HomeMy WebLinkAboutOrdinance #554 • ORDINANCE NO. 554 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, AMENDING ORDINANCE NO. 344, ENTITLED, "AN ORDINANCE PRO- VIDING FOR THE CONTROL AND SUPERVISION OF THE PUBLIC WHARF OR PIER AT THE FOOT OF MAIN STREET IN THE CITY OF HUNTINGTON BEACH, AND REGULATING ITS USE, " AS AMENDED . , The City Council of the City of Huntington Beach, California, do ordain as follows: Section 1: That Ordinance No. 344, entitled, "An Ordinance Providing for the Control and Supervision of the Public Wharf or Pier at the Foot of Main Street in the City of Huntington Beach, and Regulating its Use", as amended, .be and the same is hereby amended by amending Section 3 thereof, and by adding 14 new sections thereto, to be known as Sections 3 .1, 3.2, 3.3, 3.4, 3.5, 3.6, 3. 7, 3.8, 3.9, 3.10, 3.11, 3.12, 3.13 and 3.14 Said amended section and said nets sections to read respectively as follows: Section 3: It shall be unlawful for any person or persons while upon or near the Municipal Pier, located at the foot of Main Street in the City of Huntington Beach, and over the Pacific Ocean in said City, to do or cause or permit to be done, any of the following acts , to wit: 3 1 Ord. 554 Section 3.1: To cast a fishing line, either with or without a fishing pole, by what is commonly known as overhead casting. Section 3..2: To place, cut or clean any fish or bait, or any :other marine life upon any bench or seat placed upon the Municipal Pier or upon the floor of the Pier unless the same is placed in a container. Section 3.3: To leave said pier without disposing of any trash, shells or other debris which may be placed upon said pier by said person cr persons. Section 3.4: To drive or permit ' to be driven any vehicle of any' kind or character whatsoever upon said pier without first having obtained a permit from the Chief of Police of the City of Huntington Beach so to do. Section 3.5: To ride or to permit to be ridden any bicycle, tricycle or motorcycle on the pier. Section 3.6: To have more than two fishing lines to any one person in the Crater under or near said pier at any one time; providing, the term "fishing line" as herein used shall be defined to include mussel hooks and crab hooks . Section 3.7: To allow or permit any fishing pole to extend further from the rail than four (4) feet. Section 3.8: To take, cause or permit to be taken upon said pier any dogror other domestic animal. 2 Ordo554 I Section 3.9: To deface, injure, mark or damage any benches, seata, buildings or equipment uponEaid pier. Section 3.10: To remove, use or tamper with any life saving equipment upon said pier except in time of emergency. Section 3.11: To dive off the pier unless with the express permission of the life guard and then only unless the chief life guard is present. Section 3.12: To use a mussel hook except with permission of the wharfinger. Section 3 .13: To take more than fifteen (15) pounds of mussels from the pier in any one day. Section 3.14: To have more than two lobster traps to any one person in the water under or near said pier at any one time. Said traps to be attended by a person at all times, provided, the term ' attended' shall be defined to be within 500 feet of said traps at all times. Section 2: The City Ulerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and circulated in the Lity of Huntington Beach, California, and thirty (30) .days after the adoption hereof the same shall take effect and be in. force. 3 Ord- 554 PASSED AND ADOPTED by the City Council of the City of Huntington Beach, California, this loth day of November, 1949• MAYOR ATTEST: City Jerk 1 1 4 STATE OF Ord- 554 CALIFORNIA ) County of Orange ) ss City of Huntington Beach ) I, JOHN L . .HENRICKSEN, the duly elected, qualified and acting City Clerk of the City of Huntington Beach and ex-officio Clerk of the City Council of said City of Huntington Beach, •do hereby certify that the whole number of members of the City Council of the City of Huntington 1 Beach is five, that the foregoing Ordinance was first read to said City Council at a regular meeting thereof held on the 7th day of November, 1949, and was again read to said City Council at a regular adjourned meeting thereof held on the 14th day of November, 1949, and was passed and adopted by the affirmative vote of more than a majority of all members of said City Council as follows: AYES: Councilmen: Wood, Seabridge, Langenbeck9 Greer.
