ORDINANCE NO. 571 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH PROVIDING FOR THE APPOINTMENT OF A PLUMBING INSPECTOR, DEFINING HIS DUTIES AND FIXING HIS COMPENSATION• REGULATING THE METHOD OF CON- STRUCTING PL&ENG WORK, HOUSE DRAINAGE, AND GAS FITTINGS; PROVIDING FOR THE INSPECTION THEREOF AND THE ISSUANCE OF PERMITS THEREFOR; AND PROVIDING A PENALTY FOR THE VIOLATION OF SAID ORDINANCE. The City Council of the City of Huntington Beach do ordain as follows: Section 1: APPOINTMENT OF PLUMBING INSPECTOR. The City Council of the City of Huntington Beach shall appoint a Plumbing Inspector for the City of Huntington Beach who shall hold office during the pleasure of said City Council, and said Plumbing Inspector shall receive as compensation for his ser- vices a sum to be determined by said City Council. Section 2: DUTY OF INSPECTOR. It shall be the duty of said Plumbing Inspector to furnish to each and every person, firm, company or corporation contemplating the construction of any plumbing, house drainage or gas fitting within the limits of said City, a permit for such work upon the terms and con- ditions hereinafter set forth. He shall inspect in a thorough manner all plumbing installed in old and new buildings in said City. It shall be his duty to see that the terms and provisions of this ordinance or any amendment thereto are complied with; he shall examine all plans and specifications of contemplated buildings and improvements, alterations and repairs, that are . filed with the Building Department insofar as said plans and -1- Ord© 571 • specifications shall relate to plumbing or sanitary conditions thereof, ' Section 3: DISAPPROVAL OF PLANS. If the plans re- lating to plumbing or gas fittings are found to be incorrect or faulty, they shall be disapproved, and the applicant notified of the corrections necessary to comply with the rules and reg- ulations as set forth by the State, the Department of Health, and the City Plumbing Ordinance. Section 1+: LICENSE. Any person, firm or corporation carrying on the business of Plumbing, constructing or assum- ing control of any Plumbing; house drainage, 'or gas fitting affecting the sanitary conditions of any house or building situated within the limits of Huntington Beach, shall first obtain a license therefor, from the City Clerk of said- City, and shall pay therefor the sum of One Hundred Dollars ($100.00) per year or any portion of a year, payable annually in advance, and no such person, firm, company or corporation shall engage in the business or work of plumbing or gas-fitting in the . said City without procuring such license from the City Clerk; and such license shall expire on the first day of July of each year. Section 5: BOND. Every master plumber before he is granted a license, shall give a Bond to the City of Huntington Beach in the sum of Five Hundred Dollars ($500.00) , for the faithful discharge of his duties as master plumber, to secure_ any person ordering work done by him against damages by reason of faulty workmanship, which sureties shall qualify that they are worth said sum in property over and. above all liabilities, and exemptions; which said Bond shall be approved by the City Council of said City, and shall be filed with the City Clerk -2- Ord- 571 o • thereof. At the expiration of his yearly license every per- son carrying on the business of plumbing, within thirty days, shall again register and file a new bond as aforesaid. Section 6: PERMITS. It shall be unlawful for any person, firm.or corporation, whether acting as principal, ser- vant or employee to do or cause or permit to be done any plumb- . ing or gas fitting work within the area covered by this Ordi- nance without first obtaining a permit therefor from the Plumbing Inspector of said City. Section 7: APPLICATION FOR PERMIT. Any person, firm or corporation desiring such a permit shall apply therefor at the office of said Plumbing Inspector who may require the ap-. plicant for such a permit to file a plan or drawing showing layout of work and fittings proposed to be used and a de- scription of the location and character of the work proposed to be done, and a statement of the cost thereof, together with such other information as the Plumbing Inspector may reasonably require. Should the plans, drawings, or work show that it is proposed to be done in accordance with the terms of this Ordi- nance and all laws of the State of California, the Plumbing Inspector, upon payment of the proper fee as hereinafter fixed, shall issue the permit applied for. All work under such per- mit shall be done in accordance with the submitted plan and description or modifications thereof approved by the Plumbing Inspector and shall be subjected to inspection by the Plumbing Inspector. Section 8: EXTRA PERMIT REQUIRED. When one master plumber, to whom a permit has been issued, completes the rough work, in whole or in part, or any plumbing installation, and -3- Or'de 571 a second party is called upon to complete said installation, in whole or in part, then a second and separate permit shall be required. Each person holding a permit for the construction of such work shall be held responsible only for that portion of .the work installed by him. Before issuing such second per- mit, the Plumbing