ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING AND ADDING A NEW SECTION TO ORDINANCE NO. 327 OF SAID CITY ENTITLED: "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH LICENSING ALL KINDS OF BUSINESS CARRIED 09 IN THE CITY OF HUNTINGTON BEACH, FIXING THE RATE OF LICENSE TAX UPON THE SAME, PROVIDING PENALTY FOR ALL VIOLATIONS THEREOF, AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH," AS AMENDED. The City Council of the City of Huntington Beach do ordain as follows: Section 1: That a new section, to be known as Section 10a, to be inserted between Sections 10 and 11 of said Ordinance No. 327, is hereby added to said Ordinance No. 327, said new section to- read as follows: "Section 10a: For every person, firm or corporation who sells or offers for sale, merchandise of any nature, upon the public streets or highways of this City, from any vehicle known or described as a rolling or traveling or mobile store, or which is in fact such a traveling store, the license shall be Five Hundred ($500.00) Dollars per year, or the sum of Twenty-five ( 25.00) Dollars per day for a minimum of ten (10) days; that said yearly license fee shall be payable semi-annually in advance for every such vehicle making sales in the City of Huntington Beach; provided, however, that any vehicle making delivery to regular customers of (a) fresh milk and cream exclusively, and not offering for sale other products such as eggs, butter, . mayonnaise, cheese, tomato juice, orange juice, etc. ; and (b) ice and ,(c) water and (d) fresh fruits and vegetables or other agricultural products grown by the person who operates the vehicle on which they are offered for sale, shall not come under the provisions of this section. That under the classification of a rolling, traveling or mobile store, it is hereby declared that such a store is defined as: Any vehicle which carries a more or less general or miscellaneous assortment of any merchandise, whether of foods, packaged or bulk, groceries and household products such as soaps, coffees, teas, extracts, baking powder's; st:z;:r bakery goods, breads, cakes, pies, doughnuts, potato chips, CZ�D; dairy products, cheese, butter, eggs, mayonnaise, fruit juices in bottles; notions, novelties, tools and appliances; electrical or gas fixtures or appliances, electrical bulbs, radios, radio parts, automobile parts or accessories or tires; drugs, medicines and prepared mixtures for use on or about the person; meats, fresh or cured, and meat products; brushes and household implements, wearing apparel of every nature; ice cream in bulk, cone or package; and every other type of general or special merchandise; and which vehicle is operated on the i public streets and highways for the purpose of displaying, offering for sale or selling from such rolling stores, or taking orders from such display of merchandise 2br future delivery." Section 2: That Section XI of said Ordinance No. 327, as amended, shall be amended so as to read as follows: "Section XI: The rate of' license for conducting or maintaining the business of soliciting or canvassing. or taking orders for any goods,- wares or merchandise, and not having a regularly established and fixed place of business in the City of Huntington Beach duly licensed hereunder, or not as agent or r 1 representative of such regularly established place of business, shall be the ' sum of Ten ($10.00)- Dollars per day or Fifty ($50.00) Dollars per year, and each such person, firm or corporation shall, in addition thereto, execute the bond required by Section XXXII of this Ordinance and deliver the same to the City Clerk of the City of l� Huntington Beach." Section 3: That Section XIII of said Ordinance No. 327, as amended, shall be amended so as to read as follows: "Section XIII: The rate of license for conducting or carrying on an auction, auction house, or the business of auctioneer for selling goods, wares or merchandise at auction j shall be the sum of Twenty-five ($25.00) Dollars per day. " Section 4: If any section, subsection, sentence, clause or phrase of this Ordinance is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council of the City of Huntington Beach hereby declares that it would have passed this Ordinance and each section, sub- section, sentence, clause or phrase thereof, irrespective of the fact that any one or more other sections, subsections, sentences, clauses or phrases be declared invalid or unconstitu- tional. Section 5: The City Clerk shall certify to the passage i and adoption of this Ordinance and shall cause the same to ! be published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and circulated in the City of Huntington Beach; provided, however, that this Ordinance shall not take effect and be in force until July 1, 1937, Passed and adopted this day of , 1937. i MAYOR ATTEST: City Clerk fr i 1 STATE OF CALIFORNIA, ) County of Orange, ) ss: City of Huntington Beach. ) I, C.
