AN ORDINANCE OF THE CITY OF HUNTINGTON
BEACH, C ALIFORTdIA, AUTHORIZING AN AMEND-
MENT TO THE CONTRACT PROVIDING FOR THE
PARTICIPATION OF THE CITY OF HUNTINGTON
BEACH IN THE CALIFORNIA STAoTE EMPLOYEES'
RETIREMENT SYSTEM, MAKING ITS EMPLOYEES
MEMBERS OF SAID SYSTEM.
The City Council of the City of Huntington Beach,
California, do ardain as follows:
Section la That an amendment to the contract pro-
viding for the participation of the City of Huntington-.
Beach in the State Employeesr Retirement System., is
hereby authorized between the City Council of the
City of Huntington Beach, California, and the Board
of Administration, California State Employeest Retire-
ment System., a copy of said amendment being attached
hereto, marked "Exhibit All ,` and by such reference made
a part hereof as though herein set out in full..
Section 2: The Mayor of the City of Huntingtonyj
1 Beach-- is hereby authorized, empowered, and directed to
execute said amendment for and on behalf of said City.
Section 3: This Ordinance shall take effect from
and after March 1, 1952, and prior to the expiration
of fourteen days from the passage thereof shall be
published at least once in the Huntington Beach News,

a newspaper of general circulation, published and
circulated in the City of Huntington Beach, and
thenceforth and thereafter the same shall be in full
force and effect.

I, JOHN L. HENRICKSEN, the duly elected, qualified
and acting City Clerk of the City of Huntington Beach and
ex-officio Clerk of the City Council of said City of
Huntington Beach, do hereby certify that the whole number of
members of the City Council of the City of. Huntington-., Beach
is five, that the foregoing Ordinance was first read to
said City Council at a regular meeting thereof held on
the 7th day of January - , 195 2 , and was again- read
to said City Council. at a regular meeting lbhereof held on
the 21st day of January , 195 2 , and was passed and
adopted by the affirmative vote of more than two---thirds
of all members of said City Council as follows:

AND THE CITY COUNCIL
OF THE .
CITY OF HUNTINGTON BEACH
The Board of Administration, State Employees, retirement System,, and the CITY
COUNCIL. of the CITY OF HUNTINGTON BEACH hereinafter referred to as Agency,, having
entered into a contract under date of October 27, 1945, effective October 1 19459
which provides for the participation of said Agency in said Retirement System, and
said Contract being based on the Retirement La% as that Law existed prior to amend-
ments adopted in 1949, said Board of Administration and said CITY COUNCIL hereby
agree to amend said Contract as follows$
to Paragraph 6 of said Contract shall be and is, hereby stricken from said
Contracto
2m The following paragraphs shall be added to said Contracts
6,9 Prior service benefits to miscellaneous members employed by Public
Agency, that is, members other than Local Firemen, Local Policemen,
or County Peace Officers, upon retirement for service, shall be allowed
only as a percentage of the average salary spedified in Section 21253,
of said Retirement Law, for each year of such service, and said per-
centage shall be 100 per cent of the percentage determined under said
Section for the age of retirement®
13® Age 55 shall be the minimum age for retirement for service of persons
who are members because of employment by Public Agency as Local Fire-
men., Local Policemen or County Peace Officers and the provisions of
Section 21252,4 of the State EmployeesO Retirement Lair., providing for
a guaranteed percentage of final compensation for each year of current
service as a member, SHALL apply to such members®
14o The retirement allowances of persons who were members because of em-
ployment by Public Agency and who were retired prior to the effective
date of this amendment shall be recalculated on the basis of this
contract, but in no event shall any allowance be decreased, and said
allowances shall be paid for time beginning with the effective date
of this amendment in the recalculated amounts° Paragraph 8 of this
contract shall apply to persons retired prior to the effective date
of this amendment and whose death occurs while receiving a retirement
allowance based on time after said effective' date because of employment
by Public Agency.
15. The provisions of Section 2080h®5 of the State Employees' Retirement
Law, providing for an elec i$�on by members to contribute for the first
six months of service SHALL apply to employees of Public Agency who on
the effective date of =s amendment are members or thereafter become
members of said Retirement System®
3. Paragraph lla of said Contract shall be amended to reads
The sum of $15,369,00 per annuar, or more frequent installments as
Board shall require, for the period of years stated in said Con-
tract, less the time elapsed from-the date of participation to the
effective date hereof.
4. The percent stated in paragrapk llb shall be amended to read 60819 instead
of 8o852a
5® 'Benefits, including retirement allowances, prior to the effective date of
this amendment, shall not be affected by this amendment, except as other—
wise provided herein®
6m This amendment shall be attached to said contract and shall be effective as
of March 1, 1952.
