HomeMy WebLinkAboutOrdinance #732 ORDINANCE No. 732 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH APPROVING THE ANNEXATION OF CER- TAIN UNHABITED TERRITORY DESIGNATED AS "WEST ANNEXATION" TO THE CITY OF HUNTINGTON BEACH. The City Council of the City of Huntington Beach, Calif- ornia, does ordain as follows: WHEREAS, pursuant to the provisions of the "Annexation of Uninhabited Territory Act of 1939' the City Council of the City of Huntington Beach did, on the 21+th day of June , 1959, pass and adopt Resolution No 1381, giving notice of the proposal to annex certain uninhabited territory to the City of Huntington Beach, said territory being. therein designated as "West Annexation" and said action being taken by the Council of said city as the legislative body of the city, pursuant to a written petition therefor, said Reso- lution describing the boundaries of the territory so pro- posed to be annexed to said city; and WHEREAS, said Resolution No. 1381, did contain a notice of the day, hour and place .when and where the said council of said city would .hear protests made by any per son owning property within the territory proposed to be annexed, the time of said., hearing being not':less than A+0 nor more than 60 days after the passage of said Resolutions, and WHEREAS, on the 17th day of August, 1959, at the hour 1. . � Ord. No. 732 of 8:00 o'clock P.M. in the Council Chambers in the City Hall of the City of Huntington Beach, State of California, said time and place being the day, hour and place fixed in said Resolution No. 1381 for hearing protests to the said annexation and said hearing having been continued to the 8th day of September, 1959, at the hour of 8:00 o'clock P.M. in the Council Chambers in the City Hall of the City of Huntington Beach, State of California, and"no protests, either written or oral, to said annexation having been made; and WHEREAS, said territory is contiguous to the City of Huntington Beach, and is uninhabited territory in the County of Orange ; and WHEREAS, the owners of more. than two-thirds of the value of the territory have heretofore filed with the City Clerk written consent that the property in sand territory bey after annexationi subject to taxation equally with the property within the City of Huntington Beach to pay the entire bonded indebtedness of the City of Huntington Beach outstanding or authorized at the date of the filing of the petition for annexation for the acquisition, construct- ion or completion of municipal improvements. Ord. No. 732 NOW THEREFORE,. the City Council of the City of Hunt- ington Beach does hereby approve the annexation known as "West Annexation" , the territory of which is hereinafter .described, to the City of Huntington Beadh and does hereby further ordain that the said .territory be and is hereby annexed to the City of Huntington Beach. That said territory, the annexation of which to the City of Huntington Beach is herein approved, is all that territory situate in the County of Orange, State of Calif- ornia, and more particularly described as follows: "Commencing at the Northeast corner of Section 20, Township 5 South, Range 11 West, San Bernardino Base and Meridian; thence Northerly, along the East line of Section 17, T. 5 S. , R. 11 W. , S.B. B. & M. , 30 feet to a point; thence Westerly 30 feet to a point in the West line of Bolsa Chica Street, 60 feet in width as now laid out, said point being in the existing boundary line of the City of Huntington Beach and said point being also the true point of beginning; thence Westerly along the North line of Smeltzer Avenue , 60 feet in width as now laid out , said line being 30 feet North of and parallel to the North line of said Section 20, 3930 feet more or less to a point in the northerly prolongation of the. West line of 3• Ord. No, 732 the East one-half (E--) of the Northwest one-quar- ter (NWT) of said Section 20; thence Southerly along said West line of the East one-half (E-J) of the Northwest one-quarter (NW- ) and its Norther- ly prolongation 2010 feet more or less to a point in the North line of the South one-half (S2) of the South one-half (S*) of the North one-half (N2) of said Section 20, thence Easterly on said North line a distance of 3930 feet more or less to a point in the West line of B olsa Chica Street, said point being also in the existing boundary line of the City of Huntington Beach; thence Northerly along said West line of Bolsa Chica Street and said boundary line 2010 feet more or less to the true point of beginning." The boundaries of said City of Huntington Beach are hereby altered and the said territory above described is hereby annexed toy incorporated in and included within the City of Huntington Beach, California, and said City shall have all rights and powers ins to and over said terr- . itory as are provided by law. The City Council of the City of Huntington Beach does hereby further ordain that the territory above described shall be subject to taxation equally with the entire bonded indebtedness of the City of Huntington Beach outstanding on June .24th, 19599 the date of the filing of the Petition: Ord. No. 732 for Annexation of said territory or theretofore authorized, for the acquisition, construction or completion of munici- pal improvements. The City Clerk shall certify to the passage and adopt- ion of this Ordinance and shall cause the same to be- pub- lished by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and circulated in the City of Huntington Beach, California; and thirty (30) days after the adoption thereof, the same shall take effect and be in force.
