HomeMy WebLinkAboutOrdinance #748 t ORDINANCE No. 748 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH-APPROVING THE ANNEXATION OF CER- TAIN- UNINHABITED TERRITORY DESIGNATED AS"WEST ANNEXATION No. 2" TO THE CITY OF, HUNTINGTON BEACH The City Council of the City of Huntington Beach, Calif-. orn:ia.j does ordain as follows: WHEREAS, pursuant to the provisions of the "Annexation of Uninhabited Territory Act of 1939", the City Council of the City of Huntington Beach did, on. the 16th day of Novem- ber, 1959, pass and adopt Resolution No. 1398, giving notice of the proposal to annex certain uninhabited territory to the. City of Huntington Beach, said territory being therein desig- nated as "West Annexation No, 2" and said action being taken by the Council of said City as the legislative body of the city, pursuant to a written petition tYn refor, said Resolu- tion describing the boundaries of the territory so proposed to be annexed to said city; and WHEREAS, said Resolution No. 1398, did contain a notice of the day, hour and place when and where the said council of said city would hear protests made by any person owning property within t h territory proposed to be annexed, the time of said hearing being not less than 40 nor more than 60 days after the passage of said Resolution; and WHEREAS, on the 4th day of January, 1960, at the hour 1a Ord. No. 748 of 8t00 otclock P.M. in the Council Chambers in the City Hall of the City of Huntington Beach, State of California, said time and place being the day, hour and place fixed in said Resolution No. 139.8 for hearing protests to the ' said annex. ation and no protests, either written or oral, to said annex- ation having been made; and WHEREAS, said territory is contiguous to the City of Huntington Beach, and is uninhabited territory in the County of Orange ; and WHEREAS, the owners of more than two-thirds of the value of the territory have heretofore filed with the City Clerk written consent that the property in said territory be, after annexation, subject to taxation equally with the prop- erty within the City of Huntington Beach to pay the entire bonded indebtedness of the City of Huntington Beach outstand- ing or authorized' at the date of the filing of the petition for annexation for the acquisition, construction or comple- tion of municipal improvements. NOW THEREFORE, the City Council of the City of Hunting- ton Beach does hereby approve the-annexation known as "West Annexation No. 2" , the territory of which is hereinafter de- scribed, to the City of Huntington Beach and does hereby further ordain that the said territory be and is hereby an- nexed to the City of Huntington Beach. 2. Ord. Noi 748 "Commencing at a point in the city boundary of the City of Huntington Beach, said point being Also the point of intersection of the south line of Gerhart (Heil) Avenue said street right- of-way now being .40 feet in width, and the west line of Bolsa Chica Road, said street right-of- way now being 60 feet in width; thence soutIm rly on the West line of Bolsa Chica Road a distance of 1321 feet, more or less to the point of in- tersection of said west line of Bolsa Chica Road with the prol'on ation of the south line of Block 1, Tract No. 89 as shown on a map there- of recorded in Book 1,, Pages '35 and 36, Miscel- laneous Maps, Records of Orange County Calif. ornia; thence easterly on said south line a distance of 693 feet more or less to the east line of said Block 1; thence northerly on said east line and its northerly prolongation a dis- tance of 1321 feet , more- or less to a point in the - city boundary of the City of Huntington Beach; thence westerly a distance of 693 feet more or less to the point of beginning". The boundaries of said City of Huntington Beach are hereby altered and the said territory above described is hereby annexed to, incorporated in and included within the' Gity of Huntington Beach, California, and said City shall have all rights and powers in, to and over said terr- itory as are provided bylaw. The City Council of the City of Huntington Beach does hereby further ordain that the territory above described shall be subject to taxation equally with the entire bonded indebtedness of the City of Huntington Beach outstanding on October 23rd, 1959, the date of the filing of the Petition, for Annexation of said territory or theretofore authorized for the acquisition, construction or completion of municipal improvements. Ord. No. : 748 .The City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and circulated in the City of Huntington Beach, California; and thirty (30) days after the adoption thereof, the same shall take effect and be in force-.
