ORDINANCE No. 706 / AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING.THE HUNTINGTON BEACH, ORDINANCE CODE; ' ADOPTING A ZONING PLAN BEING A PRECISED SEC- TION OF THE .LAND USE.PLAN UNIT OF THE MASTER PLAN AND AN OFFICIAL PLAN OF SAID CITY: SPEC- IFYING THE PURPOSES- AND EFFECTS OF THE ADOPT- ION OF SAID PLAN WHEREBY VARIOUS DISTRICTS ARE ESTABLISHED IN SAID CITY: SPECIFYING THE USES OF- LAND AND OF BUILDINGS PERMITTED IN SAID DISTRICTS: - REQUIRING CERTAIN YARDS AND OTHER OPEN SPACES WITHIN SAID DISTRICTS: PRE- SCRIBING FOR. THE .ERECTION, CONSTRUCTION, AL- TERATION AND MAINTENANCE OF BUILDINGS, STRUCT- URES AND OTHER IMPROVEMENTS IN SAID DISTRICTS, INCLUDING THE REQUIREMENTS THAT CERTAIN` PER- MITS SHALL BE SECURED FOR CERTAIN OF SUCH BUILDINGS, STRUCTURES AND IMPROVEMENTS, AND FOR THE USE THEREOF AND OF LAND: DEFINING -THE TERMS USED HEREIN: SPECIFYING THE PROCEDURE FOR THE -AMENDMENT HEREOF: REPEALING ALL ORDI- NANCES OR PARTS OF ORDINANCES .IN. CONFLICT HEREWITH: AND PRESCRIBING PENALTIES FOR THE VIOLATION OF ANY OF THE PROVISIONS HERt.IN. The City Council of the City of Huntington Beach do ordain as follows: Section 1. That Article 920 and Sections 9200 and 9200.1 of the Huntington Beach Ordinance Code are hereby amended to read in words ':and figures as follows: ARTICLE 920 PRECISE PLAN ADOPTION Section 9200. Adoption of Zoning Plan. Section 9200.1. Adoption. There .is hereby adopted a zoning plan for the City of Huntington Beach, State of California, said zoning plan being a Districting Plan as Ord. No. 706 provided by law. Section 2. That Sections 9200.11 , 9200.127 9200.1219 9200.13, 9200.131, 9200.21 9200.217 9200.227 9200.23,9200.242 9200.259 9200.3, 9200.31, 9200.327 9200.33, 9200.347 9200.3.51 9200.47 9200.41, 9200.421 9200.57 9200.51, 9200.67 9200.79 9200.8, 9200.91 9200.91, 9200.927 9200.937 9201, 9202, 9202.17 9202.21 9202.3, 92037 9204, 92057 9205.17 9205.21 9205.31 9205.4, 9206, 9207 and 9208 of the Huntington Beach Ordinance Code be, and they are hereby repealed. Section 3. That Article 921 of the Huntington Beach Ordinance Code is hereby amended to read in words and figures as follows: ARTICLE 921 PURPOSE OF ADOPTION Section 4. There is hereby added to the Huntington Beach Ordinance Code, as part of Article 921, the following sections to read in words and figures as follows, to wit:. Section 9210. Purpose of Adoption of Zoning Plan. Section 9210.1. The purpose of this ordinance is to promote the growth of the City of Huntington Beach in an or- derly manner and to promote and protect the public health, safety, comfort and general welfare. 2. Ord. NO. 706 Section 9210.2. The Zoning or Districting Plan ef- fectuated by this ordinance is a part of the Master Flan and consists of the establishment of various districts, including all the territory within the boundaries of the City, within which the use of land and buildings, the space of buildings, and the height and bulk of buildings are regulated. Section 9210.3. No buildings or structure shall be erected, reconstructed or structurally altered in any man- ner, nor shall any building or land be used for any purpose other than is permitted by and in conformance with this or- dinance and all other ordinances, laws and maps referred to therein. Section 5. That Sections 9211, 9211.11 9211.21 9211.3, 92127 92137 9214, 9215, 9216, 9217 and 9218 of the Huntington Beach Ordinance Code be, and they are hereby re- pealed. Section 6. That .article 922 of the Huntington Beach Ordinance Code is hereby amended to read in words and figures as follows: ,ARTICLE 922 E:STABLISIkENT OF DISTRICTS Section 7. There is hereby added to the Huntington 3• Ord. No. 706 , Beach Ordinance Code, the following new sections, to read in . words and figures as follows: Section 9220. The following districts are hereby established. Section 9220.1 Residential Agricultural District or R-A District Single Family Residential District or R-1 District Duplex Residential District or R-2 District Multiple Family Residential District or R-3 District Multiple Residential and Services or R-1+ District Neighborhood Commercial District or C-1 District Central Commercial District or C-2' District Heavy Commercial District or C-3 District Planned Industrial District or PM District Industrial District or NI-1 District Heavy Industrial District or M-2 District Oil Field District or OF District Shoreline District or S District Unclassified District or U District Ord. No. 706 Combining Parking District or P District Combining Lot Size District or B District Combining Oil Production District or 0 District Combining Oil Production District or 0-1 District Section 9220.2. Index Map shall consist of an index map to the sectional district map, being parts of this ordi- nance under the provisions of this Article, and shall be cited as Section 9220.2 of this ordinance. Section 9220.3. Section District Maps. The designa- tions, locations and boundaries of the -districts established are delineated upon the maps entitled, "Sectional District Map for the City of Huntington Beach, California", which maps and all notations and information thereon are hereby made a part of this ordinance. No. 706 companions or otherwise, shall be established in any C-1 or C-2 District, unless a use permit shall first have been secured for the establishment , maintenance and operation of such use. Section 9240.13 . Accessory uses and buildings in .any C or M District may be permitted where such uses or build- ings are incidental to and do not alter the character of the premises in respect .to their use for purposes permitted to the District. Such accessory buildings shall be allowed only when constructed