ORDINANCE NO. 620
AN ORDINANCE OF THE CITY OF HMINGTON BEACH,
CALIFORNIA, RELATING TO THE DRILLING OF OIL
WELLS AND THE REGULATION THEREOF_; DECLARING
AN EMERGENCY TO EXIST; REPEALING SECTIONS 2423.3,
2444.4, 2444'.5; AMENDING SECTIONS 2421, 2421.1,
2421.2, 2421.4, 2422, 2422.1, 2443, 2444, 2444.1
and 2444.2. OF .THE HUNTINGTON BEACH ORDINANCE
CODE;, AND ADDING SECTIONS 2421.01, 2422.11, 2429
AND 2431.3 TO SAID CODE.
WHEREAS, new discoveries of oil have. recently been made within the
city limits of .the City of Huntington Beach in a residential area and
contiguous to the business district; and
WHEREAS, derricks, drilling, equipment, motors and heavy machinery
are now. located adjacent to or near dwellings; and
WHEREAS, it is necessary for the protection of the health, safety
and general welfare of the inhabitants of the City of Huntington Beach
to adopt regulations regarding the drilling of oil wells within said city
in order to more adequately protect the health, safety and welfaxe of its
inhabitants; and
WHEREAS, it is necessary that such regulations as set forth in
this ordinance be effective immediately:
NOW THEREFORE, in consideration of and by the above preamble and

statement, the City Council of the City of Huntington Beach declares and
defines that an emergency exists necessitating the following ordinance
for the immediate protection and preservation of the public health, prop-
erty, best interests, safety and convenience.
WHEHFFORE, the City Council of the City of Huntington Beach do
ordain as follows:

Section 1: That Sections 2423.3, 2444.4 and 2444.5 of the
Huntington Beach Ordinance Code be and the same are hereby repealed.
Section 2: That Section 2421 of the Huntington Beach Ordinance
Code be and the same is hereby amended to read as follows:
Section 2421 Temporary Derrick Specifications: Filing, Approval.
Specifications for all temporary oil well derricks to be erected shall be
_ filed with the Building Inspector and shall be subject to his approval.
Section 3: That Section 2421.1 of the Huntington Beach Ordinance
Code be and the same is hereby amended to read as follows:
Section 2421.1 Structural Material. Such temporary derricks shall
be constructed of steel, except that the derrick floors, pump house
floors, pipe racks, sills, postings and walkways mav be of wooden con-
struction.
Section 4: That Section. 2421.2 of the Huntington Beach Ordinance
Code be and the same is hereby amended to read as follows:
Section 2421.2 Owneris Sign. There shall be installed and main-
tained on each oil well, a sign on v&ich shall appear the name of the
well being drilled or operated, together with the name of the person,
firm or corporation drilling or operating the well.
Section 5: That Section 2421.4 of the Huntington Beach Ordinance
Code be and the same is hereby amended to,read as follows:
Section 2421.4 Location. The sign shall be located on the oil
well pumping unit so that it will be fully visible from two (2) opposite
sides .of the pumping unit.
Section 6: That Section 2422 of the Huntington Beach Ordinance Code
be and the same is hereby amended to read as follows:
Section 2422 Application to Drill: Application Fee. No person
shall drill, redrill, deepen, recondition or repair any well, or erect

or rebuild. any derrick, the provisions of any ordinance to the contrary
notwithstanding, unless he first make written application to the City
Engineer, who shall examine and investigate the same and place his endorse-
ment thereon. The City Engineer shall not accept or consider any applica-
tion for drilling unless accompanied by an application fee of One Hundred
Dollars ($100.00), no part of which fee shall be refunded.
Section 7: That Section 2422.1 of the Huntington Beach Ordinance
Code be and the same is hereby amended to read as follows:
Section 2422.1 Issuance of Permits. The City Engineer shall approve
all applications which comply with the provisions of the Huntington Beach
Ordinance Code relating to applications for drilling for oil. Upon the
approval of such application and the payment of the required business
license fee to the City Clerk, the City Engineer shall issue said permit.
Section 8: That Section 2443 of the Huntington Beach Ordinance
Code be and the same is hereby amended to read as follows:
Section 2443 Temporary' Sumps: Fencing. Temporary sumps may be
constructed and used during the period of drilling an oil well for the
normal purpose of mud useage or storage; provided, however, that said
sump shall at all times be maintained and fenced in accordance with the
safety standards and regulations of Section 24400 of the Health and Safety Code.
Section 9. That Section 2444 of the Huntington Beach Ordinance Code
be and the same is hereby amended to read as follows:
Section 2444 Application to Drill, Redrill, Etc. No person, firm
partnership or corporation shall drill, redrill, whipstock, sidetrack or
deepen more than 300 feet or otherwise recondition any well where new hole
is made, unless he first make written application as provided in Sections
2422, 2422.1 and 2422.11.
Section 10: That Section 2444.1 of the Huntington Beach Ordinance

