HomeMy WebLinkAboutOrdinance #454 ORDINANCE NO* 454 ADDING A NEW SECTION TO ORDINANCE NO. 327 ENTITLED: AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH LICENSING ALL KINDS OF BUSINESS CARRIED ON IN THE CITY OF HUNTING-- TON BEACH, FIXING THE RATE OF LIC1172,ISE TAX,, UPON THE SAME, PROVIDING PENALTY FOR ALL VIOLATIONS THEREOF, AND REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HER0,7ITH, AS AMENDED® I The City Council of the City of Huntington Beach, California, do ordain as follows: Q Section 1. That a new section be added to ordin- ance No® 327 entitled: "An Ordinance of the City of Hunt- ington Beach licensing all kinds of business carried on in the City of Huntington Beach, fixing the rate of license l— tax upon the same, providing penalty for all violations ' L thereof, and repealing all ordinances or parts of ordinances in conflict herewith, as eariended, " to be known as Section 2a, and to be inserted between section 2 and section 3 of said I - ordinance; the same to read_ as follows: Section 2a® Any person, firm, corporation or association who has not previously received a license from the City of Huntington Beach to conduct any business therein', shall make an application to the City Council upon a form to be secured from the City Clerk, irrhich application shall give the following information: j� la The name and residence of applicant; - 20 If the applicant is a. firm or partnership' the names and addresses of the members of the firm or of the i partners; if the applicant is an association, the names and I ` addresses of the officers of said association; if the ap— plicant is a corporation, the names and addresses of the Board of Directors of the corporation and its officers must be given; j 3. The period during which the applicant has 1 resided at the residence given; if an association or cor— poration, the period of such residence of the members or officers thereof; 4. ' Whether or not applicant is a citizen of the United States; if association or corporation, the citizenship of its officers; 5. Whether or not ax_)Plicant has ever been charged with, or convicted bf a felony in any state or territory of the United States of America, giving full details of any such charge or conviction; 7. Type of business said applicant desires to conduct; Be The address of the establishment at �rihich applicant proposes to transact business under said license and a general description of the class of improvements thereon; 9. Applicant shall be required to give at least three names and addresses of references as to his character and reputation, for honesty, integrity and morality; 10. Whether or not applicant intends to conduct 6 the business personally; 2 Such application s hall be fi 1 ed by the applicant ppl i cant J � .. l in person, with the City Clerk and shall be kept with said City Clerk as a permanent record® The application shall be referred to the Chief of Police who shall investigate and report at the next meeting of the City Council or at a special meeting called for that -purpose® Section 2® There is hereby added to Ordinance 327, an ordinance entitled "An Ordinance of the City of Huntington Beach licensing all kinds of business carried on in the City of Huntington Beach, fixing the rate of license tax upon the same, providing penalty for all violations thereof, and repealing all ordinances or parts j of ordinances in conflict herewith, as amended" a new i— section to be known as Section lla, the same to read as follows: I Section lla (1) THE RATE OF LICENSES: For every person, firm, corporationor association conducting, manag— ing, maintaining, or establishing picket lines in the City of Huntington Beach ane employing persons other than employees or former employees of the employer being picketed: For every picket line of not more than two (2) pickets, per day . . . . . . . . . 10000 For each additional picket over two (2) , per day, . 5-00 3 i i i (2) DEFINITIONS: For the purposes of this Ordinance picketing shall mean and include vialking, march— ing, patrolling, or riding to and fro, back and forth, ri or in any other repeated or successive or continuousrmanner, standing, sitting, or remaining in front of or in close proximity to the entrance or approaches leading thereto or therefrom of any place of business, residence, or place of employment for the purpose or with the intent of endors— ing or influencing any person.n to refrain from entering any such place of business residence or place of employ— ment, or to refrain from purchasing,, . selling or using any goods, wares, merchandise or other articles manufactured or offered f.or sale therein, or to induce or influence any such person to refrain from doing or performing any service L- or labor in any such place of business, residence, or place of employment, or with the intent and purpose of interfering with the normal conduct of business at any such place' For the purposes of this Ordinance a former i employee shall mean a person who has been in the employ of the person, firm, corporation, or association so picketed within a period of thirty (30) days immediately preceding the establishment of such -picket line ( �5) The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be published once in the Huntington Beach Nevis, a weekly - newspaper, and thirty ,(30) days thereafter the same shall ' take effect and be in force® PASSED AND ADOPTED by the City Council of the City of Huntington Beach, California, at a regular r-- meeting thereof held on the 4th day of May, 1942.