concurrent with or subsequent to the main building. Section 9240.14. No dwelling other than a single family structure shall be constructed or established on a lot or building site in any R-A, R-11 R-21 R-3 or R-4 Dis- trict, if said lot or building site contains less than 5000 square feet in area and less than 45 feet of average width. Section 9240.15. The removal of minerals, earth and other natural materials may be permitted, providing a use permit shall first be obtained in each case. Section 9240.2. Height Limits: Section 9240.21, Chimneys, silos, cupolas, flag poles, monuments, gas storage holders, radio and other towers,, water tanks., church steeples and similar structures and mechanical appurtenances may be permitted in excess of height limits, ;5-0. Ord. No. 706 provided a use permit is first obtained in each case. Section 9240.22. No fence, hedge or screen planting of any kind shall hereinafter be constructed or grown to exceed six (6) feet in height, unless required by law, with- in any required side yard to the rear of the front line of any dwelling or along any rear property line, nor to ex- ceed three (3) feet in height along the property line to the front of any dwelling or within thirty-five (35) feet of the street corner or any corner lot. Section 9240.3. Building Site Area: Section 9240.31. Any lot or parcel of land under one ownership and of record on May 6, 1946, and where no adjoin- ing land was owned by the same person, may be used a.s a building site even when of less area or width than that re- quired by the regulations for the district in which it is located - See Section 9240.14 for limitations as to use. Section 9240i, Yards; Section 9240.51. Architectural features such as core nice.s and canopies may not extend closer than three (3) feet, and eaves not closer than eighteen (18) INCHES TO ANY SIDE LOT LINE. Section 9240.52. Open uncovered porches, landing places or- outside stairways may project not closer than four (4) feet to any side lot line , and not exceeding six' 51. Ord. No. 706 (6) feet into any required front or rear yard on any lot over fifty (50) feet in width. Lots under fifty (50) feet in width may not have open uncovered porches:, landing places or outside stairways that project closer than eighteen (18) inches to any side lot line , and not higher than two (2) feet above the ground level. Section 9240.53. Whenever an Official Plan Line or Building Line has been established for any street, required yards shall be measured from such line and in no case shall the provisions of this ordinance be construed as permitting any encroachment upon any Building Line or Official Plan Line. Section 9240.54. In case an accessory building is attached to the main building , it shall be made structurally a part of and have a common roof with the main building, and shall comply in all respects with the requirements of this ordinance applicable to the main building. Unless so at- tached an accessory building in an "R" District shall be located on the rear one-half (1/2) of the lot and at least ten (10) feet from any dwelling building existing or under construction on the same lot , or any adjacent lot. Such accessory building, with access to the Alley, shall not be located within. six (6) feet of any alley, and in the case of a corner lot, to project beyond the front yard required or existing on the adjacent lot. 52. Ord. No. 706 Section 9240.55. Where four (4) or more lots in a block have been improved with main buildings, the minimum required front yard shall be the average of the improved lots, if less than the requirements. Section 9240.56. On any parcel of land of an average width of less than fifty ( 50) feet, which was shown as a separate parcel or shown as a lot on any subdivision map filed in the office of the County Recorder of the County of Orange prior to May 6, 1946, when the owner thereof owns no adjoining land, the width of each side yard may be reduced to 10% of the width of such parcel, but in no case to less than three (3) feet. Section 9240.57. Every Building or portion thereof which is designed or used for any dwelling purpose in any "C" District shall comply with the provisions of this ordi- nance as to side yards which are required in "RII Districts; provided that when the ground floor of any such building is used for any commercial purpose , no side, front or rear yard shall be required. Section 9240. 58. Special Yards and distances for dwelling groups. Section 9240.581. Distance between buildings in any dwelling group - minimum ten (10) feet. Section 9240.582. Side Yard, providing access to single row dwelling group - minimum twelve (12) feet. 53. Ord. No. 706 Section 9240.583. Inner Court, providing access to double row dwelling group - minimum twenty (20) feet. Section 9240. 584. See fire control regulations in Uniform Building Code,. Section 9240.6. Architectural Ccn trol. Section 9240.61. In case an application is made for a permit for any building or structure in any "C11 or "M" District, said application shall be accompanied by architec- tural drawings or sketches, showing the elevations of the proposed building or structure and proposed landscape or other treatment of the grounds around such building or structure. Such drawings or sketches shall be considered by the Planning Commission in an endeavor to provide that the architectural and general appearance of such buildings or structures and grounds be in keeping with the character of the neighborhood, and such as not to be detrimental to the orderly and harmonious development of the city, or to impair the desirability of investment or occupation in the neighborhood. Section 9240.62. The Planning Commission may appoint an Architectural Committee: of three of its members. Section 9240.63. The Architectural Committee shall. have authority to approve architectural sketches within the meaning of Section 9240.6 of this ordinance. 