J 2 3 AN ORDINANCE REGULA"`PING T--'-E MANUFACTURE, KEEPING, STORING, 4 USING, SELLING, TRANSPORTING AND POSSESSION OF PYROTECHNICS 5 717ITHIN THE CITY OF HUN'TINGTON BEACH: SETTING FORTH CERTAIN 6 EXCB'PTIOMS THERETO: PROVIDING PENALTIES FOR THE VIOLATION i 7 THEREOF, AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN 8 CONFLICT HEREt,,IITH. r I 9 I� 10 The City Council of the City of Huntington Beach does ordain 11 as follows: i 12 Section 1. Whenever used in this ordinance , the following 13 word shall have the meaning hereinafter set forth, to-wit: 14 The word "pyrotechnics" shall mean and include any bomb, 15 fire balloon, firecracker, flash light composition, flower-pot, 16 hand torpedo, nigger chaser, pine wheel, railroad track torpedo, i 17 roman candle , signal light, sky rocket, sparkler, squib, colored 18 fire composition, or any other composition, or explosive fire- 19 works used, designed or intended to produce visible or audible t I 20 pyrotechnic display. 21 Section 2. It shall be unlawful for any person, firm or 22 corporation to have in his or its possession, or to keep, store, 23 use , shoot, discharge , set off, ignite , manufacture , sell, give 24 away or transport any pyrotechnics within the city of Huntington _ 25 Beach; provided, however, that nothing in this ordinance shall 26 be held to apply to the possession or use of any signalling 27 device by railways, boats , life guards or public officials; and 28 provided further that the provisions hereof---shall not apply to 29 any person, firm or corporation giving a display of fireworks 30 in any public park, or upon any beach, or upon any other open I 31 place within the City of Huntington,,Beach, under and. in accord- i 32 ance with a -permit to be issued as hereinafter provided; and -1- I i I 1 provided further that nothing herein shall be deemed to apply 2 to the possession, sale or use of flash light composition by 3 photographers, dealers in photographic supplies or any other 4 person using such flash light composition for the purpose of 5 taking photographs; and provided further that the provisions 6 hereof shall not apply to the discharge or firing of target 7 pistols, guns or rifles in any gun club , at any outdoor target 8 1 range or in any licensed shooting gallery. 9 Section 3. µ Any person, firm or corporation desiring to 10 give a display of fireworks in any public park, or upon any beach, i 11 or in any other open place within the City of Huntington Beach, I 12 shall make a written application for a permit therefor to the 13 Fire Chief of said City of Huntington Beach. Such application 14 shall contain the name of the applicant, his residence, the place 15 where such display of fireworks is to be given, the hour at which 16 such display is to begin, and the length of time necessary for 17 such display, a detailed statement of the kinds and amount of 18 pyrotechnics that are to be used in such display, and the purpose 19 for­vhich such display is to be given. Said Fire Chief shall. 20 carefully examine such application, and if he finds that the 21 giving of such display of fireworks described in such application 22 will not be detrimental to the public peace , health, safety, 23 morals or welfare , he shall issue his permit therefor. 24 Section 4. All ordinances or .parts of 'ordinances in con- ® 25 flick', herewith are hereby repealed. 26 Section 5. Every person violating any of the provisions 27 of this ordinance , or neglecting, failing or refusing to comply 28 with any thereof, shall be deemed guilty of a misdemeanor, and 29 upon conviction thereof shall be punished by a fine not:,exceeding 30 Five Hundred ($500.00) Dollars, or by imprisonment for not more 31 than six (6) months; and such person shall be deemed guilty of 32 a separate offense for each day during which, or during any por- tion of vuhich, such violation or failure , neglect or refusal -2- i I1 1 is committed, continued or permitted. 2 Section 6. The City Clerk shall certify to the passage of 3 this ordinance by the City Council of the City of Huntington 4 Beach, and cause the same to be published by one insertion in 5 the Huntington Beach News, a newspaper of general circulation, 6 printed, published and circulated in said City of Huntington. 7 Beach, and thirty ( 30) days thereafter it shall take effect and 8 be in force . - 9 Passed and adopted by the City Council of the City of Hunt- 10 ington Beach, as its regular adjourned meeting held on the 11 day of , 193?. 12 13 Iulayor of the City of Huntington Beach 14 15 Attest: 16 17 City Clerk- and ex-Officio Clerk of the City Council of the City of Huntington Beach. 18 19 State of California, ) 20 SS.
