HomeMy WebLinkAboutOrdinance #669 ORDINANCE No. 669 AN ORDINANCE OF THE CITY OF HUNTINGT ON BEACH APPROVING THE ANNEXATION TD THE CITY OF HUNT- INGTON.BEACH C>F CERTAIN INHABITED TERRITORY DESIGNATED AS "EAST ANNEXATION"I -WHICH IS CONTIGUOUS TO THE CITY OF HUNTINGTON BEACH UPON THE TERMS CONTAINED -IN THE QUESTION SUBMITTED AT A SPECIAL ELECTION HELD IN SAID TERRITORY ON THE 6TH DAY OF AUGUST,1957 - - WHEREAS, pursuant to the provisions of an Act of the Legislature of the State of California, .known as the "Annex- ation Act of 1913", and pursuant to Resolution No. 1308 adopted by the City Council of the City of Huntington Beach on the 6th day of May, 1957, a special election was held on the 6th day of August, 1957, in that certain inhabited terr- itory contiguous to the City of Huntington Beach designated • as "East Annexation" and which is hereinafter more partic- ularly described, and WHEREAS, at said special election the following ques- tion was submitted to the qualified electors residing in said territory: SHALL THE EAST ANNEXATION BE ANNEXED TO THE CITY OF HUNTINGTON BEACH AND THE PROPERTY IN SUCH TERRITORY BED AFTER SUCH ANNEXATION, SUBJECT TO TAXATION EQUALLY WITH THE PROPERTY WITHIN THE CITY OF HUNTINGTON BEACH, TO PAY THE ENTIRE BONDED INDEBTEDNESS CIE' THE CITY OF HUNTINGTON BEACH,' OUTSTANDING OR AUTHORIZED AT THE DATE OF Ord. No. THE FIRST PUBLICATION OF THE NOTICE OF ELECTION, FOR THE ACQUISITION1 CONSTRUCTION OR COMPLETION OF MUNICIPAL IMPROVEMENTS? WHEREAS, it appears from the canvass of the returns of the votes cast at said special election that a majority of all votes cast in said territory on the question of said annexation and the assumption of. said bonded indebtedness favor annexation upon the terms contained in the question submitted; and WHEREAS, it appears that said special election and all proceedings relating thereto have been conducted strictly in accordance with law.; NOW THEREFORE, the People of the City of Huntington Beach do ordain as follows: Section 1. That the annexation of that certain in- habited territory contiguous to the City of Huntington Beach designated as "East Annexation" be and the same is hereby approved upon the terms contained in the aforesaid question which was submitted at the special election. held on the 6th day of August, 1957. Said territory is describ- ed as follows: Ord. No. • Beginning at an angle point in the boundary line of the City of Huntington Beach as now established, said point being in the South line of the Northwest quarter (NwJ-) of Section 1, Township 6 South, Range 11 West, San Bernardino Meridian and distant thereon East 1188 feet, more or less from the Southwest cor- ner of the Northwest quarter of said Section 1, said point also being the Southwest corner of the East 1+ Acres of the Southwest quarter (Sft) of the Northwest quarter (Yd-J) of said Section 1; thence North 1320 fect, more or less, along the West line of said East 1+ Acres to the Northwest corner of said East 1+ Acres; thence East 132 feet, more or less, to the Northwest corner of the Southeast quarter (SEJ-) of the North- west quarter (N ) of said Section 1; thence Northerly along quarter, quarter section lines to an intersec- tion with a line drawn parallel with and 30 feet North, measured at - right angles from the South line of Sec- tion 36, Township 5 South, Range 11 West:, San Bernard- ino Meridian; thence Easterly along said parallel line to an intersection with the West line of the East half (E2) of the Southeast quarter (SE-J) of the Southwest quarter (SWJ) of said Section 36; thence South 10 feet along said West line to an intersection with a line drawn parallel to and 20 feet North, measured at right angles from the South line of said Section 36; thence 1 Ord. No. East along said parallel line and its Easterly pro- longation to an intersection with a line drawn para- llel to and distant. 30 feet Easterly, measured at right angles from the West line of Section 31, Town- ship 5 South, Range 10 West, San Bernardino Meridian; thence Northerly along said parallel line to an in- tersection with a line drawn parallel to and distant 30.00 feet Northerly, measured at right angles from the South line of said Section 31; thence Easterly along said parallel line and along a line that is par- allel with and 30.00 feet Northerly, measured at right angles from the South line of Section 32, said Township and Range , *to an intersection with the Wester- ly line of the Santa Ana River Channel as shown on .a map Recorded in Book 12, Pages 25 to 31 inclusive of Records of Surveys, on file in the office of the County Recorder; thence Southwesterly 2.25 miles, more or less, along the said Westerly line of the Santa Ana River Channel, as shown on the Records of Surveys 0 Maps, hereinabove mentioned, to an intersection with the boundary line of the City of Costa Mesa, as now established; thence Westerly and Southerly, along said boundary line to a point in the boundary lire of the City of Huntington Beach as now established in the North line of Section, 19, Township 6 South, Range 10 Ord. No. • West, San Bernardino Meridian; thence Westerly, North- erly, Westerly and Northerly, 4.5. miles, more or less, following along the boundary line of the City of Hunt- ington Beach, as now established, to an angle point in said boundary line in the South line of the North- west quarter (NW-J) of Section 1, Township 6 South, Range 11 West, San Bernardino Meridian and the point of beginning of this description. Section 2. That the boundaries of said City of Hunting- ton Beach are hereby altered and the said territory above described is hereby annexed to, and incorporated and in- cluded within the City of Huntington Beach, California, and said City shall have all rights and powers in, to and over said territory as are provided by law. Section 3. That the territory above described shall be subject to taxation equally with the property within the City of Huntington Beach to pay the entire bonded indebt- edness of the City of Huntington Beach outstanding on March 27th, 1957, or theretofore authorized, for the ac- quisition, construction or completion of municipal im- provements. Section 4. The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same Ord. No. 669 to be published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and circu- lated in the City of Huntington Beach, California; and thirty (30) days after the adoption thereof, . the same shall take effect and be in force.
