HomeMy WebLinkAboutOrdinance #686 ORDINANCE N o. 686 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH APPROVING THE ANNEXATION OF CER- RAIN UNINHABITED TERRITORY DESIGNATED AS "NORTH No. 3 ANNEXATION" TO THE CITY OF HUNTINGTON BEACH The City Council of the City of Huntington Beach, California, does ordain as follows: WHEREAS, pursuant to the provisions of the "Annexation of Uninhabited Territory Act of 1939" , the City Council of the City of Huntington Beach did, on the 29th day of January, 1958, pass and adopt Resolution No. 1331, giving notice of the proposal to annex certain uninhabited territory to the City of Huntington Beach, said territory being therein desig- nated as "North No. 3 Annexation" and said action being taken by the, Council of said city as the .legislative body of the city, pursuant to a written petition therefor, said Resolu- tion describing the boundaries of the. territory so proposed to be annexed to said city; and ?WHEREAS, said Resolution No. 13317 did contain a notice of the day, hour and place when and where the said council of said city would hear protests made by any person owning property within the territory proposed to be annexed, the . time of said hearing being not less than 40 nor more than 60 days after the passage of said Resolution; and WHEREAS, on the 17th day of March, 1958, at the hour 1. Ord. N o. 686 of 8:15 o' clock P.M. in the Council Chambers in the City Hall of the City of Huntington Beach, State of California, said time and place being the day, hour and place fixed in said Resolution No. 1331 for hearing protests to the said an.YieIat on, the City Council of said city, did hear and pass upon all protests made to said proposed annexation and did determine and find that a majority protest had not been made or presented in accordance with Section 35313 of the Government Code of the State of California; and WHEREAS, said territory is contiguous to the City of Huntington Beach, and is uninhabited territory in the County of Orange ; and WHEREAS, the owners of more than two-thirds of the value of the territory have heretofore filed with the City Clerk written consent that the property in said territory be , after annexation, subject to taxation equally with the property within the City of Huntington Beach to pay the entire bonded indebtedness of the City of Huntington Beach outstanding or authorized at the . date of the filing of the petition for annexation for the acquisition, construction or completion of municipal improvements; NUT THEREFORE, the City Council of the City of Hunt- ington Beach does hereby approve the annexation known as "North No. 3 Annexation" , the territory of which is hereinaf- described, to the City of Huntington Beach and does hereby 2.. Ord. No. 686 further ordain that the said territory be and is hereby annexed to the City of Huntington Beach. That said territory, the annexation of which to the City of Huntington Beach is herein approved, is all that territory situate in the County of Orange , State of Calif- ornia, and more particularly described as follows: "Beginning at the point of intersection of a line drawn parallel to and 30 feet South, measured at right angles, of the North line of Section 22, Township 5 South, Range 11 West, S.B.M. , with the Southerly prolongation of the :East line of the Southwest quarter (SIft'-) of the Southeast quarter (SD ) of Section 15, of said Township and Range , said point being in the boundary line of the City of Huntington Beach as now estab- lished; thence leaving said boundary line North- erly in a direct line to the Northeast corner of the Southwest quarter (SW4) of the Southeast quarter (SE4) of said Section 15; thence West- erly in a direct line to the Northwest corner of the Southwest quarter (SIrV) of the Southeast quarter (SE—,) of said Section 15; thence Norther- ly along the North-South quarter section line extending through the center of said Section 15 to an intersection with a line drawn parallel to 3 . Ord. No. 686 and distant 40 feet Southerly, measured at right angles, from the North line of said Sec- tion 15, said point of intersection being in the boundary line of the City of Westminster as now established; thence Easterly, Souther- ly, Easterly and Northerly following along said boundary line to an intersection with the North line of the South half (S2) of the Northeast quarter (NE') of Section 14, of said Township and Range; thence leaving the boundary line of the City of Westminster, Easterly along said North line to the Northeast corner of the South- west quarter (SW4) of the Northeast quarter (NE4) of said Section 14; thence Southerly following along quarter-quarter section lines to the Northwest corner of the Southeast quay- ter (SE') of the Southeast quarter (SET) of said Section 14; thence Easterly along the North line of said Southeast quarter (SE-a) of the Southeast quarter (SEW') of said Section. 14 to an intersection with a line drawn parall- el to and distant 30 feet Westerly,measured at right angles from the Easterly line of said Section 14; thence Southerly along said parallel line and its Southerly prolongation. to an intersection with a lire drawn parallel Ord. No, 686 to and distant 30 feet Southerly, measured at right angles from the North line of Section 23 of said Township and Range , said point of intersection being in the boundary line of the City of Huntington Beach as now establish- ed; thence Westerly along said boundary line to the point of beginning." The boundaries of said City of Huntington Beach are hereby altered and the said territory above described is hereby annexed to, incorporated in and included within the City of Huntington Beach, California, and said City shall have all rights and powers in, to and over said territory as are provided by law, The City Council of the City of Huntington Beach does hereby further ordain that the territory above de- scribed shall be subject to taxation equally with the property within the City of Huntington Beach to pay the entire bonded indebtedness of the City of Huntington Beach outstanding on January 29th, 1958, the date of the filing of the Petition for Annexation of said territory or theretofore authorized, for the acquisition, construct- ion or completion of municipal improvements. The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, Ord. No. 686 a weekly newspaper, printed, published and circulated in the City of Huntington Beach, California; and thirty (30) days after the adoption thereof, the same shall take ef- fect and be in force. HENRICKSEN, the duly elected qualified and acting City Clerk of the City of Huntington Beach and ex-officio Clerk of the City Council of said City, do hereby certify that the whole number of members of the City Council of the City of Huntington Beach is five ; that the foregoing ordinance was ;read to said City Council at a regular meeting thereof held on the 17th day of March, 1958, and was again read to said City Council at a regular meet- ing thereof held on the - 7thl- day of April , 1958, and was passed and adopted by the affirmative vote of more than a majority of all the members of said City Council.
