AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH, CALIFORNIA,
ORDERING, CALLING AND PROVIDING FOR THE
HOLDING OF AN ELECTION, TO BE CONSOLIDATED
WITH THE REGULAR GENERAL MUNICIPAL ELECTION
HERETOFORE CALLED TO BE HELD ON TUESDAY,
APRIL 12, 1938, FOR THE PURPOSE OF SUBMIT-
TING TO THE QUALIFIED VOTERS OF SAID CITY
THE PROPOSITION OF INCURRING' A BONDED
INDEBTEDNESS BY SAID CITY FOR THE FOLLOWING
MUNICIPAL IL'iPROVEMENT, TO-WIT: THE ACQUISI-
TION, CONSTRUCTION AND COMPLETION OF A
PUBLIC PARK AND PLAYGROUND WITHIN SAID CITY
OF HUNTINGTON BEACH, TOGETHER WITH SUCH
EQUIPMENT AND APPURTENANCES AS 1,JAY BE NECES-
SARY OR CONVENIENT TO TI-E. USE THEREOF.
WHEREAS, the City Council of the City of Huntington
Beach, County of Orange, State of California, did, at a regular,
adjourned meeting of said Council held on ,.Monday, the 28th day
of February , 1938, at the City Hall in said City, being its
regular place of meeting therein, regularly and duly pass
and adopt Resolution No. 792. of said City, which Resolution is
entitled as follows: "A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH, CALIFORNIA, DETERMINING ANI:i- DECLARING
THAT THE PUBLIC INTEREST AND NECESSITY DE11IIAND THE`ACQUISITION,
CONSTRUCTION AND COMPLETION, WITHIN THE CITY OF HUNTINGTON BEACH,
CALIFORNIA, OF A CERTAIN MUNICIPAL IM1:1ROVEIVIENT11 and""
WHEREAS, said Resolution was duly signed by the Mayor
of said City and duly attested by the City Clerk thereof on the
28th day of February, 1938 and entered in the Book of Resolutions
of said City, and the Minute of the passage and adoption thereof
made on the Minutes of the meeting at which the same was passed
and adopted,
NOW THEREFORE, at this, a subsequent meeting of said
City Council of said City to the meeting at which said Resolu-
tion No. 792 of said City Council was passed and adopted, the

City Council of the City of Huntington Beach, California does
ordain as "follows:
�) Section 1: That a municipal election be and the same
is hereby ordered and called, to be held in said City of Hunting-
ton Beach. on Tuesday, April 12, 1938, between the hours of 6:00
o 'clock A. M. and 7:00 o 'clock -P. M. , and that at said election
there be submitted to the qualified voters of said City the pro-
osition of incurring a bonded indebtedness for the object and
purpose set forth in said Resolution No. 792, passed and adopted
on the 28th day of February, 1938, to-wit: the acquisition,
construction and completion of a public park and playground within
said City, together with such equipment and appurtenances as may
be necessary or convenient to the use thereof.
Section 2: That the object and purpose for which said
indebtedness is proposed to be incurred is as follows: the
acquisition, construction and completion, within the City of
Huntington Beach, California, of a, public park and playground,
together with such equipment and appurtenances as may be neces-
sary or convenient to the use thereof.
Section 3: That the estimated cost of the acquisi-
tion, construction and completion of said municipal improvement
is the sum of One Hundred Thousand ($100,000.00) Dollars.
Section 4: That the amount of principal of the
indebtedness to be incurred by said City for the acquisition,
construction and completion therein of said municipal improve-
ment is the sum of One Hundred Thousand ($100,000.00) Dollars.
Section 5: That the maximum rate of interest to be
paid on such indebtedness is five (5�o) percent per annum, which
interest shall be payable annually for the first year and semi-
annually thereafter, which rate shall not be exceeded in the
issuance of bonds ,for said indebtedness. i
Section 6: That the estimated cost of said proposed
municipal improvement and the indebtedness which is proposed to

be- incurred therefor, together with all existing indebtedness
of said City does not exceed fifteen (15o) percent of the assessed
value of all of the real and personal property of said City of
Huntington Beach.
Section 7: That the election hereby called and
ordered to be held shall be consolidated with the general muni-
cipal election to be held in said City on the 12th day of April,
1938, said general municipal election having been called by
Resolution No. 791, a Resolution of the City of Huntington Beach,
entitled: "A RESOLUTION OF THE CITY OF HUNTINGTON BEACH" , which
Resolution was duly and regularly passed and adopted by said City
Council of said City on the 14,th`=day of February , 1938, and which
said general municipal election is an election authorized by law,
and at which general municipal election qualified voters of said
City of Huntington Beach are entitled to vote.
Section 8: The manner of holding such bond election