Code be and the same is hereby amended to read as follows:
Section 2444.1. Form of Application: Cleanup and Repair Bond, Said
application shall.be upon such form as may.be prescribed by the City
Engineer.,and shall..be accompanied by a bond sufficient in form to the
property owners and to the City of Huntington Beach-that any sump or
reservoir, mud or drilling. residue,. loose lumber, cables, unused machinery
and debris will_be.removed from said premises and from the streets., alleys,
sidewalks, curbs and gutters adjoining. said .premises and that any and all
damage done to streets, alleys, sidewalks, curbs and gutters adjoining said
premises will.be. repaired within sixty (60) days after completion of said
well.
Section 11: That Section 2444.2 of the Huntington Beach Ordinance
Code be and the same is hereby amended to read as follows:
Section 2444.2 Form of Bond: Amount. Said bond shall inure to
the owners of the property upon which said well is drilled and to the
City of Huntington Beach, and shall be in. the penal sum of $2,000,00.
Section 12: That new Sections 2421,01, 2422,11, 2428 and 2431,3
be and the same are. hereby added to the Huntington Beach Ordinance Code,
the same to read as follows:
Section.2421.01. Permanent Derricks Prohibited. The construction
or erection of permanent derricks within the City of Huntington Beach is

hereby prohibited.
Section 2422.11. Hearing by Council. In the event the City Engineer
shall refuse to approve the application, then the applicant shall have the
right to appeal to the City Council. Such appeal to the Council shall be
made. by the applicant in writing, setting_ forth. his reasons. for requesting
relief, and shall be presented within thirty (30.) days after rejection of
the application by the City Engineer. The Council shall hear the appeal

and either approve-.or reject the application.
Section 2428 Hours..for Loadina..and Unloading..Drilling Equipment.
The loading, unloading.. or re-locating of drilling...equipment, including
tanks, drill..pipe, casing, tubing,: rods, and other heavy equipment .
pertinent to the.drilling of a well, .shall not be. conducted during the
hours from 6:00 P.M. to 6:00 A.M. in the. areas zoned R-1-0, R-2-09 R-3-09
R-4-0 and C-3-0, except during period of-emergency.
Section.2431.3 Blowout .Eguipment. _Any drilling.well .or other well
during servicing. operations such. as perforating, shooting or. cutting off
a string. of. casing on a. well that is- known to have enough gas pressure to
flow, or where the gas. pressure. is unknown, blowout prevention equipment
shall be installed. . Blowout prevention equipment shall be constructed and
installed pursuant to. the,standards. of .the "General ,Petroleum..Safety Orders
for Drilling. and Production" of the State .of. California, Article. 55, Sec.
6691i-6692.
Section 13s SEVERABILITY. If.ar{y provision of this. ordinance or
the application thereof to.any person or; circumstance. is held Invalid,
such. invalidity shall.not affect other provisions or. applications of� the
ordinance whieh .ean be given effect without the invalid. provisions or
application, and to this-end the provisions of this ordinance are declared
to be severable.
Section 14: This .ordinance, .being an emergency measure for the
immediate preservation of the public peace, property, health and
safety, which emergency is set forth .and defined .in the preamble hereto,
shall.take effect and be in force from and-.after the.passage and adoption
hereof.
Section 15: That the City Clerk shall. certify to the passage and
adoption of this-ordinance and shall cause the same. to be. published by

one insertion in-the Huntington Beach News, a weekly newspaper., printed
published and circulated in the City-of-Huntington Beach, .California;
