All that portion of the City of Huntington Beach within the following described boundaries ,is hereby estab- lished and declared to be Business District No. 1 of said City, - to-wit: • Beginning at the point of intersection of the center line of First Street projected viith the Pacific Ocean and running thence . Northeasterly to the intersection of the said center line of First Street with the Southwesterly line projected of the first alley Northeasterly from Ocean Avenue, thence Northwesterly along said. last mentioned line to its intersection with the Northwesterly line produced of the first alley Southeasterly from Third Street; thence Northeasterly along the last mentioned line. to its inter- section with the Southwesterly line of Olive Avenue; thence North- . ± westerly along the Southwesterly line of Olive Avenue to its inter- section with the Southeasterly line of the first alley Northwesterly from Third Street; thence Northeasterly and Northerly along the last mentioned alley line to its intersection with the South line of Acacia Avenue; thence Westerly and Northwesterly along said last i mentioned line to its intersection with the Southwesterly line of Sixth Street; thence Southwesterly along said last mentioned line to its intersection with the Northeasterly line of Orange Avenue; thence Southeasterly along said last mentioned line to its inter- l section with the Southeasterly line of the first alley Northwesterly I _S• p t C F from Fifth Street produced Northeasterly; thence Southwesterly . along the last mentioned alley line produced to its intersection ` with the Southwesterly line of the first alley Northeasterly from Ocean Avenue; thence Northwesterly along the last mentioned line to its intersection with the center line of Sixth Street; thence + i Southwesterly along the center line of Sixth Street .and a pro- longation thereof to the Pacific Ocean; thence Southeasterly along . the ordinary high watermark of the Pacific Ocean to the point of beginning. That all of that portion of the City of Huntington, Beach within the following described boundaries is hereby es- tablished and declared to be the Beach and Ocean District of said City of Huntington Beach: Beginning at ' a point where said Northwesterly boundary line of said City of Huntington Beach inter- sects 1P.ith the ordinary high water mark of the Pacific Ocean; thence South 48 'Nest, three (3) miles to a point in the Pacific Ocean; thence Southeasterly, parallel to and three ( 3) miles from the ordinary high water mark of the Pacific Ocean, four (4) miles, more or less, to a point, * South 360 West of the inter- section of the East line of Section Fourteen (14) , Township Six (6) South, Range Eleven (11) West, S. B. B. & M. with the ordinm high water mark of the Pacific Ocean; thence North 36 East three (3) miles to said point of intersection with the ordinary high water mark of the Pacific Ocean; thence Northwesterly along the ordinary high water mark of the Pacific Ocean to the point of beginning. Section 2. It shall be unlawful for any person, firm or corporation to erect, establish, carry on or maintain within the districts set forth and described in Section 1 hereof, any stone crusher, crushed stone yard or bunker, rock, sand or gravel loading, distributing or receiving station, rolling mill, foundry, carpet beating establishment, livery stable, riding academy, \ gas works, mattress factory, soap factory, fertilizing plant or factory, tallow rendering plant or factory, tannery, glue factory, brick yard, brick kiln, oil well or oil well derrick, or the busi- -2- i D D7 r , , t r 1 ness of drilling or operating for the discovery or production of oil, gas, hydrocarbons or other kindred substances, chemicals or chemical products, dog or cat hospital, or any plant, works or factory where power other than animal power is used to operate any- such plant, works or factory; provided that one or more twenty- electric motors of a . total capacity of not to exceed/five horse power may be operated and maintained in the said zones. Section 3. That Ordinance No. 209 of the City of Huntington Beach entitled: "AN ORDINANCE OF THE' CITY OF HUNTING- TON BEACH, CALIFORNIA, ESTABLISHING A' BUSINESS AND RESIDENCE DISTRICT IN SAID CITY, AND PROHIBITING THE ESTABLISHMENT OR MAIN- TENANCE OF CERTAIN BUSINESSES AND INDUSTRIES IN SAID DISTRICTS" , and all Ordinances amending said Ordinance No. 209, are hereby repealed; provided, however, that it is not the intention hereof to repeal Section 2 of Ordinance No. 297 or Section 3 of Ordinance No. 297, which said Ordinance purports to amend. said Ordinance No. 209; and provided, further, that any such repeal shall 'not affect or prevent the prosecution and punishment of any person, firm or corporation for any act done or permitted in violation of any ordinance which may be repealed by ,this Ordinance, and shall o not affect any prosecution or action which may be pending in any court for the violation of any ordinance repealed by_ this Ordinance; further provided that this Ordinance does not in any way affect or repeal Section 3 of Ordinance No. 375 of the City of Huntington Beach entitled: "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH REGULATING THE ERECTION, CONSTRUCTION, ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL, DEMOLITION, CONVERSION, OCCUPANCY, EQUIP- N,ENT, USE, HEIGHT, AREA AND MAINTENANCE OF ALL BUILDINGS AND/OR STRUCTURES IN THE CITY OF HUNTINGTON BEACH; PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF FEES THEREFOR; PROVIDING PENALTIES FOR THE VIOLATION THEREOF; DECLARING AND ESTABLISHING -3- 9 FIRE- ZONES; REPEALING ORDINANCE NO. 226 OF THE' CITY OF HUNTINGTOI\i BEACH, AS Ai11iENDED, AND ALL OTH`EER ORDINANCES AND FARTS OF ORDINANCES IN,.CONFLICT THERE-WITH. " Section ,4. ,,,Any person violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punishable by a fine 'of not more than Three Hundred ($300.00) Dollars, or by imprisonment in the city jail or in the county jail of the County of' Orange for a period or not more than three (3) months,. or by both such fine and imprisonment. Section 5. If any section, subsection, sentence, clause or phrase of this Ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining -portions of this Ordinance. J The City Council of the City of Huntington. Beach hereby declares that it would have passed this Ordinance and each section, subsection, sentence, clause or phrase thereof, irrespective of the fact that any one ,or more other sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 6. That this Ordinance is an emergency Ordinance for the immediate preservation of the public health, safety, morals and general welfare of the citizens of the .City of Huntington Beach, and the facts constituting such emergency are as follows: That there is danger that oil well derricks may be erected, constructed, maintained and produced upon the tide and submerged lands within the city limits of the City of Huntington Beach, and i because of such oil well derricks and the production .of oil there- from the beach and ocean within said may city become ,� ,� polluted and i damaged and, therefor, this Ordinance shall take effect from and after the date of the passage hereof. i Section 7.
