HomeMy WebLinkAboutOrdinance #585 ORDINANCE NO. 585 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING ORDINANCE NO. 425, ENTITLED "AN ORDINANCE PROVIDING A •KY. SYSTEM FOR THE RAISING OF REVENUE BY TAXATION FOR THE CITY OF HUNTINGTON BEACH, CAUFORNIA," AS AMENDED. The City Council of the City of Huntington Beach, California, do ordain as follows: Section 1: That Ordinance No. 425, as amended, be and the same is hereby amended by amending Sections 903 , 90511,9089 909, 996 and 997, and repealing Sections 966, 967, 968, 969, 970 and 971. Said amended sections to- read respec- tively as follows: .".Section 903. If there is on the published delin- quent list any tax-sold property which was sold to the City in the fifth preceding calendar year, or any year before that, a notice shall follow the description of the property substan- tially as follows: "To be deeded to the City of Huntington Beach, . . . . . . . . . . . . . .19. . . . See No. . . . . . . in' addenda to this list." Section 905. The published notice of deeding to the City of tax-sold property shall show: (a) A list of descriptions of the property. The assessments contained in this notice of deeding shall be numbered in ascending numerical order. . (b) That five or more years will have elapsed on . the date of the deed since the property was sold to the City. (c) The year of sale to the City and the fiscal -1- Ord. 585 . year for which the taxes were levied. (d) That the property will be deeded to the City unless sooner redeemed .or an installment plan of redemption is initiated. (e) The time at which the property will be deeded to the City. (f) That the amount for which the deed will be issued will be the amount of taxes, delinquent penalties, and costs for which it was sold to• the City. (g) The amount for which the property is to be deeded, opposite the description of the property. (h) That if the property is deeded to the City, the right of redemption. (i) The ,date of the notice. (j) The official who will furnish all information, concerning redemption. Section 908. After the first publication of the notice of the deed to the City of tax-sold property and not less than twenty-one nor more than twenty-eight days before the date of deeding, when tax-sold property is to be deeded, the collector shall send by registered mail to the last assessee at his last known address either a copy of the publication or a printed notice of sale. Section 909. The printed notice of the deed to the City shall specify: (a) That the property will be deeded to the City by the collector unless sooner redeemed or an installment plan of redemption is initiated. (b) The time the deed is to be issued. ord. 585 (c) The year of sale to the City and the assessee for that year. (d) The description of the particular property. (e) When redemption may be made. (f) The official who will furnish all information concerning redemption. Section 996. If the redemption of any tax-sold property is not completed, the collector shall forthwith execute a deed duly acknowledged or proved, conveying the property to the City. Section 997. In addition to the usual provisions of a deed conveying real property, the deed shall specify: (a) The date of sale to the City. (b) That the property was duly assessed for taxa- tion and the tax legally levied. (c) The year the property was assessed for taxation and the name of the assessee for that year. (d) That the property was sold to the City for nonpayment of delinquent taxes which were a lien on the real property. . ` (e) The amount for which the property was sold to the City unless there has been a partial cancellation of taxes or a redemption _from a portion thereof, in either of which events, the amount shall be the balance remaining. (f) That five or more years have elapsed since the sale to the City and no person has redeemed the property. (g) That the property is therefore conveyed to the City according to law. -3- Ord. 585 Section 2: The City Clerk shall certify to the passage of this ordinance and shall cause the same to be pub- lished by one insertion in the Huntington Beach News , a weekly newspaper printed, published and circulated in the City of Huntington Beach, and thereafter it shall be in force and effect.
