HomeMy WebLinkAboutOrdinance #465 ORDINANCE NO. 465 i . AN ,ORDINANCE OF THE CITY OF HUNTINGTON BEACH PROVIDING FOR THE ADLEINISTPATION OF THE VICTORY TAX 'FITHIN SAID CITY. WHEREAS, .the Revenue Act of 1942. imposes P. levy of 5% on the Gross income , defined as the victory ta.x net income , of ev-ery individual, which is required to be collected at the source by employers; 55HEREAS , municipal employees are subject to the tax and municioalities are made withholding events and .required to withhold such tax and to return and pa.y over the proceeds thereof to the Federal Government ; 17HEREAS, the tax attaches to all wages paid as income after January 1 , 1943 , regardless of when they -are earned; and WHEREAS, deductions , at the option of the emioloyer, may be computed on the amount actually pa.id at any payroll period or upon the basis of wage bracket withholdings set forth in the Act Section 466 (c ) (1 ) for any payroll per. iod. NOW THEREFORE the City Council of the City of Huntington Beach, Ca1.if o.r.nia., does hereby ordain as follows: 'i Section I. That , begi.nninp� with the first payroll after January 1 , 1943, the City Clerk, is hereby authorized and directed to deduct and withhold from the T,,iages or salary - paid to each officer or emplo,ye�e of the city the Victory Tax in such an amount as is required by the Revenue Act of 1942 based on the wage bracket withholding authorized under a Section 466 (c ) (1 ) of that .Act (or 5% of the amount actually nald at any payroll period) on every payroll. -1- Section II. The City Clerk at the time of making . up the payroll or immediately thereafter, shall transfer the moneys deducted therefrom under the provisions of this Ordinance to the City Treasurer for deposit in a. separate account in the same bank whe-re other funds of said City are deposited, where they shall_ be deposited and designated a.s a. "Victory Tax Account , held for the benefit of the Collector. of Internal Revenue. " The moneys accumulated from such withholdings during each quart of the calendar year `shall be paid 'by the City treasurer to the United States Collector of Internal Revenue for the District in which this City is located on or before the last day of the month following the close of any such quarter. Section III. On or before January 31 of each ,year subsequent to 1943, or 1;rhen the last payment of wages is made , if employment is terminated. before the close of the calendar year, the Clerk shall furnish to each employee with respect to his employment during the calendar year, a written statement showing the wages for the period covered I and the amount of the tax withheld and paid in respect to such wages. k copy of this statement for every employee shall be included. with the final return for the calendar year to the Collector of Internal Revenue. The taxes to be withheld. and collected -2- under this Ordinance shall not ap -ly to any taxable year � - commencing after the date of cessation of hostilities in the present wa.r and the account established for the receiving of tax funds hereunder shall be closed ttrith the last payment . to the Federal Government of the funds «withheld. The operation of this Ordinance shall terminate at that time or sooner ; f the viotory ta.x is terminated by Fpd.eral action prior to that time. Section V. The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a tifijeekly newspaper printed, published and circulated. in the City of Huntington Beach, and thereafter it shall_ be in force and effect.
