AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH,
CALIFORNIA, ADDING A NEW ARTICLE 946 TO T
HUMINGTON BEACH ORDINANCE CODE, ESTABLISHING
AN A-1 DISTRICT TO BE KNOWN AS THE "AGRICULTURAL
DISTRICT"; ADDING SECTIONS 9461, 9462, 9462.10,
9462.20, 9462.21, 9462.22, 9462.23, 9462.24,
9462-30, 9462.40, 9462.50, 9462.6o, 9462.70..

The City Council of the city of Huntington Beach, California, do
ordain as follows:
Section 1: That a new Article be and the same is hereby added to.
the Huntington Beach Ordinance Code, designated Article 946, . establish-
ing an A,-1 District to be Down as the Agricultural District.
Section 2: That new Sections 9461, 9462, 9462.10, 9462.20, 9462.21,
9462.22, 9462.23, 9462.24, 9462.20, 9462.4o, 9462,50, 9462.6o, 9462.70,
9462.go, 9462.90, 9463010, 9463.20, 9463.30, 9464, 9465010, 9465.11,
9465.12, 9465.13, 9465.14, 9465.15. 9465.16, 9466.00,, 9466.1o, 9466.2o,
9466.21, 9467.0 be and the- same are hereby added to the Huntington Beach
Ordinance Code to read as follows:
Section 9461 Agricultural District: Provisions Applicable. The

following provisions shall apply in the A►-1 District:
Section 9462 Uses Permitted: The following uses shall be permitted
in the Aml District:
Section 9462..20 Oil Operations. The drilling and operating for the
discovery or production of water or of oil, gas, hydrocarbons and/or
kindred substances in their natural states under the following conditions:

Section 9462.21, Conformity to Code. Such operations and construc-
tion shall be in conformity with the Huntington Beach Ordinance Code pro-
visions which are not in conflict with the provisions of this Article,
Section 2462.22 Mud Dumps, Sumps Prohibited. The uses permitted
under Section 9462.20 shall not be construed as permitting rotary mud
dumpa, sumps or disposal, petroleum refining or processing, nor storage
of oil or gas in tanks exceeding one thousand (1,000) barrel capacity,
not to exceed sixteen (16) feet in height.
Section 9462,23 Surface Operations: Distance from Highway. All
surface equipment, such as top of well, pumps, tanks and the like shall be
at least one hundred fifty (150) feet from the nearest portion of any pub-
lie road, street or State Highway, the provisions of Section 9293.6 not-
withstanding, and shall also be at least twenty-five (25) feet from any
lot- line which is not common with a public road, street or highway line.
Section 9462.24 Setbacks. In any case where.the setback, yard, or
space requirements of this Article would exclude the use permitted by.
Section 9462,20 because of the size or shape of.a lot, such use may be
located on the rear half of the lot and not less than twelve and one-half
(12 ) feet from the side and rear lot lines; provided, however, that prior
to the effective date of this Article: (1) a deed to such lot was of
record; (2) that the lot is assessed as a separate lot; and (3) that the
lot is held under separate ownership from adjoining lots.
Section 9462.30 R-1 Uses. All uses permitted in R-1 District,
provided that there shall be not more than one dwelling for each five (5)
acres of laud area in the lot or parcel.upon which the dwelling is located,
except as provided in Section 9206.
-Section 9462.40 Parking lots for automobiles.
Section 9462.50 Radio transmitter stations.

Section 9462.60 Transient Shows: Permission of Council. Circuses,
carnivals and animal shows of a temporary or transient type, provided con-
ditional permission is secured therefor from the Council. Such permission
may be granted without a hearing or public notice, and upon conditions con-
sidered necessary and appropriate by the Council for the protection of pub-
lie health, safety and general welfare.
Section 9462.70 Signs: Restrictions. Not more than one sign,
placard or other advertising or identification device may be erected,
painted on, or made a part of any premises, and such sign shall have an
area of not more than twelve (12) square feet and such sign shall relate
only to the sale or lease of the parcel upon which located or to such per-
missive use as may be located upon such parcel; except, however, that in
the case of oil -wells there may be one such sign for each active well. In
no case shall the signs permitted hereby be considered to include general
outdoor advertising signs commonly known as "bill boards".
Section 9462.80 Similar Uses. Uses which in the opinion of the
Planning Commission are similar to those mentioned as being permitted in
the A-1 District when such similar uses have been set forth in a resolution
of said Commission.
Section 9462.90 Other Uses. Uses eustoma i ly incident to any. of the>% ,
uses permitted.by this Article unless specifically prohibited thereby, or
unless permitted only, by Council permit,
Section 9463.10 Garbage, Sewage Disposal Prohibited. No provisioriV.`
of this Article shall be construed as permitting farms or plants for,the
disposal of garbage, sewage, or.offal, except by the City of Huntington
Beach as a governmental function or service.
Section 9463.20 Animal Husbandry: Permit Required. No provision of
of this Article shall be donstrued as permitting .animal husbandry, or the