54. Ord. No. 706 Section 921+0.61+. In case the applicant is not satisfied with the decision of the Architectural Committee , he may within fifteen (15) days after such action appeal in writing to the Planning Commission. The Architectural Committee may, if it deems it advisable , refer any, application for ar- chitectural approval to the Planning Commission for its de- cision. Section 9240.65. In case the applicant is not satis- fied with the action of the Planning Commission, he may within thirty (30) days appeal in writing to the City Council and said Council shall render its decision within thirty (30) days after the filing of such appeal. Section 9240.66. No permit shall be issued in any case hereinabove mentioned until such drawings and sketches have been approved by the Planning Commission, or by the City Council in the event of appeal from the Planning Com- mission, and all buildings structures and grounds shall be in accordance with the drawings and sketches.. Section 9240.7. Non-Conforming Uses.: Section 2240.71. The lawful use of land existing on May 6, 1946, although such use does not conform to the regu- lations herein specified for the district in which such land is located , may be continued, provided that no such use shall be enlarged or increased nor be extended t® %c`upy 'A :gre.ater 55 . Ordinance No. 706 area than that occupied by such use at the time of the adopt- ion of this ordinance, and that if any such use ceases the subsequent use of such land shall be in conformity to the reg- ulations specified by this ordinance for the district in which such land is located. Section 9240.72. The lawful use of a building exist- ing on May 6, 1946, or before, may be continued, although such use does not conform to the regulations specified for the' dis- trict in which the building is located. Section 9240.73. The non-conforming use of a portion of a building may be extended throughout the building, pro- vided that in each case a use permit shall first be obtained. Section 9240.74. The non-conforming use of a build- ing may be changed to a use of the same or more restricted nature, provided that in each case a use permit shall first be obtained. Section 9240.75. If the non-conforming use of a and or. operations wi hin. a building building/ceases for a continuous period of one year , except pursuant to a valid order of a court of law, it shall be conclusively presumed that such use has been abandoned and shall thereafter be used only in accordance with the regula- tions for the district in which it is located. Section 9240.8. Non-Conforming Building. 56. Ordinance No. 706 Section 9240.81. A non-conforming building dam- aged or destroyed by fire , explosion, earthquake , or other act to an extent of more than fifty (50) percent of the ap- praised value thereof, according to a competent appraiser, may be restored only if made to conform to all the regulations of the district in which it is located. Such building may be restored to a total floor area not exceeding that of the former building, if a use permit is first secured in each case where the damage did not exceed 500. Section 9240.82. Ordinary maintenance and repairs may be made to any non-conforming building, providing no structural alterations are made and providing that such work does not exceed fifteen (15) percent of the fair market value in any one (1) year period. Other repairs or altera- tions may be permitted provided that a use permit shall-first be secured in each case. Section 9240.83. Nothing contained in this ordi- nance shall be deemed to require any change in the plans, construction or designated use of any building for which a building permit has properly been issued, in accordance with the provisions of ordinances then effective and upon which actual construction has been started prior to the effective date of this ordinance , provided that in all such cases actual construction shall be diligently carried on until completion of the building. 57. There is hereby added to the Hunting- ton Beach Ordinance Code, the following new sections to read in words and figures as f oll.ows: Section 9250. Permits. Variances and Amendments. Section 9250.1. Zoning Permits: Zoning permits shall be required for all buildings and structures herein- after erected, constructed, altered, repaired or moved within or into any district established by this ordinance , and for the use of vacant land or for a. change in the char- acter of the use of land within any district established by this ordinance. Section 9250.2 Use Permits: 58. Ord. NO 706 Section 2250.21. Use permits , -revocable, condition- al or valid for a term period may be issued for any of the uses or purposes for which such permits are required or per- mitted by the terms of this ordinance. Section 9250.22. Application for use permit shall be made to the Planning Commission in writing on a form pre- scribed by the Commission and shall be accompanied by plans and elevations necessary to show the detail of the proposed use of building. Such application shall be accompanied by a. fee of five dollars ($5.00) . Section 9250.23. Public Hearings: No public hear- ing need be held thereon, provided that the Planning Commiss- ion may hold any hearings as it deems necessary. In case a public hearing is deemed necessary, a notice of such hearing shall be given as follows: Not less than five days prior to such hearing there shall be mailed postage prepaid, a notice of the time and place of such hear- ing to all persons whose names and addresses appear on the latest adopted tax roll of the county within which the prop- erty concerned is located, or as known to the City Clerk as owning property within a distance of not less than 300 feet from the exterior boundaries of the area actually occupied, or to be occupied by the use which is the subject of the hearing. 