HomeMy WebLinkAboutOrdinance #429 i ORDINANCE NO. 429 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, CALLING AND PROVIDING FOR THE HOLD- ING OF A SPECIAL ELECTION TO BE HELD IN THE CITY OF HUNTINGTON BEACH ON WEDNESDAY, THE 27th DAY OF SEPTEMBER, 1939, FOR THE PURPOSE OF SUB- MITTING TO THE QUALIFIED VOTERS OF SAID CITY THE PROPOSITION OF INCURRING A BONDED INDEBTEDNESS BY SAID CITY FOR THE FOLLOWING MUNICIPAL IMPROVE- MENT , TO WIT: , THE ACQUISITION, CONSTRUCTION AND COTiIiPLETION OF MUNICIPAL WATERWORKS FOR THE PURPOSE OF SUPPLYING WATER TO SAID CITY, INCLUDING THE ACQUISITION OF WATER, WATER RIGHTS, RIGHTS OF WAY, AND THE ACQUISITIONN OR CONSTRUCTION AND COMPLE- TION OF RESERVOIRS, .PUMPING PLANTS, WATER MAINS, LINES, EQUIPMENT, APPARATUS, AND APPURTENANCES AS MAY BE NECESSARY OR CONVENIENT IN CONNECTION THEREWITH . WHEREAS, the City Council of the City of Huntington Beach, County of Orange, State of California, did at an adjourned regular meeting thereof held on the loth day of July, 1939 , by a vote of more than two-thirds of all of its members duly pass and adopt a resolution en- titled, r "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, DE- TERMINING AND DECLARING THAT THE PUBLIC INTEREST AND NECESSITY DEMAND THE ACQUI- SITION, CONSTRUCTION AND COMPLETION, BY THE CITY OF HUNTINGTON BEACH, CALIFORNIA, OF A CERTAIN MUNICIPAL IMPROVEME-NT" , which resolution was numbered Resolution No. 846; and i i WHEREAS, said resolution was duly signed by the Mayor of said city and duly attested by the City Clerk thereof on the lOthi day of July, 1939: NOW, THEREFORE, the City Council of the City of Huntington Beach, California, does ordain as follows: Section 1. That a special election be held and the same is hereby called to be held in the City of Huntington Beach on Wednesday, the 2?th day of September, 1939, for the purpose of submitting to the qualified voters of said 4 city the proposition of incurring a bonded indebtedness and issuing bonds of said city therefor in the amount hereinafter set forth and for the objects and purposes set I forth in said Resolution No. 846 and hereinafter stated. i Section 2. That the objects and purposes for which said indebtedness is proposed to be incurred and bonds issued therefor is as follows: The acquisition, construc- tion and completion by the City of Huntington Beach , Cali- fornia, of the following municipal improvement, to wit: The acquisition, construction and completion of municipal waterworks for the purpose of supplying water to said city, including the acquisition of water, water rights, rights of way, and the acquisition or construction and completion of reservoirs, pumping plants, water mains , lines , equip- ment, apparatus, and appurtenances as may be necessary or - convenient in connection therewith. Section 3. That the estimated cost of said proposed - municipal improvement is $265,000.00 that the amount of -2- the principal of the indebtedness to be incurred there- for is the sum of $265,000.00, and that the maximum rate of interest to be paid on said indebtedness shall be five per cent per annum, payable semiannually. That if the proposition for the incurring of said indebtedness for said purpose so submitted receives the requisite num- ber of votes, to wit , two-thirds of the votes of the qualified voters voting at said special election, bonds of said city in the amount of $265,000.00 shall be issued and Gold for the objects and purposes stated in Section 2 hereof., Section 4. That the polls for said special election r-- shall be opened at 6:00 0 clock A. N. of the day of said election and must be and remain open continuously from said time until 7, 00 o 'clock P. N. of the same day, when the polls shall be closed; except and provided, however, that if at said hour of closing there are any voters at the polling places or in line at the entrance thereof who are qualified to vote and who have not been able to do so since appearing, the polls shall be kept open a suf- ficient time to enable them to vote, but no one who shall arrive at the polling places after 7: 00 o' clock P. M. of said day shall be Entitled to vote although the polls may i be open when such person shall arrive. The proposition of incurring the bonded indebt- edness as aforesaid shall e submitted q be to the qualified --- -3- 1 voters of said city by printed ballots and the ballots used at such special election, except as otherwise provided for in this ordinance, shall be prepared, printed, furnished and distributed as provided by law for preparing, printing, furnishing and distributing ballots at municipal elections in the City of Hun- tington Beach. The ballots to be used at said special �3 election shall in addition to eny other matters required by law to be printed thereon contain substantially the following: "IUARK CROSS (X) ON BALLOT ONLY WITH RUBBER STAMIP; NEVER WITH PEN OR PENCIL. INSTRUCTIONS TO VOTERS To vote on any question or proposition, stamp a cross (x) in the voting square after the word 'Yea ' or after the word 'No ' . All marks except the cross (x) are forbidder_. If you wrongly stamp, tear or deface this ballot, return it to the Inspector of Election and obtain another. That for the purpose of holding such special election there is hereby created four consolidated election precincts consisting of a consolidation of regular election precincts last established for holding general state or county elections in said city, said consolidated voting precincts to be designated as Consolidated Voting Precinct A, Consolidated Voting Precinct B, Consolidated Voting Precinct C , and Consoli- dated Voting Precinct D. That the election officers hereinafter designated I' �—, are hereby appointed as the election officers for their re- I I spective consolidated voting precincts, and that the elec- tion precincts and polling places for said special bond election �zy j shall be as hereinafter specified, to wit : Consolidated Voting Precinct A shall consist of Huntington Beach City General Election Precincts 1 and 2; the polling place shall be in Memorial Hall located on Sixth street near the intersection of Magnolia Avenue and Sixth Street in said city. That in all particulars not recited in this ordinance said special election shall be held as provided by law for the holding of municipal elections in the City of, Huntington Beach. Section "?. That the City Council of said city shall meet and canvass the returns of said election at the regular meeting place of said council to be held in the Council Chamber of the City Halal_ of said city on Monday, i ji the 2nd day of October, 1939, at the hour of 7 :30 o'clock P. M. , said time being the time for the next regular meet- ing of said City Council after the expiration of three full I days after said election. If at the time of such canvass i it shall be found that at least two-thirds of the quali- fied voters of the City of Huntington Beach voting at said election upon said proposition voted in favor thereof, said proposition shall be deemed approved and adopted and the issuance of said bonds shall thereby be authorized. Section 8. The City Clerk shall certify to the pass- age and adoption of this ordinance by more than two-thirds vote of all the members of the City Council of the City of Huntington Beach, and this ordinance shall be published once L a week for two weeks by one insertion each week for two suc- cessive weeks in the Huntington Beach News, a weekly newspaper L— of general circulation printed and published in said City of Huntington Beach, which newspaper is hereby designated I for that purpose, and such publication of this ordinance shall constitute the notice of said election, and no other notice of said election than the publication aforesaid shall i be necessary.
