HomeMy WebLinkAboutOrdinance #626 ORDINANCE N0. 626 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA) RELATING TO THE DRILLING OF OIL WELLS, THE REGULATION THEREOF AND THE STORING OF OIL:DECLARING AN EMERGENCY TO EXIST: AMENDING SECTIONS 2423 and 2421; AND ADDING SECTIONS 2422.219 2429, 2429.17 2429.27 2429.31 2429.59 2429.51, 2429.67 2429.61 2429.621 2429.639 21+29.641 2429.65, 2429.6�, 2429.6772429.689 2429.69, 2429.707 2429.-71, 24-29.72,2429.737 AND 2429.74 TO SAID CODE. WHEREAS, new discoveries of oil have -recently been made within the city limits of the City of Huntington Beach in a residential area and contiguous to the busi- ness district; and WHEREAS, derricks, equipment.,' motors and heavy machin- ery and oil storage tanks are now located adjacent to or near dwellings; and WHEREAS, it is necessary for the protection of the health, safety and general welfare of the inhabitants of the City of Huntington Beach' to adopt regulations regarding the ditilling of oil wells and storage of oil within said city in order to more adequately protect the health, safety* 1 and welfare of its inhabitants; and WHEREAS, it is necessary that such regulations as set forth in this ordinance be effective immediately: N0W THEREFORE, in consideration of and by the above preamble and statement, the City Council of the City of Huntington Beach declares and defines that an emergency exists necessitating theif ollowing ordinance for the im-, 1. Ord.#626 mediate protection and preservation of the public health, property, best interests , safety and convenience. The City Council of the City of Huntington Beach, California, do ordain as follows: Section 1: That Section 21+23 of the Huntington Beach Ordinance Code be, and the same is hereby amended to read as follows: Section 21+21. Location of the Well. No person shall drill any oil or gas well or well hole the center of which hole, at the surface of the ground is: Section 2: That Section 2421 of the Huntington Beach Ordinance Code be, and the same is hereby amended to read as follows: Section 2421. Temporary derrick and Portable Mast: Specifications. All derricks used for the drilling of oil wells, redrilling of oil wells and for servicing of oil wells shall conform to API standards as set forth in API Manual, 4A-14th edition for steel derricks or API Tentative Code Standard #4-D, 1953 edition for Portable Masts, or any sub- sequent revisions thereof. Section 3: That a new section be and the same is here- by added to the Huntington Beach Ordi.nance 'Code, designated Section 2422.21, to read as follows: Section 2422.21. Contents of said Map. With respect to any well located in the portion of this City described in Section 2429, said plat or map shrill also show the ties to the center of the proposed well hole together with the proposed location of. the tanks and, if required elsewhere in this Code, the safety wall, the details of construction of such safety wall and the calculations showing the re- 2. Ord.#626 quired and proposed area and capacity of any such safety wall. All buildings and structures within 75 feet of the exterior boundaries of the lease shall be shown and indi- cated. Section 4: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code, desig- nated Section 21+29. Section 21+29. Guarding Producing Wells - Residential and Business Area. No person owning, having possession of or in control of any producing oil well within the follow- ing described portion of the city: R-2, All R-1, R-1-0,/R-2-0 R 3 -3_;?0 R-41 R-4-01 R-S-O, M-1-0,/district- ing zones within the City of Hunt- ington Beach excepting that por- tion of said mentioned zones lying th westerly of 17/Street and east- erly of Hampshire Avenue. f 3. Ord.#626 ti shall maintain, or allow to exist thereon, any moving parts in use at such oil well unless and until such moving parts are securely enclosed by an adequate ventilated type fence of approved gauge wire screen or housing sufficient to prevent the entry of small children to such moving parts. If any fence or screen is erected pursuant hereto it shall be of metal construction, shall benbt less than 6 feet in height, and if equipped with gates, such gates shall be securely fast- ened at all times , except when authorized personnel are in attendance at such well. A single fence, screen or housing may be used to enclose more than one oil well. Section 5: That a new section be and the same is here- by added to the Huntington Beach Ordinance Code, designated Section 2429.1. Section 2429,1, Guarding Producing Wells - Outside of Residential and Business Area. All persons owning, having possession of, or in control of any producing oil well within that portion of this city not described in Section 2429, shall, as a minimum, comply with the pertinent safeguarding provisions contained in the "General Safety Orders" and "Petroleum Safety Orders - Drilling and Produc- tion" both of the Division of Industrial Safety, State of California. Ord.#626 Section 6: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code, designated as Section 21+29.2. Section 21+29.2. Time for Compliance - Extension. All oil wells placed on production prior to the effective date of this ordinance shall be guarded, as provided in Sections 2429 and 2429.1, within 90 days from such effective date. Provided, however, that upon application in writing by the owner or oper- ator of any oil well to the City Engineer, the City Engineer, may if there is good cause therefor, grant an additional period of time for such owner or operator to comply with Sec- tions 2429 or 2429.1. If the City Engineer shall deny any such application for additional time, the owner or operator, within three days from the time of such denial may file a written appeal from such decision of the City Engineer to the City Council. The City Council shall consider such appeal at its next succeeding regular meeting and rgay grant or deny such appeal by majority vote. The period of time beginning on the date said application is filed with the City Engineer and end- ing on the date the City Engineer or City Council makes final decision thereon shall be excluded from the 90-day period re- ferred to hereinabove. Section 7: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code, designated as Section 2429.3. Section 2429.3,. Special Permit: Substantial Compliance . Any owner or operator of a well placed on production prior to the effective date of this ordinance who had previously en- " closed the moving parts of such well with a fence , screen or i'.housing not complying with the requirements of Section 2429 Ord.