59• Ord. No. 706 Section 2250.24. Action by Commission: In order to grant any use permit the findings of the Planning Commission shall be that the establishment, maintenance or operation of the use of building applied for will not, under the circumstances of the particular case,, be detrimental to the health, safety, morals, comfort and gen- eral welfare of the persons residing or working in the neigh- borhood of such proposed use,, or be injurious or detrimental to property and improvements in the neighborhood or to the general welfare of the city. The Planning Commission may impose such condition, in connection with the use permit, as it deems necessary to. secure the purposes of this ordinance , and may require guarantees and evidence that such conditions are being, or will be complied with. Section 9250.25. Appeal: In case the applicant or any interested party is not satisfied with the action of the Planning -Commission, he may within five (5) days appeal in writing to the City Council. 3 The City Council shall set date for public hearing and shall post notices as set forth in Section 9250.E+2. Notice shall also be given to the Planning Commission of such appeal and the Planning Commission may submit a report to tin _ Ord. No. 706 the City Council setting forth the reasons for action taken by the Commission, and may be represented at the hearing. The City Council shall render its decision within ninety (90) days after the filing of such appeal. Section 9250.26. Effect: No building or zoning permit . shall be issued in any case where a use permit is required by the terms of this Ordinance until five (51 days after the granting of such use permit by the Planning Commission, or after grant- ing of such use permit by the City Council in the event of appeal and then only in accordance with the terms and con- ditions of the use permit granted. Section 9250.3. Variance and Appeals: Where practical difficulties, unnecessary hard- ships and results inconsistent with the general purpose of this ordinance may result from the strict application of certain provisions thereof, variance may be granted as provided in this section, provided this procedure may not be used to change the use of land. Section 9250.32. Applications. Application for variance shall be made in writ- ing on' a form prescribed by the Planning Commission and shall be accompanied by a fee of twenty-five dollars ($25.00) and statement, plans and evidence showing all of the follow- conditions. 61. \ J Ord. Notice of said hear- ing shall be given by mailing a postal card notice at least five (5) days prior to such hearing to the owners of proper- ty within a radius of 300 feet of the property of the appli- cant, as said owners are shown on the last equalized assess- ment roll in the office of the City Assessor. Failure of any property owner to receive such notice shall not affect the validity of the hearing. Section 9250.34. Action by Commission: After the conclusion of the public hearing the Planning Commission may grant variance permits to modify the application of particular restrictions established by the provisions of this ordinance , where unnecessary hard- ships or practical difficulties and results inconsistent with the purposes of this ordinance will result from the strict application of such restrictions, and where the grant- ing of such variance will be subject to such conditions as; 62 . Ord. No. 706 will assure that the variance granted shall not constitute a grant of special privilege inconsistent with the limita- tions on the property in the vicinity and under identical zone classification; provided however, no variance permit shall be granted to allow any land use which is not in con- formity with the use regulations specified for the district in which the land is located. Section 9250.35. Appeal to City Council: Within five (5) days after the final action of the Planning Commission upon such application, the applicant or other affected persons may file with the Clerk of the Counc- il of the City an appeal from such action. The appeal shall be in writing and shall state the reasons for which the ap- peal is taken. �' The City Council shall cause a,;public hearing to be held thereon and shall give notice thereof as provided in Section 7250.33. Notice of such hearing shall also be given the Planning Commission. Upon receipt of such notice and five (5) days prior to the time set for the hearing,the Planning Commission shall furnish the City Council the written record of the application., including all written evidence re- ceived by the Planning Commission, and a report of its action thereon. The City Council may affirm, modify or reverse the action of the Planning Commission, or may refer the matter back, with or without instructions, to the Planning Commiss- ion for further proceedings. In the event the City Council 63 . Ord. No. 706 , fails to act upon the appeal within sixty (60) days after the filing thereof, the action of the Planning Commission shall be deemed affirmed. The decision.