raising or keeping of animals or fowls for any commercial purpose, unless
a permit has been secured from the Council authorizing such use and the
conditions upon which the specified land may be used for such purpose.
Section 9463.30 Produce Selling Stands Prohibited. No provision of
this Article shall be construed as permitting any building, structure or
stand of either a permanent or temporary character on any lot or parcel,
to facilitate the selling of produce or crops of any kind whether such
produce or crops were raised,on the parcel or not.
Section 91464 Buildings: Restrictions. No dwelling, apartment, or
accessory building shall exceed thirty (30) feet in height nor consist of
more than two stories, except as provided in Section 9203.
Section 9465.10 Building Site, Area, Space and Setback Requirements.
Supplementary to other such requirements of this Article:
Section 9465.11 Width. The minimum average width of any lot shall
be not less✓than three hundred (300) feet, except as provided in Section
92o6.
Section 9'465.12 Area. The minimum lot area for each single family
dwelling shall be five (5)' acres, except as provided in Section 9206.
Section 9'465.13 Multiple Dwellings. There may be more than one
single family dwelling or apartment on any lot having an area of ten (10)
acres or .over provided there is 'not less than five (5) acres of land area
1 in the parcel for each such dwelling or apartment; and in such case, if
one building is placed in the rear of the "other, no wall of one dwelling..
or apartment shall be closer than twenty-five (25) feet to the nearest
wall of the other, and if placed side by side,'no wall of one dwelling or

the other.
Section 9465.14 Main Buildings or Structures. Main buildings or
structures for permissive uses may be established provided they are located
not closer than twenty (20) feet to any public road, street or highway
line, except as provided in Section 9462.23.
Section 9465,15 Accessory Buildings. Accessories or detached
accessory buildings shall not be located closer than fifty (50) feet to
any public road, street, or highway line except as provided in Section
9462.23.
Section 9465.16 Accessory Buildings: Distance from Main Building.
Accessory buildings shall be at least six (6) feet from any main building.
Section 9466.00 Yards. The following yards shall be provided and
maintained in case of a dwelling or apartment, and where there is a
question as to which side or end of the lot is the front, side or rear
line of the lot the Building Inspector or his deputy is hereby authorized
to make the determination;. provided, however, that on lots having an area
of less than five acres the, narrowest side abutting a street shall be con-
sidered.the front lot line:
Section 9466.10 Front Yard: There shall be a front yard of not less
than twenty (20) feet.
Section 9466.20 Side Yard: There shall be an interior side yard of
i not less than five (5) feet, except as provided in Section 9294. "`The ex-
terior side yard, adjoining a road, street, or highway shall be twenty
(20) feet as provided in Section 9465.14, notwithstanding the provisions
of Article 929.
Section 9466.21 Rear Yard: There shall be a rear yard of not less
than twenty (20) feet, except as provided in Section 9297, and accessory

buildings may occupy not more than fifty (50) per cent of the area of
such rear yard.
Section 9467.0 Provisions of Article 929. The provisions of
Article 929 shall be considered as much a part of this Article as though
written herein, unless exception thereto has been made, and with the pro-
vision that no non-conforming building, structure or accessory shall be
1 used in determining any variation in any yard requirement in the A-1
District.
Section 3: The City Clerk shall certify to the passage and
adoption of this ordinance and shall cause the same to be published by
one insertion in the Huntington Beach, News, a weekly newspaper printed,
published and circulated in the City of Huntington Beach, California;
and thirty (30) days after the adoption thereof the same shall take effect
and be in force.