Inspector shall first notify the Master Plumb- er holding the first or original permit that the issuance of a second permit has been requested or is to be issued. A sec- ond permit shall be invalid until such notice is given. The issuance of such second permit shall operate to revoke the first permit. The term "Master Plumber," as used in this sec- tion, shall be construed to mean any person, firm or corpor- ation, or agent thereof, carrying on the business of plumbing and assuming responsibility for the sanitary installation of such work. Section 9: PERMITS VOID AFTER ONE YEAR. If the plumbing or gas-fitting work authorized by any permit issued under this Ordinance is not commenced within ninety (90) days from date of issuance of such permit, or if such work is not completed and certificate of approval issued thereon within one year from date of issuance of such permit, then such per- mit shall thereupon and thereafter be void, and before any further plumbing work is done at the location designated in said permit, a new permit must be obtained in the same manner and upon payment of the same fees as are required herein for an original permit. Section 10: NO PERMIT REQUIRED. No permit .shall be required for repairs necessitated by leaks in drain, soil, waste or vent pipes; provided, however, that should any trap, Ordo 571 drain-pipe, soil-pipe, or vent-pipe be, or become bad or de- fective, by reason of which it becomes necessary to remove or replace the same with sound material in any part or parts thereof, or should any plumbing fixture or gas water heater be disconnected, removed or replaced, a permit must be secured and inspection made as herein provided. Section 11: NO PERMITS TO UNLICENSED PERSONS. No plumbing permit except as provided in Section 12, shall be . issued to any person who is not licensed, provided, however, that nothing contained herein shall be deemed to prevent any dealer in gas appliances from connecting any gas range, re- frigerator, or portable space heater to an existing gas out- let located within the same room and close to the position of such appliance. Section 12: OWNER'S PERMIT. A plumbing permit may be issued to the owner of the legal or equitable title to any property in the incorporated territory of the City of Huntington Beach used exclusively for residence purposes or as an access- ory building to a residence, to alter, repair or install any plumbing on, in or in connection with said property, provided the said alteration, repair or installation is done by himself, or a member of his household. Section 13: UNPAID FEES. No permit shall be issued to any person, firm or corporation until all prior fees due from such person, firm or corporation, under the provisions of this Code, have been fully paid. Section 14: COST OF PERMITS. Section 15: NOTICE OF INSPECTION. It shall be the duty of the owner or contractor doing plumbing work, or hav- ing the same done, to request inspection of both rough and finish work and the Plumbing Inspector shall make one inspect- ion of the rough plumbing and one inspection of the finish. Any additional inspections for any cause 'nay be charged for at. the rate of One Dollar ($1.00) per inspection and when any changes or alterations ordered are completed, notice of completion of such work shall be given to the Plumbing Inspect- or and reinspection requested; provided, however, that where the character of construction is such that one inspection is not sufficient, additional inspections shall be made as the work progresses without payment of additional fees. -6- Ord, 571 Requests for inspection shall indicate the kind of inspection to be made; such as, rough drainage, gas piping, cesspool, septic tank or final and shall identify the job by owner's name and permit number or by the name of the owner and a description of the location of the work. Inspection will be made when possible within forty- eight (48) hours, Saturdays, Sundays and holidays excepted, after notice of inspection is received by the Plumbing In- spector. Failure to inspect following notice as above required shall be reported to the Chief Building Inspector for immed- iate attention. In no event shall any plumbing work be covered or concealed before inspection is made and work approved. Section 16: APPLICATION FOR FINAL INSPECTION. With- in ten (10) days after the completion of any work for which a plumbing permit has been issued, the person, firm or corpor- ation to whom such permit was issued, shall make application for final inspection of such work. Any person, firm or corpor- ation, failing to apply for such inspection within said period of ten (10) days shall be required to pay an additional fee of One Dollar ($1.00) for such inspection. Section 17: CREDENTIALS. The Plumbing Inspector shall in the performance of his duties, and upon the exhibition of the proper credentials, have the right to inspect any and all buildings and premises situated .within the areas affected by this Code. Section 18: EXAMINATION. No person whether as prin- cipal, agent, manager or employee, shall conduct, manage or -7- Ordo 571 carry on the trade, business or calling of a master plumber, or labor at the trade of plumbing, or do any plumbing work of any kind or description within the City of Huntington