--of the City Council upon the appeal shall be final and conclusive as to all things involved in the matter. Section 9250.36. Effect: No building or zoning permit shall be issued upon a variance permit until five (5) days after the granting of such variance by the Planning Commission, or in the event of an- appeal within said five (5) day period, until said ap- peal is finally concluded. No building or zoning permit shall be issued except In accordance with and sub'ect to the terms and conditions of the variance granted. Section 9250.4. appeals: Section 9250.41. The Planning Commission shalll, have the power to hear and decide appeals based on the en- forcement or interpretation of the provisions of this ordi- nance. Section 9250.42. In case an applicant is not sat- isfied with the action of the Planning Commission on his appeal, he may within fifteen (15) days appeal in writing to the City Council. Section 9250.43. Notice shall be given to the Planning Commission of such appeal and a report shall be 64. Ord. No. 706 submitted by the Planning Commission to the City Council, setting forth the reasons for action taken by the Commiss- ion, or shall be represented at -the Council meeting. Section 9250.�4. The City Council shall render its decision within thirty (30) days after the filing of such appeal. Section 9250. 5. Revocation of Permits or Variances: Section 9250. 51. Any zoning permit, use permit, or variance granted in accordance with the terms of this ordinance shall be revoked if not used within one (1) ye ar from date of approval. Section 9250.52. Any zoning permit, use permit, or variance granted in accordance with the terms of this ordinance may be revoked if any of the conditions or terms of such permit or variance are violated, or if any law or ordinance is violated in connection therewith. Section 9250.53. The Planning Commission shall hold a hearing on any proposed revocation after giving written notice to the permittee at least ten (10) days prior to the hearing and shall submit its recommendations to the City Council. The City Council shall act thereon ivithin thirty (30) days after receipt of the recommendations of the Planning Commission. Section 16A. That Sections 9251. , 9251.1 and 9251.2 of the Huntington- Beach Ordinance Code are hereby amended to read in words and figures as follows: hS _ Ord. N . 706 Section 9251. Amendments: This ordinance may be amended by changing the boundaries of districts, or by changing any other provision thereof whenever the public necessity and convenience and the general welfare require such amendment by following the procedure of this .section: Section 9251.1. Initiation: An amendment may be initiated by: The filing of a petition of one or more recorded owners of property which is the sup ject of the proposed amendment , or their authorized agents, which petition shall be filed with the ;Planning Commission and shall be accompan- ied by a fee of fifty dollars ($50.00) , and a showing that such application shall be in the public interest and not detrimental to the health, safety and general welfare of the city. All such applications should be accompanied by pre- liminary development plan of the subject property. Resolution of Intention of the City Council, or by Resolution of Intention of the Planning Commission., Section 9251.2. Public Hearings: The Planning Commission shall hold one (1) public hearing on any proposed amendment and shall give notice thereof by at least one publication in a newspaper of -gener- al circulation within the city at least ten (10) days prior to such hearing. 66. Ord. No. 706 In case the proposed amendment consists of a change of the boundaries of any district so as to reclassify property from any district to any other district, the Planning Commission shall give additional notice of the time and place of such hearing and of the purpose thereof by mailing a post- al card notice not less than five (5) days prior to the date of the first of such hearings to the owners of property with- in a radius of three hundred (300) feet of the exterior bound- aries of the property to be changed, using for this purpose the last known name and address of such owners as shown upon the assessment roll of this County. If the proposed amend- ment is of a matter of general city-wide scope , notice need only be given by at least one publication in a newspaper of general circulation within the City at least 10 days prior to such hearing. Such notice shall contain a statement setting forth a general description of the property involved in the proposed change of district, the time and place at which the public hearing on the proposed change will be held, and any other information which the Planning Commission may deem to be necessary. public Any failure to post/notices as aforesaid shall not invalidate any proceedings for amendment of this Zoning Ordinance. Section 16B. There is hereby added to the Huntington Beach Ordinance Code the following new sections to read in words and figures as follows: 67. Ordinance No. 706 , Section 9251.3. Action by Planning Commission: Following the aforesaid hearings the Planning Commission shall make a report of its findings and recommenda- tions with respect to the proposed amendment, and shall file with the City Council an attested copy of such report within ninety (90) days after the notice of the first of said hear- ings; provided that such. time limit may be extended upon the mutual agreement of the parties having an interest in the proceedings. Failure of the Planning Commission so to report within ninety (90) days without the aforesaid agreement shall be deemed to be approval of the proposed amendment by the Planning Commission. Section 9251.E Action by City Council: Upon receipt of such report from the Planning Com- mission, or upon the expiration of such ninety (90) days as aforesaid, the City Council shall set the matter for public hearing after notice thereof and of the proposed amendment given as provided by law. After the conclusion of such hear- ing the City Council may adopt the amendment or any part thereof set forth in the petition in such form as said Council may deem to be advisable . Section 9251.41. The decision of the City Council shall be rendered within sixty (60) days after "the receipt of a report and recommendations from the Planning Commissiomt, or after the _expiration of ninety (90) days as aforesaid. 