HomeMy WebLinkAboutOrdinance #755 f ORDINANCE No, 755 AN ORDINANCE OF THE CITY OF HUNTINGTON ; BEACH AMENDING .THE HUNTINGTON BEACH OR- DINANCE CODE RELATING TO R-5 DISTRICTS1 ME ANDING, ADDING AND REPEALING SECTIONS OF SAID ORDINANCE CODE. The City Council of the City of Huntington Beach do ordain as follows: Section l: That the title of Article 939 of Chapter 93 of the Huntington Beach Ordinance Code is hereby amended, and as amended shall read in words and figures as follows: ARTICLE 939 R-5 and R-5-0 DISTRICTS Section 2: That Section 9391 of the Huntington Beach Ordinance Code is hereby amended and as amended shall read in words and figures as follows: Section 9191. Professional, Motel and Trailer Park District. Statement of Intent and Purposes. A. This district is primarily intended for land and structures to provide hote19 motel,_. trailer park and high density housing accomodations for transientsq small family groups and vaca- tion visitors. It is further intended to pro- vide as a part of these accomodations such per- sonal services establishments as are necessary to serve the occupants. B. It is further intended to provide professional: . services in addition to the above accomodations. C. The district is not however, intended for gen- eral shopping or merchandising. Section 3: The following new sections are hereby added 1. Ord. No. 755 to the Huntington Beach Ordinance Code, Sections 9391.11 9391.119 9391.12, 9391.13, 9391.14, 9391.159 9391.21 9391.31 9391.41 9391.5, which sections shall read in words and fig- ures as follows: Section 9191.1. Uses Permitted'. The following permitt- ed uses and regulations shall apply in the "R-5" Profession- al, Motel and Trailer Park Districts: All front and side yard requirements shall be in addition to those required by the Master Plan of Streets and Highways. All provisions of the Mas- ter Plan. of Streets and Highways shall be appli- cable in this Article. All parking requirements specified shall include adequate ingress and egress in accordance with Commission policy. Section 9191,11, Professional Offices: Professional services may be located in profess- ional business buildings. or other office struct- ures and not necessarily within hotels, motels, trailer parks or apartment buildings. Professional offices are defined as office for the conduct of anyone of the following uses only: Accountant, architect, attorney, chiropractor, collection agency, dentist, engineers, insurance, broker, optometrist physician and surgeon, pri- vate detective, real estate sales , social worker surveyor; pharmacies, diagnostic laboratories, biochemical laboratories - where they do not ex- ceed 1500 sq. ft. in gross floor area or similar use approved by the Planning Commission. Parking Requirements. (10 ft. x 20 ft.) One parking space for each 300 sq. ft, gross floor area. Minimum Area- 7000 sq. ft. 2. Ord. No. 755 Section 9391.12. Hotels. Motels and Trailer Parks. Permitted in this District only with a business license. Minimum Area for Trailer Parks: 2.5 acres. Maximum Density for Trailer Parks: 14 spaces per Bross acre Trailer Park Wall Requirements. Five foot concrete block or masonry wall or equiv- alent as approved by the Planning Commission shall. be required as a buffer on all boundaries of Trailer Park. Trailer Park Sewers. Connected sanitary sewer line system shall be re- quired in all cases. Minimum Area for Motels: 9,000 sq. ft. Minimum Frontage for Motels or Trailer Parks: 70 feet. Parking Requirements: (10 ft. x 20 ft.) One parking space for each dwelling, trailer space or sleeping unit. Section 9321,11. Service Establishments. Permitted in this District within a hotel, motel or trailer park. In all cases the major entrance shall be by way of an inner court or lobby for the devel- opment. No major or puglic entrance shall be per- mitted access to the front yard area. Service Establishments Defined: Restaurants cocktail lounges, barber shops, beauty shops, laundry or dry cleaning agencies travel bureaus, magazine stands and other similar uses which meet the approval of the Planning Commission. Minimum Area: None specified. Parking Requirements: (10 ft. x 20 ft.) One parking space for each 300 sq. ft, of gross floor area. 3• Ord. No. 755 Section 9391.14. Multiple Family Dwelling Units. Permitted in this District, except that two units or less are not permitted. Lot Area Per Apartment Units: There shall be at least 750 sq. ft. of lot area for each apartment for each single dwelling unit. Parking Requirements: (lo ft. x 20 ft.) One garage or carport for each dwelling unit minimum Minimum Area: 7,000 sq. ft. Minimum Frontage: 70 ft. Section':.9391.15. Public and Quasi Public Uses. Churches lodges, fraternity houses, private or public educational institutions, rooming houses, boarding houses and rest homes. Parking Requirements: ( 10 ft. x 20 ft.) One parking space for each six seats in churches or places of public assembly. One space for each dwelling or