HomeMy WebLinkAboutOrdinance #455 l.� T , 0RD It ANCE NO. * 455 i AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, ESTABLISHING A CITY DEFENSE COUNCIL AND DESCRIBING ITS DUTIES AND ITS RESPONSIBILITIES* WHEREAS, a state of war exists, and WHEREAS, the Council of National Defense and its Advisory Commission have recommended that the National Defense Program and activities related thereto be carried on through regular governmental channels in so far as po&= sibl e, and WHEREAS, the City of Hurt ington Beach desires to assist in the program of National Defense by coordinating all of its public and private facilities, resources and activities with .the program aforesaid; NOW, THEREFORE, in and by the above preamble and statement the City Council declares and defines that an emergency exists necessitating the following ordinance for the immediate preservation of the public peace, property$ convenience, health and safety; l WHEREFORE, the City Council of the City of il Huntington Beach, California, does .ordain as follows: Section le" CITY DEFENSE COUNCIL® There is hereby established a City Defense Council within the City of Hunting- ton Beach to have the power and perform the duties herein- after provided* J Section 20 MEMBERSHIP OF CITY DEFENSE COUNCIL. The City Defense Council shall be composed of the Mayor who shall be ex officio Chairman of the Council; the City Clerk who shall be ex®officio Clerk of the Council; Chief of Police; Chief of the Fire Department; City Attorney; Chief li Life Guard; City Engineer; Director of Public Utilities and Medical Director; : and not exceeding six (6) additional � I members, as may be appointed by the Mayor with the approval of the City Council® The Mayor shall designate one of the members of the City Defense Council as Vice Chairman who shall preside at the meetings of the Council in the ab� -� sence of the Mayor; a Secretary who shall keep the records; Iconduct the correspondence and perform such other duties `— as said Defense Council may from time to time require of him® Section 38 TERM OF OFFICE: The members of said Defense Council shall serve for a term of one year and until their successors are appointed and qualified. A four-fifths vote of all the members of the City Council will be re" - quired to remove any. member of said Defense. Council from office prior to the expiration of his term of office. Vacancies on the Defense Council shall be filled by appoint" i 'ment by the Mayor$ with the approval of the City Council' Section 40 DUTIES.` It shall be the duty and responsibility of the Defense Council too (a) Coordinate the activities within the city of governmental and private agencies, and of individuals$ 2 cooperating in the d"efense effort; (b) To stimulate public interest and participa- tion in defense activities; (c) 'To- consider and recommend to appropriate governmental authorities plans for the public safety, health and welfare; (d) To plan a civilian protection program, cap® able of 'functionin in an emergency; and to g perform such other advisory functions as.-may be requested of it by officials of the city., county, State, and Federal agencies engaged in the defense effort. ( e) To provide for and supervise instruction and training of the civilian population, including the s � Civilian Protection Corps, in their respective duties during war ti,-n es®' 1 . Said Council shall receive; acknowledge and appraise-proffers of facilities, services and ideas origin- ating within the community and make appropriate disposition clear information concerning defense programs 4' - and objectives among cooperating agencies; recommend adjust- ments or arrangements necessary for prompt assimilation of I government programs for defense to the appropriate officers$ departments or agencies; receive requests for assistance ' from the State Council of Defense and from Federal defense authorities or agencies; accumulate or assist in the accum_ ulation of information regarding local governmental, finan- 3 y cial, economic, indtistrial and human facilities and ream - i ources and transmit any .such facts, as well as other nee- essary information, to the. State Council of Defense and to- the Federal defense authoritle' se i Every department, commission, officer, and employee of the 'City of Huntington Beach shall cooperate with and assist the defense- council so as to enable the council to accomplish, the objectiv=es of this ordinance® The defense Council shall cooperate with the county council of defense F for the purpose of coordinating defense activities between the city. and the county Section 5 COMMITTEESS There is hereby created as permanent committees of the defense council: -- (1) Committee on civil protection, which shall consider defense matters relating to the public safety' the protection of civil liberties and the