HomeMy WebLinkAboutOrdinance #624 1 NOT ADOPTED - (Did not have 2nd Reading ) ORDINANCE NO. 624 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH , CALIFORNIA, RELATING TO THE DRILLING OF OIL WELLS , THE REGULATION THEREOF AND THE STORING OF OIL: DECLARING AN EMERGENCY TO EXIST: AMENDING SECTIONS 2423' AND 2421; AND ADDING SECTIONS' 2422. 21, 2429, 2429.1) 2429.29 2429.51 2429.51, 2429.6, 2429.61, 2429.62) 2429.63 ) 2429.64, 1 242965, 2429.66) 2429m67, 2429.68) 2429:69, 2429, 70, 2429.719 2429.72, 2429.73 ; AND 2429.74 TO SAID CODE WHEREAS , new discoveries of oil have recently been made with- in the city limits of the City of Huntington Beach in a residential area and contiguous to the business district ; and WHEREAS, derricks, drilling, equipment, motors and heavy mach- inery and oil storage tanks are now located adjacent to or near dwellings; and WHEREAS, it is necessary for the protection of the health, safety and general welfare of the inhabitants of the City of Hunt- ington Beach to adopt regulations regarding the drilling of oil wells and storage of oil within said city in order to more ade- quately protect the health, safety and welfare of its inhabitants: and WHEREAS , it is necessary that such regulations as set forth 1 in this ordinance be effective immediately: NOW THEREFORE , in consideration of and by the above preamble and statement, the City Council of the City of Huntington Beach declares and defines that an emergency exists necessitating the following ordinance for the immediate protection and preservation ti`v Ord. No. 624 of the public health, property; best interests, safety and con- venience. The City Council of the City of Huntington Beach, California, do , ordain as follows: Section 1: That Section 2423 of the Huntington Beach Ordi- nance Code be , and the same' is hereby amended to read as follows: a Section 2423. Location of the Well. -No person shall drill any oil or gas well or well hole the center of which hole , at the surface of the ground is: Section 2: That Section 2421 of the Huntington Beach Ordi- nance Code be , and the same is hereby amended to read as follows: Section 2421. Temporary Derrick and Portable Mast: Speci- fications. Specifications for all temporary oil well derricks to be erected shall be filed with the Building Inspector and shall be subject to his approval. All derricks used for the drilling of oil wells, redrilling of oil wells and for servicing of oil wells shall conform to API standards as set forth in API Manual, 4A-14th edi- tion for steel derricks or API Tentative Code Standard #4-D, 1953 edition for Portable Masts. Section 3: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code ,, designated Section 2422.21, to read-!-as follows: Section 21422-.21. Contents of said Map. Said plat or map shall also. show the ties to the center of the proposed well hole together with the proposed location of the pumping unit , the tanks and the safety wall. All buildings and structures within 75 feet -2- Ord. No. 624 of the exterior boundaries of .the lease shall be shown and indicated. Section 4: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code, designated Section 2429. Section 2429. Fencing Producing Wells. All oil and/or gas wells heretofore and hereafter placed on production shall be en- closed by a chain link fence , or its approved equal, said fence being at least six feet in height with at least three strands of barbed wire above said fence. Said fence or enclosure shall sur- round the well head, pumping unit or other moving parts of the well and the production machinery and equipment . The closest part of the fence shall be not less than 2'6"" distance from the pump, well head, pumping. uhit and/or any other moving part. All fences shall have upright posts of 'not less than 2" diameter tubing and shall have horizontal top and bottom rails securely fastened to . said posts with said fence also securely fastened to said posts and rails. Said rails and posts shall be constructed of- steel tubing or rods of sufficient strength that will not bend with normal use. All gates of said fence or enclosures shall be securely locked at all times when not actually being used by authorized personnel. Section 5: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code , designated Section 2429.1. Section -2429.1. Fences Heretofore Established: Substantial Compliance. All wells placed on production.'prior to the effective date of this ordinance shall within 90 days be enclosed with a fence as provided in Section 2429. -3- i Ord. No. 624 ► Section' 6: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code , designated as Sec- tion 2429.2. Section 2429.2. Special Permit : Substantial ' Compliance. Any owner or operator of a well placed on production prior to the effective date of this ordinance who had previously enclosed such well with a fence not complying with the requirements of Section 2429, may .make written application to the City Council for a waiver of the provisions of Section 2429. The City Council may, after hearing and by, a , 4/5ths vote , waive the provisions of Section 2429, if compliance therewith would work an undue hardship on the owner or operator of such well and the fence previously constructed by said operator substantially complies with requirements of said Section 2429. Section 7: That a new section be and the same is hereby added to ' the Huntington Beach Ordinance Code , designated as. Section 2429. 5. Section 2h29.5. Safety Valls: Map. Within ten days after a well has been placed on production, the owner or operator thereof shall file with the City Engineer and with the Fire Chief a map or Plat showing 'the actual location of the well, all structures within a distance of 100 feet of the center of such well, the location of the proposed safety wall, the details of construction of such safety wall and the calculations showing the required and proposed area and capacity of such safety wall® Section 8: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code , designated as Section 2429. 