AN ORDINANCE OF THE CITY OF HUNTINGTON
BEACH-ADDING A NEW SECTION TO TBE HUNT-
INGTON BEACH ORDINANCE CODE RELATING ,
TO UNCLAIMED. PROPERTY IN POSSESSION OF.
THE POLICE DEPARTMENT,
The City Council of the City of Huntington Beach,
California, do ordain as follows:
Section 1. That Section 1269.1 be and the same is
hereby added to the Huntington Beach Ordinance Code to
read in words and figures as follows:
. Section 1269,1. Disposition of Unclaimed Property.
All unclaimed property in the possession of the Police De-
partment shall be handled and disposed of after complying
with the provisions of Section 1873 of the Civil Code of
the State of California, as follows:
(a) Such property shall be held by the Police Depart-
. ment for a period of at least six (6). months.
(b) Thereafter, if not reclaimed as herein provided
such unclaimed property shall be ..sold at public auction to
the highest bidder, provided, however, that in the event
said property cannot be sold at public auction, it may be
given away to any fraternal, benevolent, patriotic, charit-
able ,or religious organization not organized for profit; but
if any such property is of no value and cannot otherwise be
disposed of by gift or sale, it may be destroyed as junk.

(c) Notice of such sale at public auction shall be

given by the Chief of Police at least five (5) days before
the time fixed therefor by publication in a newspaper of
general circulation published in the City specifying the
time and place where such public sale will be held and general-
ly describing the property to be sold at said public auction.
(d) In the event the owner of any such property shall
appear on or before the date fixed for the sale thereof at
public auction and reclaim said property and reimburse the
City for all expenses incurred in the care and preservation
of the property, then said property shall be restored to the
owner.
Section 2. The City Clerk shall certify to the pass-
age and adoption of this ordinance and shall cause the same
to be published by one insertion in the Huntington Beach
News, a weekly newspaper, printed, published and circulated
in the City of Huntington Beach, California, and thirty (30)
days after the adoption thereof, the same shall take effect
and be in force.
PASSED AND ADOPTED by the City Council of the City of
Huntington Beach, California, this 16th day of February
1959.

officio Clerk of the City Council of said City, do hereby
certify that the whole number of members of the City Council
of the City of Huntington Beach is five; that the foregoing
Ordinance was read to said City Council at a regular meeting
thereof held on the 2nd day of February, 1959, and was
again read to said City Council at a regular meeting thereof
held on the 16th day of February , 1959, and was
passed and adopted by the affirmative vote of more than a
majority of all the members of said City Council.
