AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF HUNTINGTON BEACH, CALIFORNIA,
CREATING A MAJOR DISASTER EMERGENCY COUNCIL
AND AN ADVISORY COUNCIL FOR THE CITY OF
HUNTINGTON BEACH, CALIFORNIA. -'

The City Council of the City of Huntington
Beach, California, do ordain as follows:
Section 1: For the purpose of creating a co-
ordinating organization and to be prepared to meet
the needs of citizens of the City of Huntington
Beach in the event of some major, physical disaster
or catastrophe overtaking the community, this
ordinance is enacted.
Section 2: The term "disaster" as used in
this ordinance shall mean floods, fires, earthquakes,
p.estilence, tornadoes, and other acts of God, which
threaten to cause extraordinary loss of life or destruc-
tion of property, and shall not include domestic dis-
turbances, strikes or labor difficulties. In, such
4, occurrences the responsibility devolves upon the re-
gularlyconstituted law enforcement authorities for

the maintenance of public peace and order. Authority
is hereby denied the Major Disaster Emergency Council

to act in these matters, which are not considered acts
�- of God.

1' Section 3: There is hereby created, under the
i
supervision and control of the City Council , a Major
Disaster Emergency Council, which shall consist of
the heads of all the Departments of the City Govern-
ment and the members of the City Council. The Mayor
shall be the Chairman of the Emergency Council. The
Idiajor Disaster Emergency Council shall formulate
plans to:
(a). Coordinate all resources of the
City of Huntington Beach and the various citizens of
said City, together with the resources of the various
corporations, business houses and associations doing
business in the City of Huntington Beach.
(b) . Secure by means of mutual coopera-
tion and effort ari effective and efficient method of
utilizing all available resources and materials for
relief of and the general welfare of the people of
the City of Huntington Beach in the event of some
major disaster. The plan so formulated shall con-
form in all respects to the laws to which the City
of Huntington Beach and its officers are subject.
Section 4: There is hereby created an Advisory
Council to which the following organizations shall
be invited to nominate representatives, which Council
shall consist of representatives of the American Red
. Cross, American Legion, Boy Scouts of America, the
several local and regional Major Disaster Councils,
labor and civil organizations, public service and
utilities corporations and various business houses,
associations , corporations and representative: cit.izens
� _ . of the City of Huntington Beach. The nomination of

members of such Council shall be confirmed by the
City Council to serve during the pleasure of said
City Council. The Advisory Council shall act in. an
advisory capacity to the Major Disaster Emergency
Council.
s Section 5: Nothing contained in this ordin-
ance shall be construed as giving the Major Disaster
Emergency Council or the Advisory Council any power
to control or direct the operation or functioning of
any officer or department of the City, or to incur
any liability of any kind on behalf of the City or
any officer or department thereof, and/or any organ-
ization or member of the Advisory Council; and nothing
contained in this ordinance shall be construed as
compelling any. person to submit to medical or surgical
treatment without his consent.
Section 6: Because of its established national
and local program the American Red Cross is recognized
as the official agency for the collection and distri-
bution of relief funds, materials and services. Ap-
proval and adoption of this ordinance shall in no
way be construed as limiting or modifying in any way

2. The complete freedom of action in
the policies or procedures of the American Red Cross
in Disaster Relief as they have been or shall be
promulgated by the Central Committee or responsible
officers of that organization.
Section 7: If any section, subsection, sen-
tence, clause or phrase of this ordinance is for any
reason held to be unconstitutional or invalid, such
decision shall not affect the validity or constitu-
tionality of the remaining portions of this ordinance.
The City Council hereby declares that it would have
passed this Ordinance and each section, subsection,
sentence, clause and phrase thereof irrespective of
the fact that one or more of the sections, subsections,
sentences, clauses or phrases thereof be declared un-
constitutional or invalid.
Section 8: The City Clerk shall certify to
the passage of this ordinance and cause the same to
a_ be published once in the Huntington Beach Nees, a
newspaper of general circulation printed, published

and circulated in the City of Huntington Beach,
California, and thirty (30) days after its passage
and adoption this Ordinance shall be in full force

regular Adjourned meeting thereof held

tiigton Beach is five; that the foregoing Ordinance
was first read to said City Council at a regular
adjourned meeting thereof held on the
8th day of July, 1940, and was again read to
said City, Council at a regular adjourned
meeting thereof held on the 29th day of July
1940, and was passed and adopted by the affirmative
vote of more than a majority of all the members of
said City Council, as follows:
