ORDINANCE No. 767 AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH DECLARING AN EMERGENCY TO EXIST AMENDING THE HUNTINGTON BEACH ORDINAME CODE RELATING TO SUBDIVISIONS BY AMENDING SECTION 9741.4 OF CHAPTER 97 OF THE HUNTINGTON BEACH ORDINANCE CODE'. The City Council of the City of Huntington Beach do ordain as follows : WHEREAS, the Planning Commission has made studies relating to the density of housing within the City of Hunt- ington Beach and has adopted its resolution recommending to the City Council that the area of lots. be increased to a minimum of 7200 square feet; and WHEREAS, the Chamber of Commerce and other inter- ested parties have submitted to the Council their recommend- ations for changing of the minimum lot area; and WHEREAS, said Council has had under submission and has studied said matter; and WHEREAS, the areas within the City of Huntington Beach are being subdivided at such a rapid rate and the density of the population in accordance with the present min- imum lot requirement does not adequately provide for and pro- tect the public peace, property, health and safety of the residents of the City, and ,that there are proposed to be filed with the City tentative maps for in excess of 5,000 homes on small minimum lot areas which would, if approved by Ord. No. 767 the City, be detrimental to the best interest and welfare of the citizens and create problems of health, safety, ,school housing, police, traffic, fire and other problems and would not be conducive to the best interest of the inhabitants of the area nor protect the public health, property, peace and " safety of the citizens of this city; NOW THEREFORE, in consideration of and by the above preamble and statement, the City Council of the City of Hunt- ington Beach declares and defines that an emergency exists necessitating the following ordinance for the immediate pro- tection and preservation of the public peace, health, safety and welfare of the residents of the City of Huntington Beach: Section 1. That Section 9741.4 of Chapter 97 of the Huntington Beach Ordinance Code is hereby amended, and as amended, to read in words and figures as follows: Section 9741.4. This ordinance being an emergency measure for the immediate preservation of the public health and safety, which emergency is set forth and defined in the preamble hereto, shall take effect and be in force from and after the passage and' ' adoption hereof. That the City Clerk shall certify to the passage and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and circulated in the City of Huntington Beach, California, PASSED AND ADOPTED by the City Council of the City of Huntington Beach, California, this day of , 1960.