5' -4- Ord; No: 624 1 Section 2429.51 . Safety Walls: Construction. All safety walls hereafter constructed shall- be of approved type of rein- forced concrete or reinforced concrete block construction and shall be capable of,retaining oil, petroleum products and/or water for a period of 24 hours without leaking under or through said safety wall. 1 Section 9: That a new section be and the same is hereby add- ed to the Huntington Beach Ordinance Code , designated as Section 2429.6. Section 2429.6 Oil Storage Tanks. All tanks for the storage of oil within the City of Huntington Beach shall conform to the following specifications and be placed in the following location with respect to other structures and property: Section 10: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code , designated as Sec- tion 2429.61. Section 2429.61. Location of Tank. No tanks shall be placed within 25 feet of any open flame or other -source of ignition. Section 11: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code , designated as Sec- tion 2429.620 . Section 2429.62. API Specifications. All tanks shall conform to API specifications. Section 12: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code , designated as Section 2429.63. -5- Ord. No. 624 1 S,'ection 2429.6 . Location of 300 barrel Tanks or Less. Tanks from 100 to 301 barrels shall not be closer than 4 feet to the ex- terior boundary line of the lease , nor closer than 8 feet to any building, nor closer than 15 feet to the center of any well hole , nor closer than 3 feet to the inside of any safety wall surrounding said tank. 1 Section 13. That a new section be and the same is hereby added to the Huntington Beach Ordinance Code , designated as Section 2429.64. Section 2429.64. Location of �E)I to .520 barrel tanks. Tanks from 301' barrels to 520 barrels shall not be closer than 4 feet to the exterior boundaries of the lease nor closer than ten feet to any building, nor closer than 15 feet to the center of any well hole , .nor closer than 3- feet to the inside of any safety wall sur- rounding said tank. Section 14. That a new section be and the same is 'hereby added to the Huntington Beach Ordinance' Code , designated as Sec- tion* 2429.65• Section 2429.65. Location of tanks over 521 barrels. Tanks of 521 barrels to 1025 barrels shall not be closer than 10 feet to E the exterior boundary lines of the lease , nor closer than 15 feet to any building, nor closer than 25 feet to any well hole , nor closer than- 5 feet to the inside of any safety wall surrounding said tank. s Section 15. That a new section be and the same is hereby added to the Huntington Beach Ordinance Code , designated as Sec- tion 2429.66. -6- Ord. No. 624 Section 2429.�66.• Tank Set Back Requirements., All tanks referred to. in Sections 2429.63 , 2429.64 and 2429.65 shall have the same set back from front property lines as set forth for bwad- ini in existing zoning requirements. Section 16. That a new section be and the same is hereby added to the Huntington Beach Ordinance Code , designated as Sec- tion 2429.67. Section .2429.67. Tanks: Measurements. All measurements of tanks referred to in Sections 2429.63 , 2429.64 and 2429.65 are taken from the shell ,of the tank. Section 17. That a new section be and the same is hereby added to the Huntington Beach Ordinance Code , designated as Sec- tion 2429.68, ..Section 2429.68. Tanks: Vent. Every tank which contains a vapor space shall be provided with vents to conform to API standards for low pressure above ground storage tanks. Section 18. That a new section be and the same is hereby added to the Huntington Beach Ordinance Code , designated as Sec- tion 2429.69. Section 2429.69 . Tanks: Hei t, Tanks for shipping or stor- ing of oil shall not exceed 1611" in height and wash tanks shall not exceed 24' in height. Section 20. That a new section be and the same is hereby add- ed to the Huntington Beach Ordinance Code, designated as Section 2429.71. Section 2429.71. ' Safety Walls: Capacity Requirements. The capacity requirements of safety walls around production tanks shall 41 -7- Ord. No., 624 1 be as follows: 1QO% capacity of the largest tank,, plus 1011'o' capacity of the next tank which shall .be of the largest if more than two tanks are inside of said safety wall plus fifty percent of any additional storage retained within said safety wall. Section 21. That a new section be and the same is hereby ' added to the Huntington Beach Ordinance Code , designated as Section 2429.72. Section 2429..72., Tanks: Painting. All tanks and production equipment shall be 'maintained in a neat , clean and orderly fashion and shall ;at all times be kept .painted. Section 22. That a new section be and the same is hereby added to the Huntington Beach Ordinance Code , designated as Section 2429.73 . Section 2429.73. Heaters. All heaters used for production, cleaning or heating oil in the tank for shipping purposes, or for any other use , shall be the hot water type heater and be of speci- fications approved by the American Gas Association. Section 23. That a new section be and the same is hereby added to the Huntington Beach Ordinance Code , designated as Section 2429.74. Soction-2429.74. Heater Location. - No part of the heater shall be closer than 25 feet to any tank or to the center of the well hole or closer than 15 feet to any house or any other type of structure , providing, however, that if the heater is closer to a house or building, the heater shall have a vent extending 24" higher than the edge of the roof of said house or building -8- Ord. No. 624 1 adjacent to said heater. Section 24. SEVERABILITY. If any provision of this ordi- nance or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provi- sions or applications of the ordinance which can be given effect without the invalid provisions or application, and to this end the provisions of this ordinance are declared to be severable. Section 25. This ordinance , bei ngt an emergency measure for the immediate preservation of the public peace ; property, health and safety, which emergency is set forth and defined in the pre- amble hereto , shall take effect and be in force from and after the passage and adoption hereof. Section, 26. That the City Clerk shall certify to the passage and adoption of\this• ordinance and shall cause the same to be Published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and circulated in the City of Hunt- ington Beach, California.
