AN ORDINANCE OF THE CITY OF HUNTINGTON
BEACH, CALIFORNIA, ESTABLISHING PRO-
CEDURE GOVERNING THE LEASING OF OIL
WELLS.
WHEREAS , the City owns certain property in the
oil fields located in Huntington Beach in the area be-
tween Twelfth Street and Twenty-third Street and between
Walnut Avenue and Palm Avenue, and
WHEREAS , many wells are now being drilled in

said area which will result in the depletion of oil,
gas and other hydrocarbon substances located in and
under the property owned by the City, and the City will
lose a great amount of revenue., which revenue would be
/- used, among other things , for the protection of the
public peace, safety, property and general welfare of
the City,
NOW THEREFORE, in and by this Preamble, the City
Council does hereby declare that an emergency exists
justifying the passage of this Ordinance for ,the pro-
tection of the public property, peace, health and safety of
the community.
1 WHEREFORE, The City Council does ordain as
follows:
Section 1: That the City Council , at any re-
gular meeting, by resolution passed by majority votej -
may declare its intention to lease any property owned
by the City for the production of or exploration for
oil , gas and other hydrocarbon substances. Notice of
said intention shall be published by one insertion in

a newspaper of general circulation printed and pub-

—---- lished within said City. Said notice shall be in sub-
stantially the following form:
"NOTICE OF INTENTION TO ENTER INTO OIL AND GAS
LEASE. "
"NOtice is hereby given that the City Council
of the City of Huntington Beach, California , did , at
a regular (adjourned) meeting held on the day of
19_, pass a Resolution declaring its in-
tentibn to lease the following described property for
the purpose of exploration for and production of oil
gas , and other hydrocarbon substances:

"Notice is hereby given that anyone interested
in entering into a lease with the City covering said
property or parcel thereof, is hereby requested to
submit a proposal to the City Council before 7:30 P.M.
on the . day of , 19i, at which time
said matter will be presented to the City Council.

Section 2: At the time set in said notice , the
City Council shall examine the proposals and said propery
may be leased to the person, firm or corporation whom
the City Council finds and declares to be the highest
responsible and best qualified person, firm or corpor-
ation to perform the terms and conditions of said proposed
lease.

Section 3: The City Council may, by:, resolution
passed by four-fifths (4/5thso vote , .resolve , find and
declare that the best interest of the City will be ser-
ved and protected by immediately entering into an oil
and gas lease with a person designated in said reso-
lution, and may after the passing of said resolution
enter into a lease without further observing of the
provisions of Section 1 and 2 hereof.
Section 4: That this Ordinance, having an emer-
gency measure for the immediate preservation of the
public peace , property, health and safety, which emer-
gency is set forth and defined in the preamble hereto,
shall take effect and be in force from and after the
passage and adoption hereof.
Section 5: That the City Clerk shall certify
to the passage and adoption of this Ordinance by a
vote of four-fifths (4/5ths) of the member s of the
City Council and shall thereafter for more public
notice cause the same to be published by one insertion
in the Huntington Beach News , a newspaper of general
circulation printed , published and circulated in the
City of Huntington Beach, California .

City of Huntington Beach, California , this 15 day of

qualified and acting City Clerk of the City of Huntington
Beach, California, and ex-officio Clerk of the City
Council of said City, do hereby certify that the whole
number of members of the City Council of the City of Hunt-
ington Beach is five; that the foregoing Ordinance was first
read to said City Council at an regular meeting thereof
held on the 1St day of March , 1948,. and was aglin read

was passed and adopted by the affirmative vote of more
than a majority of all the members of said City Council
