HomeMy WebLinkAboutOrdinance #372 ORDINANCE NO. 372 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING ORDINANCE NO. 327 OF SAID CITY, ENTITLED: "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH LICENSING ALL KINDS OF BUSINESS CARRIED ON III THE CITY OF HUNTINGTON BEACH, FIXING THE RATE OF LICENSE TAX UPON THE SAME, PROVIDING PENALTY FOR ALL VIOLATIONS THEREOF, AND REPEALING ALL ORDINANCE'S OR PARTS OF ORDINANCES IN CONFLICT HERE1,11TH, 11 AS AMEINDED. The City Council of the City of Huntington Beach do ordain as follows: Section 1. That Section 3 of Ordinance No. 327 of the City of Huntington Beach entitled: "An Ordinance of the City of Huntington Beach licensing all kinds of business carried on in the City of Huntington Beach, fixing the rate of license tax upon the same, providing penalty for all violations thereof, and repealing all ordinances or parts of ordinances in conflict herewith, " as a,nended, be and the saine is hereby amended so as to read as follows: "Section 3. Any license granted or issued under the provisions of this ordinance shall authorize the licensee to transact or carry on the business or calling therein named at the place therein designated and no other, and the said license shall not be transferable nor assignable except by the approval of the City Clerk, except as provided herein. No license shall be granted if any prior license fee remains unpaid. 'Each licensee, under this ordinance, shall be personally responsible for the proper operation of the business which he may be licensed to conduct hereunder and for the observance of ,all laws and ordinances applicable thereto by anyone engaged in or connected with said business. - - "Any licensee who shall permit a violation of the, city ordanP STAT.E OF CALIFORNIA SS. FURR, City Clerk. and Ex-Officio Clerk of the City Council of the City of Huntington Beach, California do hereby certify that the above and foregoing Ordinance was introduced and read at a regular meeting of the City Council held on the "2nd day of January 193 4 , and was again read to said City Council on the 5th day of February 193 4 at a regular meet- -I i w Meeting of the said City Council, and that said Ordnance as adopted by the following vote: Ayes: Councilmen: Talbert -`Kinp-�; ',Conrad Noes- Councilmen: None AT)s e nt Councilmen: Marion, Stevens City Clerk and Ex-Officio Clerk of the Hunting- ton Council of the City of rlunt-i'ng- ton Beach, California. 2 3 F ances or state laws or of the laws of the United States of America within his licensed establishment shall be subject to having his license suspended or permanently revoked by the City Council. Any license issued hereunder may be revoked by the City Council upon its own motion or upon the verified complaint of any citizen or resident of the City of Huntington Beach and satisfactory and convincing proof that the licensee is conducting the business licensed in such a manner as to 'be detrimental to the public health, morals or safety. No such license shall be revoked except upon a hearing by the City Council, of which hearing the licensee shall have had not less than ten (10) days' notice . Such notice, written and served upon the licensee either personally or by registered mail, and when by registered mail, deposited in the United States Post Office at Huntington Beach, California not less than ten (10) days before the date of hearing, addressed to the licensee at the place for which the license was issued, with postage prepaid thereon, shall be sufficient notice. At such hearing the licensee shall be entitled to be represented by counsel and shall be given full opportunity to show cause why his license should not be revoked. " Section, 2. If any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity of the remainder of this ordinance. The City Council of the City of Hunting- ton Beach hereby declares. that it would have passed this ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one or more other sections or subsections, sentences, clauses or phrases be declared invalid or unconstitutional. ` Section 3. The City Clerk shall certify to the passage of this ,-- ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper printed, published -2- and circulated in said City of Huntington Beach, and thirty days �J thereafter it shall be in full force and effect.