68. Ord. No.706 , Section 17. That Article 926 of the Huntington Beach Ordinance Code is hereby amended to read in words and figures, as follows: ARTICLE 926 DEFINITIONS Section 19. There is. hereby added to the Huntington Beach Ordinance Code , the following new sections to read in words and figures as follows: Section 9260. Definitions: Section 9260.1 For the purpose of this ordinance cer- tain terms used herein are defined as follows: Section 9260.11. "ALLEY" Any public thoroughfare which affords only a secondary means of access to abutting property. Section 2260.12. "AUTOMOBILE COURT" OR "MOTEL" A group of 2 or more detached or semi-detached buildings contain- ing guest rooms or apartments with automobile storage space 69• i Ord. No. 706 serving such rooms or apartments provided in connection there- with, which group is designed and used primarily for the ac- commodation of transient automobile travelers. Section 9260.13. "BOARDING HOUSE" A dwelling other than a hotel where 3rffi_dzi. 1- lodging and meals for three (3) or more persons is provided for compensation. Section 9260.14. "BUILDING" Any structure having a roof supported by columns or by walls and designed for the shelter or housing of any person, animal or chattel. Section 9260.15. "BUILDING, ACCESSORY". A subordinate building . or structure , the use of which is incidental to that of the main building on the same lot and/or building. site. Swimming Pools shall be considered an accessory structure. Section 9260.16. "BUILDING, MAIN" A building or structure in which is conducted the principal use of the lot and/or building site on which it is situated. Section 9260.17. "BUILDING SITE" A lot or parcel of land, in single or joint ownership, and occupied or to be occupied by a main building and accessory buildings, or by a dwelling group and its accessory buildings, together with such open spaces as are required by the terms of* this ordi- nance and having its principal frontage on a street , road, highway or waterway. Section 9260.18. "BUSINESS, RETAIL" The retail sale of any article, substance , or commodity for profit or liveli- 70. Ord. No. 706 hood, conducted within a building but not including the sale of lumber, or other building materials or the sale of used or second-hand goods or materials of any kind. Section 9260.19. "BUSINESS, WHOLESALE" The wholesale handling of any article , substance or commodity for the profit or livelihood, but not including the handling of lumber or other building materials or the open storage or sale of any material or commodity, and not including the processing or manufacture of any product or substance. Section 9260.20. "COMBINING DISTRICT": Any district in which the general district regulations are combined with "-P" for the purpose of adding additional special regula- tions, i.e. , "C-211combined with "-P" (C-2-P adds the addit- ional requirement of off-street parking.) Section 9260.21. "DISTRICT" A portion of the City within which certain uses of land and buildings are per- mitted or prohibited and within which certain yards and other open spaces are required and certain height limits are estab- lished for buildings, all as set forth and specified in this ordinance. Section 9260.22. "DWELLING, SINGLE FAMILY" . A build- ing designed for , or used to house not more than one family, including all necessary employees of such family. 71. Ord. No. 706 Section 9260.23. "DWELLING, TWO FAMILY OR DUPLEX". A building containing not more than two kitchens' designed and/or used to house not more than two families, living in- dependently of each other, including all necessary employees of each such family. Section 9260.23.1. "DWELLING, THREE FAMILY OR TRIPIMP: A building containing not more than three kitchens, design- ed and/or used to house not more than three families, living independently of each other. Section 9260.24i "DWELLING, MULTIPLE". A building or portion thereof, used and designed as a residence for 3 or more families living independently of each other and do- ing their own cooking in said building, including apartment houses, apartment hotels and flats, but not including auto- mobile courts, or boarding houses. Section 9260.25. "DWELLING GROUPS" . A group of 2 or more detached or semi-detached, 1-family, 2-family, or multiple dwellings occupying a parcel of land in one owner- ship and having any yard or court in common, but not includ- ing automobile courts. Section 9260.26. "FAMILY" . One or more persons oc- cupying a premises and living as a single housekeeping unit, as distinguished from a group occupying a hotel, club, fraternity or sorority house. A family shall be deemed to include necessary servants 72. � I Ord; No. 706 Section 9260.27. "GARAGE" or 11CAR PORT". An access- ible and usable covered space of not less than 10 x 20 feet for storage of automobiles, such garage to be so located on the lot so as to meet the requirements of this ordinance for an accessory building , or if attached to the main building, to meet all requirements applicable to the main building. Section 9260.28. "GARAGE SPACE" . An accessible and usable space of not less than eight (8) feet by twenty (20) feet for the parking of