Beach, for which a plumbing permit is required, without first having submitted to a practical examination before, and having ob- tained from the Examining Board of Plumbers of the City of Huntington Beach, a certificate of competency showing such per- son to have sufficient practical experience and knowledge to do plumbing work. If any applicant fails to pass such exam- ination, he may apply for re-examination, but not until after the elapse of thirty (30) days from such former examination. Section 19: EXAMINING BOARD. The Examining Board of Plumbers of the City of Huntington Beach shall consist of the Building Inspector, Health Officer of the City of Hunting- ton Beach, one Master Plumber and the Plumbing Inspector. The master plumber for the examining board shall be appointed by and shall serve during the pleasure of the City Council of the City of Huntington Beach. The Board of Examiners shall hold one regular meeting each month or on call of the Building In- spector. The presence of any three members of. the Board shall constitute a quorum for the purpose of transacting any busi- ness of said Board. Section 20: MASTER PLUMBER. For the purpose of this Ordinance a Master Plumber shall be deemed to be a person en- gaged in or carrying on the business of plumbing, or doing plumbing work, including the laying of cast iron sewers, who maintains an established place of business and to whom has been issued a license to carry on the business of plumbing in 1 the City of Huntington Beach. -8- Ord® 571 Section .21: REGISTERED CONTRACTOR'S CLASSIFICATIOX C-36. The Examining Board of Plumbers shall issue a Master Plumber' s license upon payment of the required fee to an appli- cant who is the bona fide possessor of a registered license to - install plumbing work issued by the State of California and identified by the classification C-36. The fee for such license shall be' the sum of One Hundred Dollars ($100.00) per year or any fraction thereof, payable annually in advance and / shall expire on the thirtieth day of June in each year. Section 22: JOURNEYMAN PLUMBER. For the purpose of this Ordinance, a journeyman plumber shall be deemed to be any person who is employed to do plumbing work for wages or salary, but who does not furnish any material or supplies in the execution or performance of plumbing work® The fee for a journeyman plumber's license shall be the sum of Two Dollars and Fifty Cents ($2.50) per year or any fraction thereof, payable annually in advance and shall expire on the thirtieth day of June in each year. Section 23: -CANCELLATION OF LICENSE OR CERTIFICATES. The City Council of the City of Huntington Beach' shall have 1 the power to suspend or cancel the license of any master plumber or the certificate of any journeyman plumber for any violation of this Ordinance or for incompetency. Section 21+: REGULATIONS AND SPECIFICATIONS. The Plumbing Inspector, in approving plans or in accepting work of any or all persons carrying on, conducting or causing to be constructed, any plumbing or house drainage affecting the sanitary condition of any house or building within the area 1 affected by this Ordinance shall be governed by the regulations Orden 571. • hereinafter set forth, and it shall be unlawful f or any person to fail, neglect or refuse to comply with any one or more of such regulations. Section 25: ADOPTION OF CODE OF RULES AND REGULA- TIONS. Three copies of a code in book form, establishing rules and regulations for the installation of plumbing, house drainage and gas fittings, in the City of Huntington Beach, have heretofore been filed with the City Clerk of the City of Huntington Beach, and said Code is hereby adopted and made a part of this ordinance by reference, the same as though the same were set forth in full herein. Section 26: PENALTIES FOR VIOLATION. Any -person, firm, or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not more than Three Hundred Dollars ($300.00) or by imprisonment in the County Jail for a period of not more than six months, or by both such fine and imprisonment. Each such person, firm or corporation shall be deemed guilty of a separate offense for each day or portion thereof during which any violation of any of the provisions of this ordinance is committed, continued or permitted, by such person, firm or corporation, and shall be punishable therefor as herein provided. Section 27: CONSTITUTIONAL DECLARATION. If any section, subsection, sentence, clause or phrase of this ordin- ance is for any reason held to be unconstitutional, such decision shall not affect the validity of the remaining portion of this ordinance. The City Council of the City of Huntington 1 Beach hereby declare that it would have passed this ordinance, -10- Ordo 571 and each section, subsection, 'sentence, clause and phrase • thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared uncon® stitutional. Section 28: ORDINANCES REPEALED. All ordinances or parts of ordinances in conflict with the provisions of this ordinance be and the same` are hereby repealed. Section 29: That the City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and cir® culated . in the City of Huntington Beach, California; and thirty days after the adoption hereof the same shall take effect and be in force.
