HomeMy WebLinkAboutOrdinance #641 I1 r I ORDINANCE N0. 641 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH RELATING TO THE VACCINATION OF DOGS• DECLAR- ING AN EMERGENCY TO EXIST:ADDING SE6TIONS 4400.11 4411.11 4414.1 and 4414.2 AND AMENDING SECTION 4414 OF THE' HUNTINGTON BEACH ORDINANCE CODE. WHEREAS, a .large part of the County of Orange has been quarantined bg..the State Department of Health because of the positive cases of rabies infection within the past few weeks within said county. There have been many positive cases of rabies infection and other clinical indications of other rabies infections, together with considerable evi- dence of widespread rabies infection among the wild animals of Orange County, and WHEREAS, it is necessary for the protection of the health and safety of the inhabitants of the City of Hunt- ington Beach to adopt regulations for the inoculation of dogs within said city:. NOW THEREFORE, in consideration of and by the above preamble and statement, the City Council of the City of Huntington Beach declares and defines that an emergency ex- ists necessitating the following ordinance for the immed- iate protection and preservation of the public health and safety. The City Council of the City of Huntington Beach do ordain as follows: 1. Ord. No. 641 Section 1: That a new section be and the same is hereby added to the Huntington Beach Ordinance Code, designated Section 4400.1. Section 4400.1. Vaccination. Vaccination shall mean the inoculation of a dog with.i.canine rabies vaccine approved by the Orange County Meat and Livestock Inspector of the County of Orange. Section 2: That a new section be and the same is here- by added to the Huntington Beach Ordinance Code, designated Section 4411.1. Section 4411.1. Possession of Unvaccinated Dog Pro- hibited. No person shall keep, harbor or maintain upon his premises, . or have title to, any dog over six (6) months of age in the City of Huntington Beach after the 6th day of February, 1956, which has not been vaccinated, except as otherwise provided in this Chapter. Section 3, That Section 4414 of the Huntington Beach Ordinance Code be and the same is hereby amended to read as follows: Section 4414. Sale of Tags: Exemption. Except as in this Article otherwise provided said Tax and Licence Coll- ector shall furnish tags to the owner or persons having charge, care or control, thereof, applying therefor prior to August 1st of the year for which such tag is issued or with- in four ()+) calendar months of the time when the dog for which application is made was acquired by the applicant, for the sum of $2. 50 for each male dog and for each spayed female dog, and the sum of $3.50 for each female dog. 2. Ord. No. 641 I Section 4. That a new section be and the same is hereby added to the Huntington Beach Ordinance Code, designated Section 4414.1 Section 4414.1. Vaccination Required Before Licens- ing: Exemptions. Neither the said Tax and License Collector nor any other person shall issue any license for any dog over the age of six (6) months, after the 6th day of February, 1956, unless and until such dog has been vaccinated as defined in this Chapter and the owner or person seeking such license shall produce for in- spection, a certificate from a licensed veterinarian show- ing said dog to have been vaccinated within the preceding twelve (12) months, which certificate such issuing officer may accept as proof of vaccination; provided, however, that any dog may be exempt from vaccination and a license may be issued therefor without proof of vaccination upon the presentation of an Affidavit sworn to within sixty (60) days preceding the application for license, by a veterinar- ian licensed by the State of California to practice and ac- tually practicing as a veterinarian in said State,stating that in his opinion the rabies vaccination would be likely to seriously injure the dog described therein; and provid- ed further, that no person shall allow any dog so exempt from rabies vaccination at any time, to run at large and such dog must be restricted to the securely inclosed yard of the owner except when held upon a substantial chain, leash, or rope. Section 5. That a new section be and the same is here- i I 3. Ord. No. 641 by added to the Huntington Beach Ordinance Code, designated Section 4414.2. Section 4414.2. Vaccination for Imported Dogs. Any person who imports or brings into the City any dog shall, within five ( 5) days after its arrival within said City, cause the same to be vaccinated and licensed as herein pro- vided for and any person who imports, harbors, keeps or maintains any such imported dog without complying with the requirements of this Section shall be deemed guilty of a misdemeanor Section 6. This ordinance being an emergency measure for the immediate preservation of the public health and safety, which emergency is set forth and defined in the pre- amble hereto, shall take effect and be in force from and after the passage and adoption hereof. Section 7. That the City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and cir- culated in the City of Huntington Beach, California.