automobiles off the street, such space to be so located on the lot so as to meet the require- . ments of this ordinance for an accessory building. Section 9260.29. "HEIGHT OF BUILDINGS". The verticle distance from the average -level- of -the highest and lowest point of that portion 'of the lot covered by the building to the topmost point of the roof. Section 9260.30. "HOML". Any building or portion thereof containing six (6) or more guest rooms used, de- signed or intended to be used, let, or hired out to be oc- cupied, or which are occupied by six (6) or more individu- als for compensation, whether the compensation- for hire be paid directly or indirectly. Section 9260.31. "JUNK YARD". The use of more than 100 square feet of the area of any lot, for the storage of junk, including scrap metals, salvage or other scrap 73. Ord. No. 706 materials, or for the dismantling or"wrecking"of automobiles or other vehicles, or machinery, whether for sale or stor- age, Section 9260.32. "LOT". See Building Site . Section 9260.33. "NON-CONFORMING USE" . A use that does not conform to the regulations for the district in which it is situated. Section 9260.34. "PARKING SPACE". An accessible and usable space on the building site at least eight (8) feet by twenty (20) feet , located off the street with access for the parking of automobiles. Section 9260.3-5. "PROFESSIONAL OFFICE" . An office for the conduct of any one of the following uses a only: Accountant, architect, attorney, chiropractor, opto- metrist , engineer, surveyor, collection Agency, dentist, physician and surgeon, funeral parlor, insurance office, private detective , real estate office, social worker, or similar use. Section 9260.36. "ROOMING HOUSE". See boarding house. Section 9260.37. "SIDE AND FRONT OR CORNER LOTS" . For the purpose of this ordinance the narrowest frontage of a corner lot facing the street is the front, and the longest frontage facing the intersecting street is the side irrespective of the direction in which the dwelling faces. 74. Ord. No. 706 Section 9260.38. "STREET". A public thorough- fare accepted by the City of Huntington Beach which affords principal means of access to abutting property, including avenue , place , way, drive , lane , boulevard, highway, road, and any other thoroughfare except an alley as defined herein. Section 9260.39. "STREET LINE" . The boundary between a street and property. Section 9260.40. "STRUCTURE" Anything construct- ed or erected, the use of which required location on the ground or attachment to something having location on or in the ground, including swimming pools. Section 9260.41. "STRUCTURAL ALTERATIONS". Any change in the supporting members of a building, such as bearing walls columns, beams or girders. Section 9260.42. "TRAILER COURT". Land or prem- ises used or intended to be used, let or rented for occu- pancy by or of trailers or movable dwellings, rooms or sleep- ing quarters of any kind. Section 9260.43.. "USE". The purpose for which land or premises of a building thereon is designed, arranged, or intended or for which it is, or may be occupied or main- tained. Section 9260.44. "USE-ACCESSORY". ' A use incid- \ 75 . Ord. No. 706 ental and accessory to the principal use of a lot or a build- ing located on the same lot. Section 9260,45. "YARD" . An open space other than a court on the same lot with a building, which open space is unoccupied and unobstructed from the ground upward, except as otherwise permitted in Section 9240.5. $6ctibn 9260.46. "YARD-FRONT",. A yard extending across the front of the lot between the inner side yard lines and measured from the front line of the lot to the nearest line of the building; provided that if any building line of Official Plan Line has been established for the street upon which the lot faces, then such measurement shall be taken from such Building Line or Official Plan to the nearest line of the building. Section 9260.47. "YARD-REAR". A yard extending across the full width of the lot and measured between the rear line of the lot and the nearest line of the main build- ing. Section 9260.48. "YARD-SIDE". A yard between the side line of the lot and the nearest line of the build- ing and extending from the front line of the lot to the rear yard. 76. Ord. No. 706 , Section 20. That Sections 9261, 9262, 9262.11 9262.2 and 9262.3 of the Huntington Beach Ordinance Code be, and they are hereby repealed. Section 21. That Article 927 of the Huntington Beach Ordinance Code be amended, to read in words and fig- ures, as follows : ARTICLE 927 INTERPRETATION Section 22. There is hereby added to the Hunt- ington Beach Ordinance Code, the following new sections to read in words and figures, as follows: Section 9270. Interpretation. Section 9270.1. When interpreting and applying the provisions of this ordinance , they shall be held to be the minimum requirements adopted for the promotion of tI-B public health, safety, comfort, convenience and general welfare. Except as specifically herein provided, it is not intended by the adoption of this ordinance to repeal, abrogate, annul, or in any way to impair or interfere with any existing provis- ion of law or ordinance , or any rules, regulations or per- mits previously adopted or issued, or which shall. be adopted or issued pursuant to law relating to the erection, construct-. 