#626 or 2429.1, may make written application to the City Council for a waiver of the provisions of Section 2429 or 2429.1. The City Council may, after hearing waive the provisions of Section 2429 or 2429.1, if compliance therewith would work an undue hardship on the owner or operator of such well and the fence, screen or housing previously constructed by said Operator substantially complies with requirements of said Section 2429 or 2429.1. Section 8: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code, designated as Section 2429. 51. Section 2429. 51. Safety Falls: Construction: All safety walls hereafter constructed shall be solid and leak- and design proof and constructed of an approved type/of concrete , mason- ry, or earth in, through or underneath which there shall be no openings except for pipe . If constructed of earth, said safety wall shall be constructed of good earth, free from substances which impair the strength thereof and shall be well packed and coated with crude oil or asphalt on all surfaces. All such earth safety walls shall have a flat-top not less than 3 feet wide and a slope of not less than one and one-half feet horizontal to one foot vertic, 1 . Section 9: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code, designated as Section 2429.6. Section 2429.6. Oil Storage Tanks. All tanks for the storage of oil within the City of Huntington Beach shall con- form to the following specifications and be placed in the fol- lowing location with respect to other structures and property. 6. Ord.#626 Section 10: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code, designated as Section 2429.61. Section 2429.61. Location of Tank. No tanks shall be placed within 25 feet of any open flame or other source of ignition. Section 11: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code, designated as Section 2429.62. -Section 21+29.62. API Specifications. All tanks shall conform to API specifications. Section 12: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code , designated as Section 2429.63. Section 2429.63. Location of 300 barrel Tanks or Less. Tanks from 100 to 301 barrels shall not be closer than 4 feet to the exterior boundary line of the lease , nor closer than 8 feet to any building, nor closer than 15 feet to the center of any well hole , nor closer than 3 feet to the inside of any safety wall surrounding said tank. Section 13: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code, designated as Section 2429.64. Section 2429,64. Location of 301 to 520 barrel tanks. Tanks from 301 barrels to 520 barrels shall not be closer than 4 feet to the exterior boundaries of the lease nor closer than ten feet to any building, nor closer than 15 feet to the center of any well hole, nor closer than 3 feet to the inside of any safety wall surrounding said tank. Section 14: That a new section be and the same is hereby Ord.#626 7— added to the Huntington Beach Ordinance Code, designated as Section 2429.65. Section 2429.65. Location of tanks over 521 barrels. Tanks of in excess of 521 barrels shall not be closer than 10 feet to the exterior boundary lines of the lease , nor closer than 15 feet to any building, nor closer than 25 feet to any well hole, nor closer than 5 feet to the inside of any safety wall surrounding said tank. Section 15: That a new section be and the same is hereby added to the Huntington Beach Ordinance C6de, designated as Section 2429.66. Section 2429.66. Tank Set Back Requirements. All tanks referred to in Sections 2429.63, 2429.64 and 2429.65 shall have the same set back from front property lines as set forth for buildings in existing zoning requirements. Section 16: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code , designated as Section 2429.67. Section 2429.6,Z. Tanks: Measurements. All measurements of tanks referred to in Sections 2429.63, 2429.64 and 2429.65 are taken from the shell of the tank. Section 17: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code, designated as Section 2429.68. Section 2429.68. Tanks: Vent. Every tank which contains a' vapor space shall be provided with vents to conform to API standards for low pressure above ground storage tanks. Section 18: That a new section be and the same is hereby. added to the Huntington Beach Ordinance Code , designated as 8.. r Ord.##626 Section 2429.69. Section 242969. Tanks. Height. Tanks for shipping or storing of oil shall not exceed 24' in height , as measured from the ground to the top of the shell. Section 20: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code , designated as Section 2429.71. Section 2 29.71. Safes Walls: Capacit Requirements. The capacity requirements of safety walls around production tanks shall be as follows: 100% capacity of the largest tank, plus 10% capacity of a second tank if more than one tank is inside of said safety wall, plus 50% capacity of all addition- al tanks. Section 21: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code , designated as Section 2429.72. Section 2 9.72. Tanks. Painting. All tanks and produc- tion equipment shall be maintained in a neat , clean and orderly fashion and shall at all times be kept painted. Section 22: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code , designated as Section 2429.73. Section 2429.73 . Heaters. Within that portion of this city described in Section 2429 all heaters used for production, cleaning or heating oil in the tank for shipping purposes, or for any other use , shall be the hot water type heater and be of specifications approved by the American Gas Association, or 9 . Ord.#626 with the approval of the Fire Chief may be the direct fired type heater. Section 23: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code, designated as Section 21+29.71+. Section 21+29.7 Heater Location. No part of the heater shall be closer than 25 feet to any tank or to the center of the well hole or closer than 15 feet to any house or any other type of structure , providing, however, that if the heater is closer to a house or building, the heater shall have a vent ex- tending 21+" higher than the edge of the roof of said house or building adjacent to said heater. Section 24: SEVERABILITY. If any provision of this ordinance or the application thereof to any person or circum- stance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provisions or application, and to this end the provision of this ordinance are declared to be severable. Section 25: This ordinance , being an emergency measure for the immediate preservation of the public peace, property, health and safety, which emergency is set forth and defined in the preamble hereto, shall take effect and be in force from and after the passage and adoption here+bf. } Section 26: That the City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same ---- to be published by one insertion in the Huntington Beach News a weekly newspaper, printed, published and circulated in the City of Huntington Beach, California. 10 Ord.#626 PASSED AIM ADOPTED by the City Council of the City of Huntington Beach, California, this 311tday of May 1955.
