HomeMy WebLinkAboutOrdinance #584 ORDINANCE NO. 584 AN ORDINANCE OF THE CITY OF HUNTI NGTON BEACH AMENDING ORDINANCE NO. 322 OF SAID CITY, ENTITLED "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, RELATING TO AND REGULATING TRAFFIC UPON THE PUBLIC STREETS OF THE CITY OF HUNTING- TON BEACH AND REPEALING ALL ORDINANCES INCONSISTENT HEREWITH," AS AMENDED. The City Council of the City of Huntington Beach, California, does ordain as follows: Section 1: Section l of Ordinance No. 322 is hereby amended to read as follows: Section 1. Definitions. In any traffic ordinance of the City of Huntington Beach in which any of the follow- ing terms is used but is not defined, the meaning of such term shall be as follows: "Loading zone" means the space adjacent to a curb reserved for the exclusive use of vehicles during the loading or unloading of passengers or materials. "Official traffic control devices" includes all signs, signals , markings or devices not inconsistent with ordinance placed or erected by authority of a public body or official having jurisdiction, for the purpose of regu- lating , warning or guiding traffic. "Official traffic signals" 'includes any device, whether manually, electrically or mechanically operated, by which traffic is alternately directed to stop and pro- ceed and which is erected by authority of a public body or official haying jurisdiction. -1- Ord. 584 i "Park" means to stand or leave standing any vehicle, whether occupied or not, otherwise than. temporarily for the purpose of and while actually engaged in loading or unloading of passengers or materials. "Passenger loading zone"means the space adjacent to a curb reserved for the exclusive use of behicles during the loading or unloading of passengers. "Pedestrian" means any person afoot.. "Police officer" means every officer of the police department of the City of Huntington Beach. "Stop" , when required, means complete cessation of movement. "Stop or stand" , when prohibited, means any stopping or standing of a vehicle , whether occupied or not , except when necessary to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic control device. "Traffic" means pedestrians , ridden or herded animals , vehicles , and other conveyances either singly or together while using any street for purposes of travel. Vehicle Code Definitions. All terms which are defined in the California Vehicle Code shall have the same meaning in all traffic ordinances of the City of Huntington Beach as in the said Vehicle Code , except in ordinances in which such terms are otherwise defined. Official Time Standard. Whenever certain hours. are named in any traffic ordinance of the City of Huntington Beach, they shall mean standard time or daylight saving time as may be in current use in the State of California. Ord, 584 Section 2: The following sections of Ordinance No. 322 are hereby repealed: Section 5, entitled "Traffic Stop and Go Signal Legend." Section 3: Section 6 of Ordinance No 322 is hereby amended to read as follows: Section 6. Crosswalks Authorized. The Chief of Police is hereby authorized and required to establish and 1 maintain and to designate upon the surface of the roadway by appropriate devices, marks or white or yellow lines , crosswalks approximately equal in width to the adjacent sidewalk at all intersections where in his opinion there is particular danger to pedestrians crossing the roadway. Section 4: The following sections of Ordinance No. 322 are hereby repealed: Section 9, entitled "Pedestrian' s Right of Way at Intersection." Section 10, entitled "Pedestrian' s Limited Right to Use of Roadway. Section 11, entitled "Pedestrians to Obey Signals." Section 12, entitled "Pedestrians Standing on Side- walk." Section 13, entitled "Method of Approach for Left Turn." Section 14, entitled "Method of Turning to Left at Intersection." 1 Section 17, entitled "Method of Approach for Right Turn." -3- Ord. .584 Section 18, entitled "When Right Turns May Be Made." Section 19, entitled "When Turning Around at Inter- sections ." Section 24, entitled "Following Fire Apparatus Pro- hibited." Section 25, entitled "Crossing Fire Hose." . Section 5: Section 31 of Ordinance No. 322 is hereby 1 amended to read as follows: Section 31. Painting Curbs near Safety Zones, Inter- sections. Upon all streets within any business district, the Chief of Police shall designate the provisions of sections 586(c) and 586(d) of the California Vehicle Code, by placing and maintaining red paint or other red material upon the entire curb surface within areas, omitting any crosswalk area, or by placing and maintaining appropriate signs direc- ting that the stopping of vehicles is prohibited.. Section 6: The following sections of Ordinance No. 322 are hereby repealed. Section 35, entitled "Standing or Close to Curb." Section 37, entitled "Riding on Vehicle Running Board." Section 7: The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News , a weekly newspaper printed, published and circulated in the City of Huntington Beach, Orange County, California; and thirty (30) _4_ Ord. 584 r days after the adoption hereof the same shall take effect and be in force.