sleeping unit where applicable. Minimum Area: 6,000 sq. ft. Minimum frontage: 60 ft. Section 9391.2. Yard Requirements for All Permitted Uses: Front Yard: Five feet minimum, except thAt along all state highway frontage there shall be required a minimum of 50 feet set- back from existing right-of-way. Side Yard: Five feet minimum. Rear Yard: Five feet minimum, except where permitt- ed use abuts an R-1 Zone District, then there shall be required a minimum of 15 feet. 4. Ord. No. 755 Dwelling Distance: Minimum distance between unat- tached dwelling groups 20 feet Minimum_ distance between garage or carport and .unattached dwell- ing groups - 10 ft. Section 9391.3. Height Limitations All Permitted Uses: Maximum building height: 35 feet or three stories. Section 9391.4. Signs - All Permitted Usesz Only signs pertaining to the business of occupants located on the premises shall be permitted in the R-5 Zone. Lighted or unlighted signs which are not attached to the building advertising the business or services conducted on the premises may be erected in the follow- ing conditions: a. The sign area shall not exceed one sq.ftt for each two ft. of premises frontage but not to exceed one hundred sq.ft. maximum. In all cases a minimum sign area of 25 sq.ft. shall be permissible. b. The sign shall be located not further from the center of the premises frontage than a distance equal to 20% of such frontage , unless the written permission of the owner or lessee of adjoining prop- erty nearest the sign location is filed with the Building Department. c. If sign is not attached to a building each support shall not exceed eight (8) inches in width or diameter and if mare than one support is used, a clear unob- structed opening not less than thirty (30) inches wide shall be provided and maintained between supports. Section 9391.5. Dedication and Improvements. a. Dedication. No building shall be used or constructed for any uses permitted in 5. I Ord. No. 755 the "R-5 P-M-T District", nor shall a permit for the construction of such building be issued by the Building De- partment, nor shall any land be used, where the land upon which such build- ing is to be used or constructed or where the land to be used for said uses abuts upon and the ingress or egress to the said building is upon any indi- cated Arterial Highway shown on the Master Plan of Streets and Highways adopted February 1g57 `and as hereafter amended, until and unless the right-of- way for such highway to the width shown on the Master Plan has been dedicated to or vested in the City of Huntington Beach. b. Improvements. No final notice of com- pletion be issued by the Building De- partment until such required dedication of right-of-way as described in sub- paragraph a of this section has been improved by installation of curbs, gutters and street drainage in full compliance with City of Huntirg ton Beach street standards, or until, with the consent of the City Engineer, an agreement is entered into with the City in accordance with an accepted plan of improvements. In the event an agree- for the improvements is entered into, the City Council may require that the agreement be secured by a good and sufficient bond, or it may accept in lieu thereof a cash deposit, which bond or cash deposit shall be in an amount equal to the cost of the improvements estimated by the City Engineer, Section 46 That Sections 9392, 9392.11 9392.21 9392.39 9392.41 9392.417 9292.E+2, 9392.43, 9392.57 9392.69 93939 93949 9395, 9395.11 9395..21 9395.31 9396, 9397 and 9398 of the Hunt- ington Beach Ordinance Code be, and they are hereby repealed. 6. Ord. No. 755 Section 5. That Section 9393 is hereby re-enacted and as re-enacted shall read in words and figures as follows, to-wit: Section 9393• R-5-0 Professional and Trailer Park District Combined with Oil Production: All of the pro- visions applicable to R-5 District shall apply to the R-5-0 District; provided, however, that drilling and operating for the discovery and production of oil, gas, hydrocarbon and all other kindred substances in their natural state shall be permitted in the R-5-0 District. Section 6. Section 9211.1 of the Huntington Beach Ordinance- Code is hereby amended, and as amended shall read in words and figures as follows: Section 9211.1. Designation of Districts. A-1 R-3-0 C-2 R-1 R-4 C-3 R-1-0 R-4-0 C-3-0 R-2 R-5 M-1 R-2-0 R-5-0 M-1-0 R-3 C-1 M-2-0 S-1 Suffix "X" added to district designation indi- cates district - as, -adopted by Inter- im Ordinance No. 668. Suffix "Y" added to district designation indi- cates district as -adopted by Inter- im Ordinance No. 672. (both Interim Ordinance No. 668 and 672 adopt Orange County Land Use Ordinance No 351 by reference) 7. Ord.No. 755 Section 7. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper printed, published and circulated in the City of Huntington Beach, California, and thirty (30) days after the adoption thereof, the same shall take effect and be in force.
