HomeMy WebLinkAboutOrdinance #612 Ord. 612 f j ORDINANCE NO. 612 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL ELECTION TO BE HELD IN THE CITY OF HUNTINGTON BEACH ON THE 14TH DAY OF SEPTEMBER, 1954, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY A PROPOSITION TO INCUR BONDED INDEBTEDNESS BY SAID CITY FOR A CERTAIN MUNICIPAL IMPROVEMENT. WHEREAS, the City Council of the City of Huntington Beach, California, did on the '2nd day of August, 1954, by a vote of more than two-thirds of the members of said City Council, adopt Resolution No. 120 , entitled "Resolution of r"1 the City Council of the City of Huntington Beach, California, determining that the public interest and necessity demand the acquisition and construction of a certain municipal improvement, and making findings relating thereto", which said resolution was duly signed and approved by the Mayor of said City and attested and certified by the City Clerk of said City; NOW, THEREFORE, the City Council of the City of z Huntington Beach, California, DOES ORDAIN as follows : Section 1. That a special election be held, and the same is hereby called to be held, in the City of Huntington Beach, California, on the 14th day of September, 1954, for the ,—, purpose of submitting to the qualified voters of said city a proposition of incurring indebtedness and issuing bonds of said city therefor, in the amount hereinafter set forth, and for the object and purpose set forth in said resolution and - hereinafter stated. Ord., 612 Section 2. That the object and purpose for which ` said indebtedness is to be incurred and bonds issued therefor is as follows: The acquisition and construction by the 'City of . Huntington Beach of a certain municipal improvement, to wit : aqueducts, water pipe lines and. other works for the 'trans- mission, of water, including the city' s share of aqueducts, water pipe lines and related works to be owned and used jointly with other public corporations or public agencies, and including the acquisition of all land, easements, pipe, pumps, machinery and other property necessary therefor. Section 3. That the estimated cost of the municipal described in Section 2 'hereof is the sum of eight improvement ht g r� hundred sixty thousand dollars ($860,000) and that the amount of the principal of the indebtedness to be incurred therefor is the sum of eight hundred sixty thousand dollars ($860,000) . That the maximum rate of interest to be paid on said indebtedness shall not exceed the maximum rate permitted by law, to wit, six per cent (6%) per annum, payable annually the first year and semiannually thereafter, the actual rate or rates cf interest on said bonds to be determined at the time of the ele or sales thereof. I That if the proposition for the incurring of bonded indebtedness so submitted receives the requisite number of fvotes, to wit, tow-thirds of the votes of the qualified electors voting on said proposition, bonds of said city, in not exceeding ` I I , 2. i Ord. 612 the principal amount stated in such proposition, shall be issued and sold for the object and purpose set forth' in said proposi- tion. Section 4. That the polls for said election shall be ' opened at seven o' clock, A.M. , of the day .of said election and shall remain open continuously from said time until seven o ' clock, P.M. , of the same day, when said polls shall be closed, except as provided in Section 5734 of the Elections Code of the State of Calif ornia. That on the ballots to be used at said special elec- tions, in addition to any other matters required by law, there shall be printed substantially the following : MARK CROSS (+) ON BALLOT ONLY WITH RUBBER STAMP; NEVER WITH PEN OR PENCIL. (ABSENTEE BALLOTS MAY BE MARKED WITH PEN' AND INK OR PENCIL. ) INSTRUCTIONS TO VOTERS To vote on any measure, stamp a cross (+) in the voting square after the word "YES',' or after the word "NO' . All marks, except the cross (+) are forbidden. All distinguishing marks or erasures are forbidden and make the ballot void. I 3. Ord 61 Section 5. A cross (+) placed in the voting square after the word. "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the question or proposi- tion. A cross (+) placed in the voting square after the word "NO" in the manner hereinbefore provided shall be counted against the adoption of the question or proposition. Section 6. That for the purpose of holding said special election there shall be and are hereby established five (5) consolidated voting precincts designated as herein- after stated. Each such consolidated voting precinct shall consist of regular election precincts in the City of Hunting- ton Beach (of the numbers hereinafter stated) established for i the holding of state and county elections, as said regular election precincts exist on the date of adoption of this or- dinance. That the polling places for the respective precincts shall be the places hereinafter designated; and that the per- sons hereinafter named, being competent and qualified electors and residents of said city and of their respective voting pre- cincts, are hereby appointed officers of election for their " respective voting precincts and they shall hold said election and make return thereof in the manner provided by law. Consolidated voting precinct "A" shall consist of regular election precincts Nos. 1 and 4. Polling Place : G. S. Bergey residence, 305 Eighth Street i f Inspector : Bessie E. That except as otherwise provided in this ordinance, the election called hereby shall be conducted T provided by law for other municipal elections in said city. Section 8. That the City Council of said city shall meet at its usual place of meeting in the City Hall on Monday, the 20th day of September, 1954 `at 0 0'clock 'P `.M. of said day, and proceed to canvass the election returns and declare the result of said election. Section 9. That the City Clerk shall certify to the passage and adoption of this ordinance by a vote of more than two-thirds of all of the members of the City Council of said city, and shall cause said ordinance to be published once a week for two successive weeks in the HUNTINGTON BEACH NEWS, a weekly newspaper of general circulation in said city. No other notice of such election need be given. Section 10. This ordinance shall take effect upon its passage. ADOPTED, SIGNED AND APPROVED this 16th day of -August � 1954.
