HomeMy WebLinkAboutOrdinance #763 ORDINANCE No. 763 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTION 8720.1 RELATING TO TRAILERS. The City Council of the City of Huntington Beach do ordain as follows: Section 1. That Section 8720.1 of the Huntington Beach Ordinance Code is hereby amended, and as amended, shall read in words and figures as follows: Section 8720.1. Unlawful Use. It shall be unlawful for any person to park, leave parked, use , occupy or main- tain any trailer coach upon any area or tract of land with- in the City of Huntington Beach, except as follows: (a) A trailer coach may be parked and used as living quarters in a licensed trailer park. (b) A trailer coach may be parked for display, for sale, and/or trade purposes on a trailer sales lot for which a current business license has been issued. (c) A trailer coach may be parked upon the streets within the City of Huntington Beach during the daylight hours, if not in violation of any other parking rule or regulation applicable to the area. 1. Ord. No. 763 (d) A trailer coach may be parked for storage purposes upon private property within the City of Huntington Beach if a permit therefor has been issued by the Building Department. To secure such permit, application shall be made to the Building Department upon forms provided by the Department and shall be accompanied by a fee of $ LVO . Such permit shall be valid for not to exceed a year from the date of issuance. The Building Department shall not issue such per- mit unless the area where said trailer coach is to be parked complies with the setback and yard area requirements of Chapter 93 of the Huntington Beach Ordinance Code. In the event that the application is denied by the Build- ing Department, the applicant may, within ten (10) days, appeal by filing written notice of appeal with the City Clerk. The City Council shall hear said appeal within thirty (30) days after its filing by the applicant and the Council may grant or deny the permit; provided, however, that no waiver of yard area and setback requirements applicable to said trailer, as provided in this section, shall be granted by the City Council unless a public hearing has been held by the Council. Notice of said hearing .shall be given by mail- ing a postcard or other written notice setting the time and and place of the hearing, the name of the applicant,/ the address at which the trailer is proposed to be stored not less than ten (10) days prior to the date of hearing mentioned therein, to the owners of all property within 150 feet of the exterior 2. Ord. No. 763 boundaries of the described property, using for this purpose the last known address of such owner or address given for such owner on the last equalized assessment roll. Section 2. The City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach Newsq a weekly newspaper, printed7 published and circulated in the City of Huntington Beach, California, and thirty (30) days after the adoption thereof9 the same shall take effect and be in force.
