HomeMy WebLinkAboutOrdinance #426 I '* ORDINANCE NO. 426 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, ESTABLISHING A RESI- DENCE DISTRICT THEREIN. The City Council of the City of Huntington Beach, California, do ordain as follows: Section 1: That all that portion of the City of Huntington Beach included within the following des- cribed boundaries is hereby established and declared to be a residence district : Beginning at the point of the intersection of the center line of Lake Avenue with the intersection of the center line of Palm Avenue; thence northerly along the center line of Lake Avenue to its intersection with z the center line of Twelfth Street ; thence westerly along the center line of Twelfth Street to its intersection with the center line of Main Street; thence northerly { 4 g the center line of Main Street to its intersection with the center line of Thirteenth Street ; thence westerly along the center line of Thirteenth Street to its inter- section with the center line of the first alley westerly from Main Street; thence northerly along the center line of said alley to its intersection with the center line of Fourteenth Street ; thence westerly along the center F_ line of said Fourteenth Street to its intersection with 1 I the center line of Palm Avenue; thence southerly along the center line of Palm Avenue to the point of beginning. i Section 2: Any lot , premises or building in the residence district may be used and occupied for the following purposes: Residential dwellings , parks, playgrounds, public buildings and accessories to said uses, including garages and space necessary for the occupants of said buildings. Section 3: (a) Every building or improvement which lawfully exists on any lot or premises at the time this ordinance became effective on said lot or premises, �t any portion of which does not comply with the regulations specified in this ordinance, shall be deemed and construed to be a non-conforming building or improvement. (b) A use lawfully existing in any build- ing upon any lot or premises at the time this ordinance Z became effective on said lot or premises , and which does not comply with the regulations of this ordinance shall be deemed and construed to be a non-conforming use. Any such non-conforming use may be continued. (c) The use of a non-conforming building shall not be changed except to a use which in the opinion of the City Council, as evidenced by resolution, is similar in nature, operations and degree of compat- ability to surrounding property$ to the use which occu- pied the building 'at the time ,it became non-conforming or the use fbr which the building was intended as pro- vided in this ordinance. The use of a non-conforming — building may be changed to a conforming use. -2- (d) Repairs or alterations which do not enlarge or increase the size of a non-conforming building I may be made to any such non-conforming building, provided that the aggregate value of separate repairs or altera- tions shall not exceed fifty (50%) percent of the assessed value as of the date such building first became a non- conforming building by the effect of this ordinance; provided no repairs , alterations or additions shall be made to any non-conforming building vbich has been damaged by fire , flood, wind, earthquake or other calamity to the extent of more than fifty ( 50%) percent of its value at the time of such damage, unless every portion of such building is made to conform with all provisions of this ordinance for new buildings. (e) No non-conforming building or improvement shall be added or enlarged in any manner unless such building or improvement and such additions or enlarge- ments conform in every respect with the provisions set forth in this ordinance. (f) A non-conforming use or portion thereof occupying any lot or premises and not housed in a building occupying a conforming building or portion thereof shall not be enlarged or extended onto land or into any other portion of the conforming building not actually so occupied at the time such use became non- { conforming nor shall such use be changed except to a conforming use. If such a non-conforming use or portion -3- I thereof is abandoned or discontinued or changed to a conforming use , it shall not thereafter be re-established or reopened. (g) For the purposes of this ordinance a non- conforming use shall be deemed to be discontinued or abandoned when any such use has ceased to operate or has not been operated, or the lot or premises has ceased to be used, or has not been used, for such non-conforming purpose, for a period of sixty (60) days. Section 4: The City Clerk shall certify' to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach Mews, a weekly newspaper, printed, published and circulated in the City of Huntington Beach, and thirty (30) days after the adoption hereof the same shall take effect and be in force.