maintenance of law and order, including the preparation of civilian protection i plan; (2)�. Committee on #uman resources and skills'- which shall assist in .the registration of persons for defense work of all Unds, cooperate with governmental agencies in makkng plans for defense training of skilled i ' workers and other_ persons engaged in defense work require- ing special training, and analyze and report to the defense council on all proffers of assistance from private persons and organizations; (3) Committee on health, welfare, and consumer y interest, which shall consider activities designed to con— tribute directly to the social, physical and ezonomic _well® being of the individual and the family, protection from want. + protection against unwarranted rise in prices; (4) Committee- on transporation,. housing, works and facilities.,- Which shall .consider provisions for defense housing, buildings and structures, works for water supply and transportation,, highways, airports and other trans..; i �r portation facilities; ( 5) Committee on public information, which shall serve all committees of the.. council as medium through which to inform the public of defense activities$ -- develop plans for the use of newspapers, radio,. and other I means of public information, and attract and sustain citizen interest and participation in defense work; (6) Committee on industrial resources and pro-' duction, which shall consider the industrial resources of the city as these relate to defense production and assist ,af in making the most advantageous use of such facilities®' The City Council may create subh other permanent and such temporary committees of the defense council as the City Council deems necessary, shall define their duties within the purpose of this ordinance and may abolish any I � such committee0 The Chairman of the permanent committees of the defense council shall be designated by the, defense '; 5 i i council chairman from among the members of the defense council appointed as provided in Section 2 of this ordinances All members of permanent committees other than the chairman and all members of temporary committees shall be appointed by the chairman of the defense council and need not be members of the defense councilo! Section 6. DIRECTOR OF CIVILIAN DEFENSE®' The Mayor, upon recommendation of the Defense Council and the approval of the City Council, may, appoint a Director of Civilian Defense and an Assistant Director of Civilian Defense., each of which said offices are hereby created® It shall be the duty of the Director and the Assistant Director to act as General Manager and to coordinate all activities engaged in by the City Defense Council. Section 7. DEPARTMENT OF EDUCATION, A Depart- ment of Education is.hereby created to consist of a Director Of Education, an Assistant Director and not to exceed twenty (20) members to be a volunteer department, The Director of Education and Assistant Director shall be appointed by the' Mayor subject to the approval of the City Council! and said Director shall appoint the other members of the departw ment, subject to the approval of the City Council® _ The Department of Education shall. assist the chiefs of the various departments of emergency service in instructing and training candidates for membership in the Civilian Protection I Corps, and shall arrange the necessary courses .of instruct!bn 6 - ---- - ------- ------ i and maintain the standard of instruction required by the Office of Civilian Defense®' .Section 8. EMERGENCY® That this ordinance, being an emergency measure for the immediate preservation of the public peace, property, health and safety, which emergency is set forth and defined in the preamble hereto, shall take effect and be in force from and after the passage and adoption hereof. Section 9® SAVING CLAUSE. If any, provision of this ordinance or the application thereof to any person or circumstances is held ;invalid, such invalidity shall not affect other provisions or applications of this ordinance which can be given effect without the invalid provisions or applications, and to this end the provisions of this ordin- ance are declared to be severable® .Section 100 CERTIFICATION® The City Clerk shall certify to the passage and adoption of this ' ordinance by a vote of four-fifths of the members of the City Council and shall thereafter for more public notice cause the same tb be published by one insertion in the Huntington Beach News, a newspaper of general circulation, printed, published and circulated in the City of Huntington Beach, Californian PASSED AND ADOPTED by the City Council of the f City of Huntington Beach, California, at a Regular meeting thereof held on the 1 ..day of June , 1942®' ATTE �- X — MAYOR Cit Clerk 7 L- STATE OF CALIFORNIA County of Orange SS City of Huntington Beach ) I, C.
