HomeMy WebLinkAboutOrdinance #539 ORDINANCE NO. 539 AN ORDINANCE CREATING A PUBLIC RECREATION COMMISSION, PRESCRIB- ING TERMS OF MEMBERS ORGANIZATION AND POWERS AND DUT IE9. The City Council of the City of Huntington Beach does ordain as follows: Section 1:. There is hereby established a Depart- ment of Public Recreation hereinafter referred to as "The Department", which shall operate in and for the City of Huntington Beach, County of Orange, State of California, hereinafter referred to as "The City". The Department shall be under the control and management of the Public Recreation Commission, here- inafter referred to as "The Commission", which com- mission shall be composed of five members who shall be appointed from time to time by the Mayor of the City of Huntington Beach with the approval of the City Council by a majority vote. The first members appointed hereunder shall be appointed for the following terms: One shall serve in office for a period of two years ; ;two shall serve in office for a period of four years, and two shall serve in office for i a period of five years. Thereafter, each member. 1 Ord. 539 appointed shall serve in office for a term of five years, the method of appointment to remain the same. The term or terms of office specified herein shall not be deemed arbitrary and should, by majority vote after a fair hearing has been conducted thereon, the Mayor with the approval of the City Council, determine that' it would be for the best interests of the Department that a member be retired, he may so order and appoint a successor for the unexpired term ofctfice of such retired member. Further, members shall be privileged to voluntarily retire from the Commission at any time, successors to be appointed in such case, and also in the event of other occurring vacancies from whatever cause, by the Mayor,, with the approval of the City Council by a majority vote for the unexpired terms of office. Members may be reappointed by the Mayor with the approval of the City Council for as many terms of office as is desirable. The Mayor shall be ex-officio member of said Commission. All members of such Commission shall serve without compensation. v Section 2: The commission shall have the power to adopt rules and regulations and for the proper conduct of public .recreation of the City. Within .fifteen days after the appointment ' of the members of the Commission it shall meet and appoint a temporary chairman who shall preside over such meeting. At such meeting the Commission 2 Ord. 539 shall elect by a majority vote three officers, a chairman, a vice-chairman and a treasurer, which officers shall serve for periods of one year in such capacity subject to re- election. Regular and special meetings shall be open to the public. Section 3: The duties of the various officers of the Commission shall be as follows: (a) The chairman shall preside at all meetings, submit all motions to vote, and in general do all things ordinarily required of Commission Chairman. . (b) The Vice-chairman shall assume the duties of the chairman in his absence. a (c)' The Treasurer shall prepare an annual report on activities of the Commission to the City Council prior to the beginning of each fiscal year, in which report shall be included an annual departmental budget covering the expenditures of the Department for the succeeding year, and shall issue all warrants drawn against the Special Recreation Fund hereafter provided for, the same to be countersigned by the Mayor and City Clerk. All such officers shall have the right to vote on all submitted motions at meetings. Section 4: The general objective of the Department shall be to encourage, foster, facilitate, establish and maintain a systemized program of recreation to be made 3 Ord. 539 available to residents and visitors of the City on any of the properties owned or controlled by the City, or on other properties, with the consent of the owners and authorities thereof. Section 5: To achieve the objective of the Depart- ment, the following shall be the powers and duties of the Commission: (a) To establish an adequate system of recreation, to equip and maintain such recreation facilities and to provide the personnel required by such facilities. (b) The Commission may with the consent of the City Council by majority vote use City lands or buildings or both for recreation centers and may use school board property with the consent of the governing bodies of said board or boards. (c) The Commission may with the consent of the City Council by majority vote acquire in the name of the City by gift or purchase such real or personal property as is deemed necessary to effect the desired objectives. (d) The Commission may, with the consent of the City Council by majority vote enter into any contracts and do any and all things necessary and proper for the establishment, development and maintenance of a well rounded recreation program. 4 Ord. 539 Section 6: The Department may accept all gifts, devises, legacies or bequests, either real or personal property ,from any source, public or private. All moneys so obtained by the Department shall be deposited by the Department in the Treasury of the City in a Special Recreation Fund, which fund shall .be exclusively for the purposes of the Department and shall be paid out by the CityCouncil u demands audited and on p approved by the Commission and the City. Section 7: The City Council shall annually establish a recreation budget to supplement the Special Recreation Fund, and may transfer such moneys to said fund as may be required. Section 8: The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Hunting- ton Beach News, a weekly newspaper, printed, published and circulated in the City of Huntington Beach, California, and thirty (30) days after the adoption hereof the same 1 shall take effect and be in force. Council of said City of Huntington Beach, do hereby certify that the whole number of members of the City Council of the City of Huntington Beach is five, that the foregoing Ordinance was first read to said City Council at a regular meeting thereof held on the 7th day of February, 1949, and was again read to said City Council at a regular meeting thereof held on the 7th day of Maroh , 1949, and was passed and adopted by the affirmative vote of more than a majority of all the members of said City Council as follows: AYES: Councilmens LeBard, Terry, Seabridge, Langenbeok, Greer,, NOES: Councilmen: None, ABSENT : Councilmen: None, City Clerk and officio Clerk of the City Council of the City of Huntington Beach, California. 6
