HomeMy WebLinkAboutOrdinance #762 ORDINANCE No. 762 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE RELATING TO REFUNDS ON WATER LINE EXTENSIONS. The City Council of the City of Huntington Beach do ordain as follows: Section 1. That Sections 3556 and 3556.1 be,and they are hereby repealed. Section 2. That Section 3556.2. is hereby amended, and as amended, shall read in words and figures as follows: Section 3556.2. CONDITIONS GOVERNING REFUNDS: Notwithstand- ing any other provisions of this Ordinance, the payment of refunds shall be governed as follows: (a) Refunds shall be payable for a period of five (5) years only from the date of applicant ' s application for main line extension. (b) Refunds shall be made from subsequent development as set forth in Section 3530 of the Huntington Beach Ordinance Code. (c) Refunds shall not exceed 90% of offsite construction costs. (d) Refunds shall bear no interest. 1 . Ord.. . No. 762 (e) Refunds shall be payable only to the original applicant or. applicants. Upon death of applicant, the right to refund shall terminate. In the event applicant is a partnership or corporation, the dissolution of the partnership or corporation shall terminate the right to refund. (f) The City and City Water Department shall not be liable for payment of any refund by reason of its failure to collect or receive from any person the service fee for connecting into the main line paid for by applicant . (g) The City Water Department' s refusal to allow any con- nection or-- connections into the main line paid for by appli- cant shall not make the City or City Water Department liable to applicant for any refund which might have accrued to appli- cant if such connection had been permitted. (h) The City retains the right to allow a connection by any public agency exempted from payment of connection fees and City shall not be liable to applicant for refund because of said connection. Section 3. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and circulated in the City of Huntington Beach, California, and thirty (30) days after the adoption thereof, the same shall take effect and 2.
