HomeMy WebLinkAboutOrdinance #810 ORDINANCE No. 810 AN ORDINANCE OF THE CITY OF HUNT INGT ON BEACH AMENDING THE HUNTINGTON BEACH OR- DINANCE C ODE 'AND ESTABLISHING SETBACK LINES. WHEREAS, the Planning Department of the City of Hunt- ington Beach has held public hearings, as required by law, and made its recommendations by resolution to the City Council recommending the adoption* of setback lines .within the City of Huntington Beach; and WHEREAS, the City Council has held a public hearing, as required by law and the City Council has determined that it is for the best interest and the general welfare of the inhabitants of said City that setback lines be adopted; NOW THEREFORE, the City Council of the City of Hunt- ington Beach, California, do ordain as follows: Section 1. That the Huntington Beach Ordinance Code is hereby amended by adding a new section thereto, which new section shall read in words and figures as follows, to wit. Section 9528. Establishment of Setback Lines. F-IN COMPUTING THE DEPTH OF A REAR YARD FROM ANY BUILDING WHERE SUCH YARD OPENS ON AN ALLEY , PUBLIC PARK OR PUBLIC BEACH I ONE HALF (1/2) OF THE WIDTH OF SUCH ALLEY, PARK, OR BEACH MAY BE DEEMED TO BE PORTION OF THE YARD , EXCEPT THAT UNDER THIS PROVISION NO REAR YARD SHALL BE LESS THAN 15'. WITHIN ALL COMMERCIAL AND INDUSTRIAL DISTRICTS WHERE TWO ARTERIAL HIGHWAYS INTERSECT ; THERE SHALL BE REQUIRED A TRAFFIC SAFETY VISION SIGHT-ANGLE SETBACK AREA CONSISTING OF A TRIANGULAR AREA BOTH OF WHICH LEGS SHALL EXTEND 20 FEET ALONG AND DISTANCE FROM THE INTERSECTING PROPERTY 'LINES; AND SUCH AREA SHALL BE DETERMINED AS BEING WITHIN THE HYPOTENUSE AND THE TWO 20 FOOT LEGS OF THE DESCRIBED RIGHT TRIANGLE. THERE SHALL BE A 36" HEIGHT LIMITATION ON ANY PLANTING OR STRUCTURES WITHIN THE REQUIRED TRIANGULAR AREA. PREPARED BY THE HUNTINGTON BEACH PLANNING DEPT. DRAWN BY_-ft_ Section 2. The City Clerk shall certify to the pass- age and adoption of this ordinance and shall cause the same to be published by one insertion in the Huntington Beach News, a weekly newspaper, printed, published and circulated in the City of ' Huntington Beach, California, and thirty (30) days after the adoption thereof, the same shall take effect and be in force.