on said day and voting for and against Incurring- such bonded indebt-
edness shall be as follows:
The proposition of incurring a bonded
debt of said City, as aforesaid, shall be submitted to the quali-
fied voters-,of said City by printed ballot§,-which ballots shall be
the same ballots as those used for said general municipal election,
and the ballots used at such election, except as otherwise provided
for in this Ordinance, shall be prepared, printed, furnished and
distributed as provided by law for preparing, printing, furnishing
and distributing ballots at municipal elections in the City of
Huntington Beach. Each ballot shall be printed in substantially the
following form:

INSTRUCTIONS TO VOTERS:
To vote for a candidate of your selection, stamp
a cross (+) in the voting square next to the right
of the name of such candidate. ,+'There two or mo-re
candidates of the same off ice are to be elected,
stamp a cross (+) after the name of all the candi-
dates for that office for whom you desire to vote
not to exceed, however, the number of candidates who
are to be elected. If the ballot does not contain
the names of candidates for-all offices for which
you may desire to vote, you may vote for candidates
for such offices so omitted by writing- the name of
the candidate for whom you wish t o .vote in the blank
space left for that purpose. To vote for a person
not on the ballot, write the name of such person
under the title of the office in .the -blank space
left for that purpose.
To vote on-:any question, proposition or constitu-
tional amendment, stamp a cross (+) in the voting
square after the word "Yes" or after the word 1111o". I
All marks except the cross (+) are forbidden. All
distinguishing marks or erasures are forbidden and
make the ballot void.
If you wrongly, stamp, tear or deface this ballot,
return it to the inspector of elections and obtain
another. .

Section 9: That the election officers hereinafter
designated are hereby appointed as the election officers for their
respective consolidated voting precincts, and that the election
precincts and polling places for said bond election as so consoli-
dated with the general municipal election shall be as hereinafter
specified, to-wit:
There shall be four consolidated voting
precincts , consisting of a consolidation of the regular election
precincts last established for holding general State or county
elections in said City, to be designated as consolidated voting
precinct "A" , consolidated voting precinct "B", consolidated voting
precinct "C" , and consolidated voting precinct "D".
Consolidated voting precinct "A" shall consist of
general election precincts Huntington Beach One and Two; the
polling place shall be in Memorial Hall located on Sixth Street
near the intersection of I+fagnolia Avenue and Sixth Street in said
City

Consolidated voting r-recinct "B" shall consist of
general election precincts Huntington Beach Three and Four, and
the polling place Vim' shall be at the Woman' s Club House located
at 418 Tenth Street , between Orange Avenue arr. lulagnolia Avenue,
in said City of Huntington Beach.

Consolidated voting precinct "C " shall consist of
general election precincts Huntington Beach Five and Six, and
the polling place, shall be Windsor Club House , located
at the corner of Thirteenth Street and Crest Avenue in said
City of Huntington Beach.

Avenue in ' said City of Huntington Beach.

Section 10: That when the polls are closed the
returns of said election shall forthwith be made to the City
Council of said City and signed by the officers of said election
and shall be then deposited with the City Clerk, together with the �
ballots cast at said election, and the City Council shall meet D

and canvass said returns in the Council Chamber in the City
Hall of said City, it being the regular meeting place of said
City Council, on the 18th day of April, 1938, at the hour of
7 : 30 P. M. of said day, and if upon such canvass, it shall be
found that at least two-thirds of the qualified voters of the City
of Huntington Beach voting at said election upon said proposition
voted in favor thereof, said proposition shall be deemed adopted
and the issuance of said bonds approved.
Section 11: The City Clerk shall certify to the
passage and adoption of this Ordinance by more than tiro-thirds
vote of all the members of the City. Council of the City of
Huntington Beach, and this Ordnance shall be published once a
week for two weeks by one insertion each week for two
successive weeks in the Huntington Beach News , a weekly
newspaper of general circulation, print ed' and published in. said
City of Huntington Beach, California, and this Ordinance shall
take effect from and after the adoption hereof.
Passed and adopted by the City Council of the
City of Huntington Beach, California, by a vote of more than
two-thirds of all its members, at a regular, adjourned meeting
of said City Council held on the 9th day of March, 1938.
