i any of said public streets, alleys, sidewalks or public places or said excavation is for the purpose of connecting with sewer water or gas pipe lines by such person, firm or corporation, then and in i that event, said application and permit may be granted without charge. "Each person, firm or corporation having authority i from the City Council of the City of Huntington Beach, as provid- ed in Section 1 of Ordinance No. 19) to out, remove, excavate in, I upon or along any paved or improved street, alley, sidewalk, curb or other public place in said City and/or to cut, remove or exca- vate in, upon or along any unimproved dirt or oiled street, lane or alley or other unimproved public place in said' City shall, upon i and at the time of making application to the Superintendent of Streets of said City for permit to so out in, upon, across or along, or remove, excavate or obstruct any such paved or improved street, curb, sidewalk, alley or other improved public place and/or unim- proved dirt or oiled street, lane, alley or other unimproved public lace shall p pay in lawful money of the United States to the City of Huntington Beach a sum for each and every square foot and frac- tion thereof of all such paving, street, curb, sidewalk, alley or other improved public place and/or for each square foot of any unimproved dirt or oiled street, lane, alley or -other unimproved public place proposed to be cut or . r.emoved as contained in the -2- r statement thereof set forth in said application, for the purpose of repairing the damage to said paving, curb, sidewalk or other L� public places, except as herein provided; said sum of money shall be calculated according to the following schedule: A. For paved or improved streets, sidewalks, curbs alleys or other improved public places in said. city said sum shall be as follows: 1. Twenty-five (25) square feet, or less, FIFTY (50 f ) CENTS per square foot. i 2. More than Twenty-five (25) square feet, up to and including Five Hundred (500) square feet, THIRTY-FIVE (35fl CE- TS per square foot, and 3. In excess of Five Hundred (500) square feet, TIVENTY-FIVE (250) C' l TS per. square foot. B. For unimproved dirt or oiled streets, lanes, alleys or other unimproved public places in said city said sum shall be as follows: 1. DIRT street, lane, alley or other unimproved public place, THREE (30) CENTS per square foot; 2. OILE'D street, lane, alley or other unimproved public place, THIRTEEiv (130) CENTS per square foot; "The above schedule shall apply to all persons, firms or corporations alike who make application to obstruct, cut, remove or excavate in, upon across or along any improved or paved street, alley, sidewdalk, curb or other public place within said City and/or I any unimproved dirt or oiled street, lane, alley or other public place within said City. All money so paid shall be deposited by the City Council of the City of Huntington Beach in such fund as \ said City Council may direct. - -- - - -- i Section 2. That this is an emergency Ordinance for the immediate preservation of the public safety of the citizens of the City of Huntington Beach, and the facts constituting such emergency are as follows: That many improved and unimproved streets, lanes, alleys, sidewalks and curbs in said City of Huntington Beach are being torn up, excavated and obstructed and, in order that said streets, lanes, alleys, sidewalks and curbs be replaced in the same condition as they were prior to such excavation, cutting and obstruction it is, therefore, necessary that this Ordinance take effect from and after the date of its passage. 1 Section 3. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper printed, published and circulated in said City of Huntington Beach.✓y Passed and adopted this ;4�. day of September, 1933.
