AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA; AMENDING ORDINANCE NO. 480, ENTITLED, "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH, CALIF- ORNIA, REGULATING THE PRESENCE OF MINORS UNDER THE AGE OF 16 YEARS IN PUBLIC STREETS AND OTHER PLACES BETWEEN THE HOURS OF 10 P. M. AND 5 A. M. , DEFINING DUTIES OF PARENTS OR OTHERS C, IN CARE OF MINORS, PROVIDING FOR ARREST AND PENALTIES FOR VIOLATION THEREOF. " WHEREAS, the City of Huntington Beach, California, under date of May 1, 1944, enacted an Ordinance No. 480, entitled "An Ordinance of the City of Huntington Beach, California, Regulating the Presence of Minors Under the Age of 16 Years in Public Streets and Other Places Between the Hours of 10 P. M. and 5 A. IT. , Defining Duties of Parents or Others in Care of Minors , Providing for Arrest and Penalties for Violations Thereof" in which it was declared to be unlawful for minors under the age of 16 years to loiter, idle , wander, stroll or play in or upon the public streets-, high- C ways, roads, alleys, parks, public buildings, places of amusement and entertainment or vacant lots , between the hours of 10 P. Mi. and 5 A. 1,,[. of the folloi�iing day, and Ord. 486 C - WHEREAS, other Cities located within the Counter of Orange , and the County of Orange have adopted ordinances in which said age was set at 18 years instead of 16 years, and WHEREAS, minors between the ages of 16 and 18 years of age are now committing the various acts C within the City of Huntington Beach which said Ordinance prohibits to such an extent that they interfer with the public peace, health and safety of the community. NOW THEREFORE, in and by the above preamble Fand statement the Council declares and defines that an emergency exists necessitating the following C ordinance for the immediate preservation of the public peace , property, convenience, health and safety of the City of Huntington Beach. WHEREFORE, the City Council of the City of Huntington Beach, California, does ordain as follows: Section 1: That the title of Ordinance no. 480 C entitled "An Ordinance of the City of Huntington Beach, California, Regulating the Presence of Minors Under the Age of 16 Years in Public Streets and Other Places Between the Hours of 10 P. M. and 5 A. M. , Defining Duties of Parents or Others in Care of Minors, Providing f or VArrest and Penalties for C- 2 1 Ord. 486 C Violations Thereof' be and the same is hereby amended so as to read as follows: "An Ordinance of the City of Huntington Beach, California, Regulating the Presence of Minors Under the Age of 18 Years in I Public Streets and Other Places Between the Hours I of 10 P. N. and 5 A. MI. , Defining Duties of Parents O or others in Care of Minors, Providing; for Arrest and Penalties for Violations Thereof. " Section 2: That Section 1 of Ordinance No. 480 be and the same is hereby amended so as to read as follows: LOITERING OF MINORS PROHIBITED. It shall be unlawful for any minor un3 er the age of 18 years to loiter, idle, wander, stroll or play in or upon the public streets, highways, roads, alleys, parks, public buildings, places of amusement and enter— tainment or vacant lots, between the hours of 10 P. K. and 5 A. 1.11. of the following day, official city time; provided, however, that the provisions of this Section do not apply to a minor accompanied by his or her parent, guardian, or other adult person having the care and custody of the minor, or where the minor is upon an emergency errand or legitimate — business directed bye his or her parent , guardian, or C 3 / Ord, 86 \ �t G i other adult person having the care and custody of the minor. Section 3: That this Ordinance , being an emergency measure for the immediate preservation of the public peace, property, health a.nd safety, nihich emergency is set forth and defined in the O preamble hereto, shall take effect and be in force from and after the passage and adoption hereof. Section 4: The City Clerk shall certify to the passage and adoption of this Ordinance by a, vote of four—fifths (4/5) of the members of the City Council , and shall thereafter fo.r more public C notice cause the same to be published by one insertion in the Huntington Beach News, a, newspaper of general circulation, printed, published and circulated in the City of Huntington Beach, California.
