AN ORDINANCE OF THE CITY OF HUNTINGTON
BEACH, CALIFORNIA, AMENDING ORDINANCE
NO. 4181 OF SAID CITY, ENTITLED, "AN
ORDINANCE OF THE CITY OF HUNTINGTON BEACH,
CALIFORNIA, DECLARING AND DEFINING AN
EMERGENCY TO EXIST AND REGULATING THE
APPLICATION FOR AND THE DRILLING OF OIL
WELLS WITHIN SAID CITY OF HUNTINGTON
BEACH" AS AMENDED.
The City Council of the City of Huntington Beach,
California, does ordain as follows:
Section 1:, That a new section is hereby added
to Ordinance No. 418, entitled "An Ordinance of the
City of Huntington Beach, California, Declaring and
Defining an Emergency to Exist and Regulating the
Application for and the Drilling of Oil Wells within
said City of Huntington Beach" as amended, the same
to be known as Section 6a, and to be inserted immediately
after Section 6, the same to read as follows::
Section 6a: Termination of Bond: Any bond filed
under this Ordinance may be terminated and cancelled and
the sureties thereon relieved of all further liability
thereon under the following circumstances:
1. Completion of the abandonment of said oil well
as provided in the public resources Code of the State of
C-alifornia and statement of the State Oil and Gas Super-
visor . or of a deputy is contained in the application.

2. Failure to drill the proposed oil well after
securing a permit therefor as provided in this Ordinance
upon surrender of such permit.
3. The filing of a duly authenticated copy of a
survey of said oil well, showing the well within the
perpendicular boundaries of the property on which drilled.
4. Special permission of the City Council after a

public hearing, notice of which was published in a news-
paper of general circulation, published within said City,
for at least five days prior to said hearing, when it
appears that said well has been completed for at least
ten months and that said well is entirely within the
perpendicular boundaries of the property upon which it
was drilled, or if it is drilled off said property, the
written consent and waiver of damages of all persons
interested in said property as indicated by a title
report from a reputable title company is on file with
the City Council.
i Application for termination of bond shall be filed
with the City Engineer, if the application is based upon
the first, second or third grounds the same shall be
presented to the City Council at the next meeting,
together with a report and recommendation of the City
Engineer, providing, the City Council may in its dis-
cretion hold a public hearing thereon.

If the application is for special permission to
terminate bond a fee of $5.00 shall be collected and the
City Engineer shall cause a notice thereof to be placed
in the official newspaper of said City, and cause the
same to be set for hearing at the first regular meeting
held at least five days after the publication- of said
notice, at which hearing the City Council may consider

evidence for and against said termination. The appli-
cation may contain a request to terminate bonds on one
or more wells.
Section 2: The City Clerk shall certify to the
passage and adoption of this Ordinance and shall cause
the same to be published by one insertion in the
Huntington Beach News, a weekly newspaper, printed,
published: and circulated in the City of Huntington Beach,
California, and thirty days after the adoption thereof
the same shall take effect and be in force.

of Huntington Beach, California, this 3rd day of

Beach is five, that the foregoing Ordinance was first read

the 20th day of March, 1950, and was again read to said
City Council at a regular meeting thereof held on the
3rd day of April, , 1950, and was passed and
adopted by the affirmative vote of more than a majority
of all the members of said City Council as follows:
