HomeMy WebLinkAboutOrdinance #633 1 yf ORDINANCE No. 633 AN ORDINANCE OF THE CITY OF HUN_TINGTON BEACH RELATING TO SAFETY WALLS AND -PULL - ING UNITS and -ADDING SECTIONS 242�,412431.4 2431.11� 2431.51 2431. 51; 2431. 529 2431. 53, 2431: 547 2431. 541 and 2431. 55�/ The City Council of the City of Huntington Beach, Cal- ifornia do ordain as follows: Section 1: That new sections be and they are hereby added to the Huntington Beach Ordinance Code, designated Sections 2431.49 2431.111 2431.51 2431. 51, 2431. 521 2431.537 2431.54, 2431. 541 and 2431. 55 to read as follows: Section 2429.4. Safety Walls Required: Within sixty days after the effective date of this ordinance, all persons, firms or corporations owning, operating or having control of storage tanks used in the production of oil within the fol- lowing described portion of the City; all R-1, R-1-01 R-21 R-2-01 R-31 A-3-O, R-41 R-4-01 R-5-0; M-1--Oq C-3, C-3-0 dis- tricting zones within the City of Huntington Beach, except- ing that portion of:;said mentioned zones lying westerly of Seventeenth Street and easterly of Hampshire Avenue, shall 1 construct and maintain safety walls around said tanks as in this code hereinafter provided. Section 2431.4. Well Head Equipment: All well head production equipment used in production operations shall be ed installed and mp.�ntald/according to API specifications with the flanges thereon fully bolted at all times to prevent .the leaking of gas, oil or other hydrocarbons. ' Section 21+311,11. Cellars: All cellars shall be covered j . 'I ORD. No. 633 at all times that the well . is not attended by authorized per- sonnel and shall at all times be kept clean of oil, water, sludge or debris. Section 2431. 5. Pulling a Well - Hours when Prohibited: It shall be unlawful to do any work in pulling a well between the hours of 9:00 P.M. and 6:00 A.M. within 200 feet of any residence, dwelling within the City of Huntington Beach ex- cept when circulation in the well is necessary to be maintain- ed and in cases of emergency where a safety hazard would exist if the pulling work were not done immediately. Section 2431. 51. Pulling Masts: All pulling masts shall be in conformity with API ,standards, or its equal, and shall be properly guyed or braced at all times that the mast is in a raised position. Section 2431,52. Pulling Masts - Removal: All pulling masts shall be removed from the lease or the property within seven days after completion of servicing operations. During that time that such mast is not in operation in servicing the well, there shall be an adult in attendance 24 hours a day. Section 2431,53. Pulling Line Stripped: All pulling or bailing wire line shall be adequately stripped and other pre- cautions taken to prevent fluid from being carried on the line over the block to prevent spraying adjacent houses, streets, sidewalks, buildings, etc. Section 2431,54. Servicing Equipment; Sidewalks; Per- mits: No person, firm or corporation servicing a well shall extend equipment over property lines, sidewalks, parkways , alleys or streets until permission -therefor has been granted i by the City Engineer. No. 633 of persons and property shall be required by the City Engi- neer before issuing such permit and such permit shall not be issued unless temporary sidewalk:; enclosures sufficient to protect pedestrians are maintained by the applicant ser- vicing company. Said temporary sidewalk enclosures shall be so maintained until the servicing equipment shall be removed from the lease or premises. Section 2431. 541. Permits; Appeal from City Engineer' s Requirements: In the event that any well servicing company, firm, person or, corporation feels that an undue hardship ex- ` ists by reason of the requirements of the City Engineer for the issuance of such permit, such servicing company, firm, person or corporation may, within five (-j) days, file written application to the City Council of the City of Huntington Beach for a change or modification of such requirements as specified in their written request and the City Council shall, at its next meeting, hear such request and grant or deny the same, or may modify, or in any manner change the requirements of the City Engineer so long as the safety of persons and property shall be maintained and protected. Section 2431. 5 Cleanup after Service Operations: Im- mediately upon completion of servicing operations of an' oil well, the owner, operator or manager of the servicing company shall notify the City Engineer and such owner, operator or manager, or his employees, shall immediately remove all oily rags, waste material and debris placed upon such lease or property by the servicing company in its operations thereon and shall further repair any and all damages done to sidewalks, .alleys, parkways and streets and shall remove all oil and Ord. No. 633 debris which may have collected thereon by reason of the oper- ations of such pulling unit. Section 2: The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper printed, published and circulated in the City of Huntington Beach, Orange County, California; and thirty (30) days after the adoption hereof the same shall take effect and be in force.