77 • Ord. No. 706 ion, establishment, moving , alteration, or enlargement of any building or improvement. It is not intended by this ordinance to interfere with or abrogate or annul any easement , covenant or other agreement between parties. However, in cases in which this ordinance imposes a greater restriction upon the erection, construction, establishment, moving, alteration or enlargement of buildings, or the use of any building or premises in any district or districts that. is im- posed or required by such existing provisions of law or ordi- nance, or by such rules, regulations or permits, or by such easements, covenants or agreements, then in such case the pro- visions of this ordinance shall control. . Section 23. That Sections 9271, 9271.11 9272,9273, 9273.11 9273.27 9273.3, 9271+1 92757 9276 and 9277 of the Huntington beach Ordinance Code be , and they are hereby re- pealed. Section 24. That Article 928 of the Huntington Beach Ordinance Code be amended to read in words and figures, as follows: ARTICLZ 928 ENFORCEMENT, PENALTIES AND LEGAL PROCEDURE Section 25. There is hereby added to the Huntington Beach Ordinance Code, .the following sections to read in words and figures as follows: 78. Ord. No. 706 Section 9280.Enforcement,Penalties and Legal Procedure. _ Section 9280.1. All departments, official and pub- lic employees of the City of Huntington Beach vested with the duty or authority to issue permits or licenses shall conform to the provisions of this ordinance, and shall issue no permit or license for uses , buildings, or purposes in conflict with the provisions of this ordinance ; and any such Permit or license issued in conflict with the provisions of this ordinance shall be null and void. It shall be the duty of the Building Inspector of the City of Huntington Beach to enforce the provisions of this ordinance pertaining to the erection, construction, reconstruction, moving, conver- sion, alteration or addition to any building or structure. Section 9280.2. Any person, firm, or corporation, whether as principal, agent , employee or otherwise , violating or causing the violation of any of the provisions of this ordinance , shall be guilty of a misdemeanor, and upon con- viction thereof, shall be punishable by q fine of not more than $500.00 or by imprisonment in the City Jail of the City of Huntington Beach or County Jail of the County of Orange for a term not exceeding 180 days, or by both such fine and imprisonment. Such person, firm or corporation shall be deemed to be guilty of a separate offense for each and every day during any portion of which any violation of this ordi- nance is committed or continued by such person, firm or cor- poration, and shall be punishable as herein provided. 79. Ord. No. 706 Section 9280.3. Any building or structure set up erected, constructed, altered, enlarged, converted, moved or maintained contrary to the provisions of this ordinance , and any use of any land, building or premises established, conducted, operated or maintained contrary to the provisions of this ordinance shall be , and the same is hereby declared to be, unlawful and a public nuisance; and the City Attorney of said City shall, upon order of the City Council, immed- iately commence action or proceedings for the abatement and removal and enjoinment thereof in the manner prescribed by law, and .shall take such other steps and shall apply to such courts as may have jurisdiction to grant such relief as will abate and remove such building or structure, and restrain and enjoin any person, firm or corporation from setting up, erecting, building, maintaining or using any such building contrary to the provisions of this ordinance. Section 9280.4. The remedies provided for herein shall be cumulative and not exclusive . Section 26. That Sections 9281, 9282, 92837 92.847 9285 and 9286 of the Huntington Beach Ordinance Code be , and they are hereby repealed. Section 27V. That .Article 929 of the Huntington Beach Ordinance Code be amended to read in words and figures as follows: 80. Ord. No. 706 , ARTICLE 929 SEVERABILITY 3 NAME3 ENACTING Section '23, There is hereby added to the Huntington Beach Ordinance Code , the following new sections to read in words and figures as follows: Section 9290.1. Severability, Name , Enacting. Section 9290.11. If any section, subsection, sen- tence, clause or phrase of this ordinance is for any reason held by a court of .competent jurisdiction to be invalid, such decision shall not affect the validity of the remaining por- tions of this ordinance . The City Council hereby declares that it would have passed this ordinance and each section, subsection, sentence , clause and phrase hereof, irrespective of the fact that any one or more sections, subsections, sen- tences, clauses or phrases be declared invalid. Section 9290.12. This ordinance shall be known and cited as the Zoning Ordinance of the City of Huntington Beach, California. Section 29. Ths.t Sections 9291, 9292, 9292.11 9292.21 9293, 9293.11 9293.21 9293.39 9293.31 , 9293.47 9293.41 , 9293-.51 9293.61 9293.61 , 9293.62,9293.7, 92949 92957 9296, ,9296.1 and 9297 of the Huntington Beach Ordinance Code be , and they are hereby repealed. 81. Ord. No. 706 , Section 30. That Chapter 31+, Articles 340, 31+1 and all sections of said Chapter and Articles of the Hunt- ington Beach Ordinance Code are hereby repealed. Section 31. That Article 852 of Chapter 85 and all sections of said Article 8.52 of the Huntington Beach Ordinance Code are hereby repealed. Section 32. That Chapter 93, Articles 930, 931 , 9327 9337 9341 935, 936, 937, 9387 939 and all sections of said Chapter and Articles are hereby repealed. Section 33. That Chapter 94, Articles 91+0, 941, 9'4 6, - 942, 91+37 944, 945%and all sections of said Chapter and Articles of the Huntington Beach Ordinance Code are hereby repealed. Section 34. That Chapter 95, Articles 951 , 952, 9537 9547 955 and all sections of said Chapter and Arti- cles of the Huntington Beach Ordinance Code are hereby repealed.
